  1. Because most of them are attorneys and they might need the work (interpreting /defending/prosecuting) when they leave office.
  2. Ironically it may be the 7th U.S. Circuit Court and the Illinois Supreme Court that sends the “Bear Arms” outside the home to the SCOTUS. The 7th has affirmed in Moore v. Madigan that a citizen has the right to carry in public for self-defense. In a decision last month in Aguilar v. Illinois the Illinois Supreme Court overturned a conviction and upheld the 2nd amendment.   However, I believe the SCOTUS will see the carry issue as a States Rights issue. That’s why they have dodged a direct ruling on carry and may be reluctant to hear the case and leave it at the Federal District level. I see nothing from the present Supreme Court to think they are anti 2nd amendment; quite the opposite. We already have worked our way from the “bottom up”. The next step for Tennessee is Constitutional carry. The state is free to do what it wants and does not have to wait on a ruling by the SCOTUS (States Rights).
  3. It appears to me that we lose focus by arguing about all these non-sense laws or wanting to copy laws from other states that are not Constitutional carry states. Tennessee has gone as far as we can go with gun privileges. Our next obvious step is gun rights. Rights recognized for all citizens; not just those that pay the state for the privilege. Until we step into the “Rights” category, we are just a “Special Group” trying to claim Constitutional Rights; that dog won’t hunt. We are at that point. We need to be the 5th state.
  4. As has been posted many times all the law parking lot law does is decriminalize guns in cars for HCP holders in some locations. It does not protect you from being fired from your job or being expelled or suspended from school. Carrying a gun in Tennessee is a crime; the state does not recognize carry off your property as an individual right, ever…even with an HCP. Until that changes state government can’t force any person, property owner, business owner, or school to allow you to carry. Only a state that recognizes the right to keep and bear arms could do that.
  5. Yes, that’s affordable considering you need to pay for the health care of three or four other families that are either living off the government or are illegals. Obama is intentionally trying to destroy this country, and this is just one of the ways that show it. He doesn’t have to worry about elections anymore and I don’t think you have seen the worst of it yet. Our representatives are allowing this. This is the best this country has to offer from those who vote.

  9. And then what? The people that could fix this problem couldn’t get elected. The majority of voters wouldn’t like their ideas, many countries wouldn’t, and even many of the people on this forum wouldn’t.   Almost every well known economist and financial expert has said our economy cannot recover until our manufacturing base recovers. That can’t happen without the support of both the people and the government.
  10. Think on a grander scale (in case you travel). Would a reasonable person (that means a jury; not you) believe they were in immediate danger of death or great bodily harm? That is pretty much the test in all of the states I am aware of.   If the word immediate or the seriousness of the threat becomes an issue; you may find yourself in criminal court.   Somewhere along the line some folks got the idea that some laws created free fire zones. They decided to start using the words Castle Doctrine. Guess how long that term has been around. It doesn’t give you a free pass to kill someone in your home; it is a principal that removes the duty to retreat and assumes you are acting in self-defense. If a Prosecutor has evidence that can show you were not acting in self-defense he can use that to remove that assumption.   Bottom line is if you are protecting yourself from a real threat you will probably be okay. If the person is running away or you are protecting property; you may have a problem. There are not (legally) any free fire zones.   Of course every case Is different, and people will see them differently.
  11. I’m against it. But they will put a hell of a dent in gun transactions without background checks if they make it a crime. I doubt many of us here would commit a crime to buy/sell a gun; not worth it.   Background checks won’t stop criminals from getting guns. If they can’t buy one they will break into your home and take yours; or find someone who will for a bag of dope.

The same way they prove anything else; witnesses, undercover buys, or they have you on a felony transfer and you opt to plead out to a misdemeanor instead of taking your chances at trial.   You couldn’t advertise it or transfer it to someone you don’t know; so they will have achieved the desired effect.
  13. Just a guess also, but I would think if you refuse to show it; it’s as if you don’t have it. You might make a valid argument in your weapons charge trial, but I doubt it would fly in your HCP revocation hearing.

  17. I don’t know what your budget is, but you might want to take a look at the S&W 617 revolver. It’s a full size K-frame stainless revolver, but since it’s a round butt you can put some pretty small grips on it if need be. It would last him a lifetime and he could pass it down to his kids.   19. Oh I think we are all pretty clear on that. The problem is that the producer’s numbers are rapidly declining while the takers numbers are growing. You don’t need to be a math or financial genius to understand that can’t continue and our Nation remain strong.   The takers don’t care about that (United) and the producers are split on how to fix the problem (Divided). The problem will eventually take care of itself and we will go down in history as the generations that allowed it to happen.
  20. As Fallguy stated if you are armed you have to show ID. Otherwise, no one can answer the question on whether or not you have to ID without knowing the circumstances. Are you obstructing an Officers investigation or resisting a stop, frisk, search or arrest?
  21. In the 80’s I made the mistake of volunteering to go to school for L.E.A.D.S (Law Enforcement Agencies Data Systems). It was my understanding we were charged by the state on the amount and type of info we ran. We were set-up so that when we ran a plate we would also get back DL info for the owner(s). I could even run a complete criminal background on someone; but I was told it cost more and I would have to explain why I did it, so I never did. If we needed that done the desk clerks did it.   On patrol we typically ask dispatchers to check DL status from a plate number. Unless it was a busy night we had an answer in seconds. We didn’t have computers in the car. Could it be that the in-car computers of today are limited to how much data they can access?   I’m not arguing with anyone; I’m just skeptical that an Officer couldn’t get back info that would indicate an HCP in seconds if they wanted to know that. Or that if they ran a plate and that owner was suspended/revoked/wanted it wouldn't show up.

    Cancer

    Saw this after I just back from the Doctor today. I am a cancer survivor. Today I went from six month checks to one year. Being diagnosed with cancer puts other “problems” in perspective; I hope none of you have to hear those words.   I am lucky that I had great Doctors, a great hospital, and technology that saved my life and made the treatment easier.
