Ha Ha Ha, great find. I would go to the Sherriff and make a criminal complaint against the company that sent the letter, and I would see if Kimberly Curth wanted to go with me and see what the Sherriff does and says.

He won’t be on paid leave long. The Department or the Chief will have an administrative hearing before taking any action… something about innocent until proven guilty. I know that’s a fairy tale for cops as well as non-cops, but you at least have to maintain appearances. As a tax payer I would rather they pay him a few weeks pay rather than fire him and then find out he is innocent; resulting in a huge lawsuit.

I doubt you will find many gunsmiths that can single point (of course that is rare for a “Machinist” now a days). Read the conversations and watch the videos when they are talking about machining or measuring; you will see what I mean. All you will need to do it see the mechanics and what needs to be done. It should be a piece of cake for a skilled machinist.

You can legally make your own gun and you don’t have to have an FFL to do it; you can’t transfer it. You can’t buy guns and fix them with the intent of flipping them without an FFL. An FFL only cost $200, the biggest stumbling block for most of us comes from local zoning laws and laws governing home businesses. The ATF checks that.

They probably aren’t sending you a box; they are sending you a pre-paid shipping label. If they wanted to verify ownership they would have done it before that. It is rare for S&W to charge for warranty work on their own guns; so I doubt they will charge anything on a Walther. If it was obvious to the gun smith you took it to that Bubba worked on it, they may charge you, but it would be less than a gunsmith, and it will be right. Smith & Wesson service is 2nd to none in the industry. They took some heat over some Walther problems and recalls because Walther couldn’t get them parts; but I think they handled it. If S&W says they will fix, I would think they will. But why is S&W fixing it? I thought that S&W quit being the importer for Walther? S&W makes the PPK here, and Walther makes the M&P22 there. I certainly would like to see that stop. I can’t round out my M&P collection until they start making it here.

  Yes I have. I work in manufacturing making aerospace components for such companies as Boeing, Lockheed, Airbus and Gulfstream. I was also the Applications Manager for a machine tool manufacturer and have traveled to manufacturing companies all over the U.S. and a couple of foreign countries. That’s why I was pretty sure someone was playing games with the numbers.   That makes more sense.

So is our economy and having gun manufacturers in the U.S. If our economy fails the Constitution will just be another piece of paper, but that doesn’t seem to matter to many.  

That isn’t what I said. I said it is a factor that with others can lead to Probable cause for a warrant or a search. There are a couple of SCOTUS decisions on it. They don’t need to have roadside “Beyond reasonable doubt” just enough to articulate probable cause in an evidentiary hearing. That also needs to include the dogs training and track record. This is one of the rare cases where there is no law to “Get rid of”; it’s one where we need a law. We need a law that says If the Officer isn’t making an arrest he can’t seize the money. If he seizes the money for an “Investigation” the DA has a reasonable amount of time (specified in the law) to file charges or return the money in full. If it’s a very large amount of money; you may have to deal with the IRS.

Something doesn’t make sense. The stories say 600 people work at Magpul. But a couple of other plastic injection molding companies actually produce the magazines (another couple of hundred jobs). If these numbers are right; what do the 600 people at Magpul do?

Most money in circulation is tainted with drugs. That coupled with other facts can lead to probable cause, but not by itself.

Police Superintendent Garry McCarthy and Mayor Rahm Emanuel just experienced a crime rate that is the highest it has been in 10 years. It is those two men’s jobs to make sure that doesn’t happen. They have failed. It’s easier to blame the state saying they can’t get the gun bans they want than it is to admit they aren’t very good at their jobs. But it is what it is; the worse the economy gets, the more it will happen in other states.

I don’t know that. If they damage your weapon while simply disarming you on a traffic stop; they (The Department) are responsible. If that happened I would request a Command Officer at the scene to document the damage, if they refused I would go to the department and make a complaint. I’m not saying that you would be happy about it, but saying a cop has no responsibility for your personal property is just wrong.

There should be “innocent until proven guilty” and we should have a “Justice system”. But we don’t. If the cops arrest you and the DA charges you; good luck convincing a Judge or jury you are innocent. And even if you do, at what cost? Justice? You will get as much “justice” as you can afford. You know as well as anyone here that am I pro cop and makes no bones about it, unless they give me evidence otherwise. But I’ve been told many times I should write a book on surviving a traffic stop. It’s not about the cops; it’s about having our kids not listen to some civics teachers/parents mindless ramblings about a vehicle search requiring a warrant, or teaching kids not to do and say stupid things when they are stopped. Their whole futures are in jeopardy at that very minute in their life and they need to know what to do and what the law is. Not listen to someone that skipped over the word “Unreasonable” when they read the 4th amendment, or is telling them to invoke their right to remain silent without knowing the circumstances.

Whether you like it or not there has been no “innocent until proven guilty” any more than there is a right to “Bear Arms”, and it will continue to that way until people acknowledge that fact and quit spouting myths. I put people in handcuffs, stuffed them in a car, towed their cars and took them to jail. They were booked into jail and if it was a misdemeanor they could bond out. If it was a felony, or they didn’t have the money to bond out they stayed in jail until they went before a Judge. As time passed they would go to court where they were allowed to try to convince a Judge or a Jury that they didn’t do what they were accused of. If you think that means anyone is “innocent until proven guilty” or that you don’t have to prove your innocence to a Judge or jury… so be it. I don’t believe in fairy tales. And it bothers me that parents teach their kids non-sense instead of knowing the law. Kids deserve a better education than some fairy tales about search warrants and what cops can and can’t do.

It might be a once in a career opportunity if you are standing there with a wad of cash in your hands and an arrest on drug charges. But if you find yourself standing on the side of the road with a wad of cash in your hand, no charges to file, and the owner of the money being allowed to drive away; there is a problem. I have no problem with seizing every single dime and asset a drug dealer has. But the law should require a criminal conviction to do it.

I disagree. I had thousands of dollars in my pocket when I went to North Carolina to buy a car. From what I have seen if I had been stopped on I-40 in Tennessee I could have very well been in danger of having my money seized if they ask me about cash and I answered truthfully. Cops that do that are thugs with badges, and are in the minority. You should be appalled at it. I blame the departments that allow it. They should be under investigation by the TBI and the FBI. I didn’t know about this at the time. I wouldn’t do it now. Cops fighting on the roadside for territory? Come on, how does that just go away? If I have 32K in cash on me and you don’t like my explanation; you get to seize it? Sorry, that is ridiculous.

Inventory search is because you are now in possession of the vehicle and are responsible for its contents. Officer safety has nothing to do with it. Does it allow a full blown search of the vehicle where everything found may be charged? Yes, it is as good as a warrant.

You can do anything you want, but Terry does not allow you to search my vehicle unless you articulate reasonable suspicious to believe there are weapons present. Of course plain view gives you a free pass and does not apply to what we are discussing. Michigan V Long was plain view. I’m taking exception with the statement you can search anywhere in my vehicle I can reach. I don’t believe that you can without cause. Plain view is cause and I guess you could make the argument an HCP is also. Cops before you searching without cause is how and why your hands are tied on the job now.

You need probable cause to impound a vehicle if you are going to search it for something. If you are impounding it because of an arrest or license/registration/equipment violation you have to do an inventory search…. That’s where a lot of charges come from; no warrant required.
