Who do you think has this "database"?

We have more firearms freedoms than when Obama took office. Putting a sin tax on a constitutionally acknowledged right will not fly. Just goes to show you that just like Obama; Hillary doesn’t give a squat about your rights.

Horizontal Kydex Sheath For BK24
DaveTN replied to BillOReitz_II's topic in Knives, Lights, EDC Gear
Kydex should be a piece of cake for you. But on that leather, why can’t you just either sew on a long horizontal piece or put cuts for a belt in the sheath? -
The Department of Transportation has said you must obey the laws of the state you are in. But they are not the ones you would be dealing with. If the bus lines says you can’t have a gun; they could leave you standing on the side of the road. I don’t believe they would do that, but if the gun became an issue; they would deal with it in their own way.

Call for help goes terribly wrong, Firefighter killed
DaveTN replied to DaveTN's topic in General Chat
Your guess is as good as mine. I assume because they say he was unresponsive; they were yelling and trying to get his attention. My experience from watching Firefighters make entry is that they are yelling “FIRE DEPARTMENT” when they are forcing entry. Now whether they are calling “unresponsive” as they saw him through a window or something and he was unresponsive, or unresponsive as in they didn’t know if he was there or not is not clear. I’ve had to request from Command to force entry on a few “check on the welfare” cases; we usually left the entry to the Fire Depart as they have the tools for it. In the cases I was involved in we either had a dead body or some having a medical emergency that would have died had we left. We required family members or some pretty good information that the person needed help or was dead. Firemen aren’t cops, they aren’t trying to arrest anyone and they aren’t trying to move in fast. I just can’t imagine them not identifying themselves as they were making entry. But I guess anything could happen. -
This is one of the risks first responders deal with. Prayers for the Fireman. http://www.msn.com/en-us/news/crime/1-maryland-firefighter-dead-another-injured-after-shooting/ar-BBrOTvm?ocid=spartanntp

Instead of speculation I would be curious to see if there are stories of Doctors speaking out with facts on why they don’t want to be a part of this program. Is it limits on pricing, paperwork involved, or other government limitations/restrictions?

If you look at those pictures; that is what a manufacturing facility looks like. It is filled with machine tools that make product. They employee skilled trade people that manufacture guns. As opposed to those that want to claim “American Made” when they are nothing more than an assembly facility. Good for them.

River and Spires.(Clarksville) Is this legal?
DaveTN replied to espacef1fan's topic in 2A Legislation and Politics
Go to the DA and see if they will take your complaint. If they don’t; get an attorney and see about going that route. Or as OS said; be a test dummy. It’s not a lawful sign so I don’t think they would cite you. I would guess they would tell you to leave or be charged with trespass. Would it hold up in court; who knows? I feel strongly about this simply because our state legislature wants to make it unlawful to carry a gun, but then try to act like an HCP holder has some special rights or has some special training. I have an HCP and feel that is ridiculous on both counts. Last I checked rights were for all the people and individuals couldn’t purchase them. This is a family event and I can understand them not wanting HCP holders and thugs alike (because some are both) open carrying. It could impact their attendance; and that’s their call, same as it is in a store. My carrying in there would not be illegal (in my opinion) and would not be an issue. So no, I would not participate in a show of force against an event like that when it would surely end badly for us. EDIT: An AG opinion is not law but most of these types places would probably abide by it until there is case law. Does anyone know if anyone that is authorized to do so has submitted this question to the AG, or if there is case law? Have we ever found anyone yet charged with carrying past a sign of any kind? -
I foresee attorneys in someone’s future; Japanese attorneys.

Effect of ammo on reliability in 9mm semi-autos
DaveTN replied to tightshot's topic in Ammunition and Reloading
The first place many people look when they have a malfunction is the ammo or the magazine. The first place I look is the weapon. Unless you are shooting absolute junk ammo or you have been running steel case for a long time; ammo should not be an issue. A quality handgun does not require a break-in period to function properly. You want to fire a couple of hundred rounds before carrying it to make sure there is nothing wrong with it, but if it fails to fire or fails to eject; it has problems. I recently had a new Shield feeding improperly out of the box. I packed it up and sent it back to S&W. They fixed it and sent it back. (Replaced the extractor). Anything mechanical can have issues. They didn’t even have me send the mags with it, and it works flawlessly now; so I know it wasn’t ammo or magazines. Winchester White box and Remington UMC is pretty cheap and will operate anything I have. You could have an issue with a round or a batch, but it shouldn’t be a continuing problem. If your firearm won’t feed properly with mainstream ammo; send it to the experts to deal with. DISCLAIMER: I haven’t owned a 9mm in over 25 years; my experience is based on the mighty 40 semi-autos. -
What kind of problems did you have with it? What did they say when you called them?

30th Anniversary of FBI Miami Shootout
DaveTN replied to Cruel Hand Luke's topic in Training Discussions
From this I learned to keep a rifle handy. From the North Hollywood shootout I learned to make sure it’s a heavy caliber rifle. -
Is it that they don’t care or is it that don’t have jurisdiction? Does your local law enforcement have the authority to make an arrest under the Stolen Valor act? The first was shot down as unconstitutional and the one from 2013 is pretty specific in what the person has to claim and the intent that must be proven. I don’t see this as near the problem computer fraud is. People are scammed out of money every day and due to the laws; it’s tough for anyone but the feds to do anything. Of course they aren’t going to get involved in someone getting scammed. With the computers and information age eventually the laws will change. But that will require states to work together; good luck with that.

Yes, on my department you would be in violation of department policy and subject to punitive action including dismissal. The liability is too great if the guy has his friend drive him around until you leave and then takes him back to his car. He drives and gets in a wreck. You think his attorney isn’t going to say a cop had him and didn’t think he was drunk enough to arrest. Well certainly he will and he will try to put the liability on the cop. Look at post #15; a cop was fired. There is no defense. Should a cop have discretion? Absolutely, but in DUI and Domestic violence cases most departments have taken that away. It’s like zero tolerance; it’s ridiculous. But it’s the way things are. People just need to be aware of what the rules are; not what they think they should be. This is the information age; get the information.

That’s why I said I wish people (especially young people) understood the DUI laws. In your day (and mine) DUI was not a big deal. Today it is. Even if you don’t injure someone a DUI in this day and age can be a career ender. There are many jobs you won’t get and many companies won’t hire you with a DUI conviction. Like it or not if you get in your car with a BAC at or above .08 you risk being arrested for DUI. If you injure someone even in an accident that wasn’t your fault; you risk prison time. You can make all the arguments you want about whether or not that’s right; I just think people deserve to know what is going to happen. And maybe these discussions on social media help; I don’t know. We have a lot of discussions here on gun laws so people can understand the laws and don’t get jammed up. We get a lot of good information and we get information that is totally wrong. Same thing with the DUI laws. So what's not to understand?

Usually this stuff runs wild when someone is outed in the gun community. Doing a Google search I don’t see much about this other than this thread and the Facebook post. He says in his video he was in the Marines; are you sure that isn’t true? I can’t tell; just asking.

Scope Mounts....Tapping into the Knowledge Base
DaveTN replied to Randall53's topic in Firearms Gear and Accessories
I wouldn’t put Loctite on any gun part. If it won’t hold when properly torqued; something is wrong. Putting a bunch of junk in properly fitting threads is not good. -
Our state did away with the public intoxication laws. They decided that those people had a problem and needed help. So when we got called on the drunks (where a car was not involved) we either had to get them to voluntarily go to DETOX or wait for them to walk into the street and take them for intoxicated pedestrian in the roadway. Back then we had fire phones on street corners. The drunks would use the fire phones to call the dispatchers for a cop to take them to detox. Looking at the Tennessee law on PI it requires “to the degree that” that would probably not be satisfied by someone sleeping in a car. And if it was do they go to jail or are the cited and released?

That what happened with us in the early 80’s. We lost discretion on DUI and Domestic violence within a couple of years. If a person was borderline or questionable we could let them pull the car over and park it, call a cab, or we would call a friend or family member to pick them up. That ended in one day. Our shift Commander came into the squad meeting and told us that if we stop a suspected DUI we will arrest and test them. If we don’t we could be fired. He then asks if anyone did not understand what he was saying. Apparently a cop somewhere out east had stopped a car; he thought the driver was borderline. The driver told him he only lived a few blocks away. So the cop said he follow him home. While the cop was following the guy, the guy ran a red light and killed a family of five. The law suit was huge. You can imagine what it would be today if a cop checked someone out; left them, and then they drove off and killed someone. I also understand (as I’m sure you do) why the law was changed from having to be driving to “physical control” and adding DUI to an arrest that could be made on private property. Too often we had to let a suspect start the car before we could arrest them. That caused a lot of unnecessary danger for everyone involved. When they changed the law we could take them as soon as they opened the door and got in the car. I have mixed feelings about someone sleeping it off in a car. But they put themselves in that situation. If you drink too much to drive you better have a designated driver with you or someone you can call. A cab is a small cost compared to a DUI, not to mention the risk of harming someone. I wish young people could understand the DUI laws and that it’s not about “drunk” driving; it’s about BAC.

Why? I thought doing that showed he is dumber than rock and doesn't have a problem with violating SOP.
-
Well I don’t know how the “hero” status would impact his DUI. I understand that you are disappointed in him, but I don’t think he deserves better/worse treatment than anyone else. He obviously will have the money to hire a good attorney and with his clean (I assume) record he will probably get the same offer most first time DUI defendants with a clean record get; Court supervision with a dismissal after completing the supervision and drug/alcohol classes. I have never been able to determine if he is telling the truth about Bin Laden or not because most of the people that were they; don’t talk. But I don’t think it should come into play either way on this. If he thinks he is innocent because he popped a prescription sleeping pill when he had to drive; let him try that. I doubt it will work any better than him than it would for any of us. Although you never know. Steve McNair’s attorneys got a judge to rule he wasn’t weaving “enough” for PC for a stop after McNair publically admitted he was drunk and apologized for his behavior. That wouldn’t happen to any of us regular folk.

Depends what the laws are in that state. I assume since he was arrested that state has the same laws as many; that if you are in physical control, you can be charged. The test is usually if you can start the vehicle and drive off without exiting the vehicle; you are in physical control. He shouldn’t get any special treatment because of who he is; but he will probably have no shortage of good attorneys that will want his case. Prescription drug excuse won’t fly.

I can see why you are upset with them, but I am confused as to why you think you are out any money or have to wait to get your money back. I’ve had to submit a dispute to MasterCard. It was handled pretty quick and it wasn’t billed while it was in dispute. The gun has been sent back to Century, I would dispute the charge and go buy whatever I wanted.

Carrying on a Motorcycle with no Permit
DaveTN replied to scubaru's topic in Handgun Carry and Self Defense
Obviously getting a permit would be a good fix; but it doesn’t fit what he wants to do right now. I was commenting because he wanted to know the law; not opinions of what could happen. Two posts mention premeditated murder with absolutely no legal qualifiers. We do not have a duty to retreat. If someone tries to rob him or attack him he can return to his motorcycle to get whatever he needs to defend himself, and as long as that threat is still immediate; he can shoot them. If he walks up and sees someone pointing a gun at the clerk and goes back to his motorcycle, gets whatever he needs and walks in and shoots the robber to death; he’s fine. Neither situation is “premediated murder”. The only way he will be charged with murder is if he shot someone to death that was not a threat to him or someone else; and an HCP won’t make a bit of difference in that. Going to a safe area, grabbing a weapon and returning to save others is not premeditated murder.
