If they force the issue they can't use it in criminal proceedings. A DA isn't going to do that. EDIT: However, the Feds aren't bound by that law.

U.S. law abiding citizens are not being sent into harms way. There are plenty of Police Officers that have been in shootouts that are as violent as most in the military have seen. Why would you want to limit their ability to stay alive when they are being sent into situations as violent as a combat situation? I’m sure there are cops carrying M16’s instead or AR15’s but I would guess most have AR’s. It really doesn’t matter to me because one is no different than the other in the hands of a trained professional. I have no idea why they would want a suppressor on a weapon other than the obvious ear protection as they may not have time to put in ear protection. I wouldn’t want a suppressed weapon. I would want the most accurate weapon I could get my hands on; so I wouldn’t be hanging a suppressor on the end of the barrel. You can have a suppressor; why can’t they? Weapons are irrelevant; tactics and procedures are what are important. I will say this again, when you see cops that dress like combat troops and wear mask, etc. responsibility for the problem is easy to identify because only one person can authorize that. Make them give an answer on why they feel their cops need to be dressed like that. I don’t know how others feel but when I kicked a door as a cop I wanted the people inside to recognize me as a Police Officer on sight. Me wear a subdued uniform and a mask? That would laughable if it wasn’t so deadly.

I’d take a handgun over a shotgun any day for home defense; but the OP ruled that out with the over penetration/living in an apartment comments. So pay attention and get back on track or start a shotgun vs. handgun thread. -
And I am much kinder and nicer when discussing the issue; I learned that lesson the hard way a long time ago. We have discussions from time to time on this forum about issues that really don’t matter much; traffic tickets, how a cop handled a traffic stop, disarming someone during a stop. But what we see going on now with cops is really troubling. When there are riots over a cop shooting a dirtbag that has tried to kill him or someone else it’s wrong. When a cop shoots a person that is no threat it’s wrong. I served in the military and have two honorable discharges. I also served as a Police Officer. I am as proud of my Police service as I am my military service and make no bones about it. Having cops here gives the opportunity of getting answers from those that will be responding to the calls. I was not a cop in this state and have relied on them to provide answers about how things are done here. Procedures can also change from county to county and city to city. I have said this before and I will say it again; if you want to know what it’s like go be a cop, or if you don’t want it as a career go be an auxiliary officer. I guarantee it will change your outlook. And I will also guarantee that even if you decide not to stay with it; it will be an experience you will be glad you had. We have some new folks here that are prior LE; I would say to them that as they have already discovered there are haters here. Don’t take the bait to turn it into an attack, that’s what they want. Most people here are pretty intelligent and can see what’s going on.

When you flee you are putting pedestrians and other motorists around you in “Immediate danger of death or great bodily harm”. I think that justifies the use of deadly force in most all states. Some departments have policies about pursuits; but they are not state law. Shooting at him from a moving vehicle was over the top though; he should have just hit him as he was making the turn. He should have taken lessons from the first video.

Has anyone tried the Redfield Accelerator? It’s a spinoff of the Leupold DeltaPoint but only costs $180. (The DeltaPoint is $700) http://www.redfield.com/accelerator/ The Eotech is not a reflex sight, but it’s a proven performer with customer support to back it up if there is a problem. I wouldn’t be worried about putting my XPS2 on a shotgun.

I read it the same way; the clock stops if there is probable cause. He did not articulate any probable cause for a search and he wanted to run the dog around the car to get that cause. If he had been writing the ticket and he had a partner that got the dog out, or a K9 Officer drove up and ran the dog while he was writing the ticket; he would have been okay. I doubt this will change much except for those Officers that ask permission to search with no probable cause; which I have never understood anyway.

For some reason used .357 levers are hard to find and are usually listed at a premium in that caliber. The new prices of those two guns are within $50 of each other. So it boils down to what you want/need. I would make the trade; but that’s because I have absolutely no need for a single action revolver. Why would you not be able to get parts from Rossi?

A shotgun is good home defense weapon. Sounds like your Mossberg has a 20” barrel. That’s fine as long as you can maneuver it. Barrel length usually becomes an argument when people start talking about “clearing” your apartment or house. If you know someone is there you don’t go hunting; you let them come to you, through the fatal funnel. If you aren’t sure you run the risk of being taken out no matter what kind of weapon you have. I would use 00 over #4. But everyone will have an opinion; they will both penetrate multiple sheets of drywall. Short of non-lethal or bird shot there isn’t anything you can put in a 12GA that won’t put your neighbors at risk if you shoot the wall. The same thing will happen if you miss with a handgun. A dog will let you know if someone is in your house or apartment. -
I think that will be your best bet. You will also find out how good their customer support is. They should email you a shipping label and ship it on their dime. Magazines are always blamed for guns malfunctioning. If it won’t function with the magazine the manufacturer supplied; that’s a problem. If it’s a bad mag; let them deal with it. But if it’s the gun having a factory gunsmith go through it sure can’t hurt. If you get it back and it still does it; then you have problems. Let us know how it turns out.

He may file a lawsuit as a ploy to try to cut a better deal on his criminal charges. But nothing will come of it as far as the Officer is concerned. Department policy isn’t law; the use of deadly force is. It would be an easy one for the jury but it won’t make it that far. He’s going to be busy trying to cut time off his prison sentence.

He had committed a robbery, home invasion, vehicle theft, firearm theft and was an active shooter holding a rifle. Since no one was going to walk up on him and he was refusing all orders to comply; the next logical escalation of force would be to shoot him before an innocent walks into the scenario and gets shot or he shoots a cop. You think hitting him with a car was more reckless than opening fire? I don’t.

Don’t go shopping for mags. If your weapon won’t function with the mags that came with it; something is wrong. Send it back and let them have their gunsmiths go through it. A Straw Purchase is a criminal offense. It is as hard to stop as any other crime. But it is usually harder to prove until another crime has been committed. If criminals want guns; they will get them. They will walk up and take them or they will wait until you are not home and they will kick your door in and take them. I’m not against background checks I just don’t think they stop criminals from getting guns. They are more about politicians saying “At least we are doing something”, and putting cash in gun dealers and the state pockets.

I did not know that, thanks for posting that. However, I use .22’s for trigger time, not carry, so I would like to have a full size.

The Judge was just making an observation. The DA and a jury will deal with the premeditation issue at trial. It in no way impacts you carrying with a round chambered. Unless of course you are charged with premediated murder; in which case your HCP or how someone carries is moot.
