Carrying on a Motorcycle with no Permit
DaveTN replied to scubaru's topic in Handgun Carry and Self Defense
Obviously getting a permit would be a good fix; but it doesn’t fit what he wants to do right now. I was commenting because he wanted to know the law; not opinions of what could happen. Two posts mention premeditated murder with absolutely no legal qualifiers. We do not have a duty to retreat. If someone tries to rob him or attack him he can return to his motorcycle to get whatever he needs to defend himself, and as long as that threat is still immediate; he can shoot them. If he walks up and sees someone pointing a gun at the clerk and goes back to his motorcycle, gets whatever he needs and walks in and shoots the robber to death; he’s fine. Neither situation is “premediated murder”. The only way he will be charged with murder is if he shot someone to death that was not a threat to him or someone else; and an HCP won’t make a bit of difference in that. Going to a safe area, grabbing a weapon and returning to save others is not premeditated murder. -
Why would LE be involved in this; it’s a civil situation?

That is the route I would go. Once you have disputed the payment they know they aren’t getting paid and you will probably have more options. But I wouldn’t wait. If your bank is the issuing authority for the MasterCard you aren’t anything; it will show up on your bill as disputed.

FFL dealers in TN that won't ship to C&R holders.
DaveTN replied to LCPfraTN's topic in Curio, Relics and Black Powder
Sure between private parties. But the FFL that has the gun he wants can’t do that (unless he decides to accept his C&R) I can understand a FFL not wanting to take any risks. I had a C&R that expired recently, I would be curious to know if there is some kind of issue that makes these dealers not want to do it. -
Carrying on a Motorcycle with no Permit
DaveTN replied to scubaru's topic in Handgun Carry and Self Defense
Now you are in a situation where the vehicle is not relevant. I don’t have access to case law from this state, but the test is generally “readily accessible”. If you have a gun and a loaded magazine in your backpack (or anywhere else) it’s the Officer call and then ultimately the DA and the courts whether or not you are carrying with the intent to go armed. Being a test dummy is not good even when the charges are dropped. (I know that because I have been there and have the T-shirt) This state has no “Duty to retreat”; so talk of premediated murder is silly unless you murder someone. If you have to return to your bike to get your gun because you or someone else is in danger of death or great bodily harm; you are fine. Just remember no cares what you believed; it’s what a reasonable person would believe (a judge or jury). If you were having to get off the bike a bunch, I would carrying without a round in the chamber, pop the mag and leave it with the bike and put the empty gun in your backpack; you can carry an empty gun unless it’s in a specifically prohibited place. It’s not the best way to carry, but the only good way to carry in this state is with a permit. -
Carrying on a Motorcycle with no Permit
DaveTN replied to scubaru's topic in Handgun Carry and Self Defense
A motorcycle is not excluded from “Motor Vehicle” in 55-1-103. (Castle Doctrine doesn’t have anything to do with this.) So you should be okay while on the bike. The problem comes into play when you step off the bike. If you are carrying and you step off and approach the pump to get gas; you are carrying illegally. If the weapon is secured on the bike; you are okay. The law does not address securing the weapon in a vehicle. Your friend is wrong about loading the weapon. Tennessee only cares if you were justified in the use of deadly force. If you are; carry and possession laws do not apply. (Everything you do will be used against you in a criminal or civil trial) I do not think you would have any problem having a properly secured loaded firearm on your bike and accessible. I do think you could have a problem if you are wearing it, a cop sees it, and wants to mess with you. Step off that bike and you are illegal. -
It appears to me they cleaned up all the drama about what’s a legal sign and what’s not.

I know plenty of people that obey the laws, they are Americans; I wouldn’t call them “good” Americans. I’m sure there are Muslims in this country that mean us no harm. I am also sure there are Muslims that want to kill us for no reason other than religious beliefs. It’s just a warning sign. But then we continually ignore warning signs from home grown American non-Muslims that want to kill us.

I would also suggest running some CCI mini-mags through it. If it has issues with those I would contact Ruger and send it back. I bet Ruger would fix you up. I have been drooling over the new Smith & Wesson SW22 Victory. I guess I’m going to have to check it out. http://www.smith-wesson.com/webapp/wcs/stores/servlet/Category4_750001_750051_804153_-1_757752_757751_image

When I saw "Faster than Jerry Miculek" I had to click to see what that was all about. BTW.... 4 rounds in 1.3 seconds would not beat him.

As a former cop I can say... People call 911 and cops respond; it’s what they do (Dispatchers don’t make decisions on calls were violence is a possibility; cops at the scene do.). She sounds like a nutcase looking for a lawsuit, and she will get exactly what she wants if they arrest or fire her for calling in a man with a gun. This sounds like a situation the College administration needs to deal with. They have an over the top gun hater they need to deal with. The real possible problem here is if they do get an active shooter and are slow to respond trying to find out if it’s a call from her. DISCLAIMER: I didn’t go look at her website though, I could tell from her “letter” she has issues.

You could have your DL suspended or revoked without impacting your HCP. Then you would need another card.

Any sign that was conforming (pretty much any sign), will still be conforming until 2018. My rule of thumb is any sign I see is legal because I understand the property owner’s intent. If I don’t see it; it probably isn’t legal under any version of the law.

I wondered the same thing... If I build out of parts how will I match finish? I don’t believe in painting guns and who wants to build a new gun and then pay to have everything refinished?

Gun shop owner refuses to sell gun to eligible customer
DaveTN replied to DaveTN's topic in General Chat
I don’t believe it’s a charge. It’s a term usually used in pretrial diversion that allows people with a drug problem to get their charges dropped if they complete a drug abuse program. It may also be used in mental health hearings; but I don’t know that for sure. As with any job I’m sure there are those that don’t feel they have a duty to do anything. And there are those that take their responsibilities very seriously. My guess is this FFL is one of those. -

Petition for Open Carry at the Republican Convention
DaveTN replied to btq96r's topic in 2A Legislation and Politics
Both the venue and the Secret Service said "no guns". So this is really nothing more than a publicity stunt. -
I'm not sure why that would matter? He pulled it and pointed it at a Police Officer.

non permit holder Gun in car..... what is details?
DaveTN replied to P-E-Z's topic in Handgun Carry and Self Defense
You don't need a permit to carry in your car. As to the OP.. you can have a loaded gun in your car. It is a crime in this state to carry a loaded gun out of your vehicle if you are not on your own property. -
Constitutional Carry Or Non Restricted Permit Carry
DaveTN replied to 300winmag's topic in 2A Legislation and Politics
Where are these states that allow carry on school property (other than Colleges)? I took a quick look and don’t see any. Isn’t there a Federal gun free act about schools? -
It started in 70’s-80’s when states stared doing away with their “fleeing forcible felon’s statutes”. When I was a cop we could (and did) shoot criminals running from burglaries, armed robberies, etc. Less of them ran than today. Today they run for anything and everything, felony, misdemeanor, traffic, suspended license; it doesn’t matter, no reason to stop. If they get shot; they sue. If they get killed momma, (who couldn’t care less about them) gets a payday.
-
An FFL wouldn’t sell them. He would either return them to whoever shipped them to him, or hold them for you. Sounds like he is willing to do the latter. That’s good; some dealers would send them back.

Without more information from you, three masked men with long guns is a home invasion. I would be curious to know how they justified not responding. They had higher priority calls than a home invasion?
