Then it probably an identity issue. If you can get someone on the phone they may be able to tell you. Good luck. You will be doing another background check on the other gun, so you might tell them that when you call.

Unless Craig’s is going to send the gun back to Buds I would say they will do a background check. I would guess the TBI would be looking at your denial on their screen; but I don’t know, that's just a WAG. Unless there is something in your background you need to clear up; I would guess the appeal will go through tomorrow. I would try to call the TBI if you want the gun by Wednesday.

All searches will be tested by your defense attorney if you are going to trial. It's then the Judges call. The Police rely heavily on citizens’ complaints. So if someone calls in and says you are carrying a gun in a school the Police are going to show up and pat you down for weapons. Carrying a gun in Tennessee is a crime; so articulating RAS or PC is pretty easy. -
The background check is done by the FFL that has the weapon; how does a different FFL have it? Have you tried to call the TBI to see where the appeal is at? Mine only took a couple of days.

The common cause seems to be an arrest that doesn’t show a disposition somewhere. I was arrested for having a gun in my car in Illinois many years ago. The charges were dismissed. I purchased guns in several states over many years before making purchases in Tennessee. Of my first several purchases here I was refused twice. Both were appealed and went through in two days. The first time I thought it was just a mistake; because it was approved so quickly. I called the TBI and the woman told me she couldn’t tell me why I was refused. The second time it happened (not the next purchase) I called the TBI again. The woman told me it was because something Illinois was reporting, but she wasn’t allowed to say what it was on the phone. I told her of the arrest, that it was dismissed, and even if it wasn’t it was a non-disqualifying misdemeanor. She replied with “We don’t know that.” I said, “You don’t know it’s a misdemeanor?” she said “No, we know it’s a misdemeanor, but it could be a felony in Tennessee”. She said that when checking on the appeal they found I was okay. She couldn’t tell me why it went through okay on other purchases. My daughter is a Probation Officer in Illinois and her boyfriend was an Illinois State Trooper. He checked and said Illinois didn’t report anything to them other than a speeding ticket. That led to think it was the FBI database. They wanted $25 for a background check. It was $30 for a C&R license and I knew it would show up there if there was a problem. It did. The BATF sent me a letter I needed documentation on the disposition of the charge before they could proceed. I talked to the person handling it and he said the gun charge was not reported by Illinois, but was showing up in the FBI check with no disposition. My daughter went to the Circuit Clerks office to get the documentation. The woman gave it to her and gave her a second copy; she said it has happened to her husband a couple of time and might happen again. She said she would resubmit the disposition to the Feds and that may fix the problem. It seems to have fixed the problem. She did that, and I submitted it to the Feds and got my C&R; no problems since.

I’ve done that; it doesn’t do any good. They were clueless in the conversations I had with them. It was the BATF that told me why I was being denied and how to fix it.

They can confiscate anything they want if they are investigating a crime. The problem comes into play when they are asked to explain any RAS or PC that a crime was or is being committed. This is a black eye for law enforcement and as I said here before; you can lay this right at the feet of the Police Chiefs and Sheriffs that participate in it. Good cops don’t do this and good department heads don’t allow it.

It’s Tennessee LEO’s that are doing it here. They shouldn’t need the Feds to tell them its wrong; the Tennessee legislature needs to follow suit and ban the practice.

I would have charged them with Obstructing Police (different charge than obstructing justice). But I don’t know what the specific charge in Tennessee would be; maybe they don’t have one. You would have about as much chance of using a “freedom of speech” argument in this case as yelling “Fire!” in a crowded theater when there was none. But that's just me, the Officers chose not to arrest the guy and it all worked out.

I have a friend that said she had a question on a “gun issue”. Her husband has been diagnosed as being in the first stages of Alzheimer’s. He isn’t that bad yet, but his Doctor told him not to drive unless he was with someone. She didn’t say if he is on Meds or not. I’ve talked to him on several occasions and I can’t tell. She said he announced the other day he wants to buy a handgun for home protection. He’s taking this hard and she is afraid he may be suicidal. She said “Surely they won’t sell him a gun will they?” I said “Probably”, unless he tells them; they would have no way of knowing. I also told her she doesn’t have a “gun issue”; she has a “mental health” issue. It would be tough to have to give up having guns around or driving a car; but that is what needs to happen. Tough decisions.

I have several of both. Most of my carry guns are semi-autos, but my nightstand gun is a revolver. Everything is application driven. That’s been settled long ago. 9mm is for punching holes in paper; not for carry.

If that was directed at me I apologize if I came across that way. My point was that our interpretations of the law might be different when I was arresting people. Arrest is not a conviction and the person will have ample opportunity to convince the DA, Judge or jury no crime was committed. The people in that video incited the person being arrested to resist. They also were putting the Officers in danger by causing them to have to deal with them while they were trying to take a suspect into custody. They refused to move back when ordered to do so. I do not know this to be fact, but I would bet that is illegal in all 50 states.

Verbal threats are threating behavior. Being told to get back is being told to disperse. However, on your ride to jail I would explain to you that you and your attorney can make those arguments to the DA or in court.

Certainly it is. A physical response would change it from obstructing to assaulting a Police Officer. Whether or not force is used is pretty much up to him when he is told he is under arrest. I’m not going to second guess the Officers as I can’t see what’s going on around them or where they are. But I would have arrested him and then used his own video to convict him. But maybe Tennessee doesn’t have a law against Obstructing Police; I don’t know.

Well said. Another big problem I see is that groups are trying to make this a race issue; it is not. Criminals are trying to intimidate cops into not using the level of force required for fear of being arrested or losing their jobs. It won’t work and the politicians that are participating in that will be out of a job. The color of those thugs in Nashville had nothing to do with it. I have had the same thing happen many times with white people; rich white kids that think they are entitled and don’t know the law are as bad as the thugs. Most poor white kids know they will get cuffed and stuffed and they don’t get to play the race card. Who would have ever thought 20 years ago that we would be having a controversy over a cop shooting a thug that that just committed a robbery, beat the cop in the face, grabbed his weapon and caused the weapon to discharge? Is this where we are headed? I hope not, because if any of you think the cops are bad now, what do you think you will get when cops start getting arrested or fired for using force against criminals that are attacking them? The only people that will want the job will be the ones that you don’t want in there. Many citizens don’t stand for thugs attacking them or pulling guns on them; and neither will cops.
