That may be, but embezzlement is theft and that isn't one of them. Do I care if non-violent convicted felons can buy guns? No, I couldn't care less one way or the other. Do I want my taxes to pay the salaries of those that would be required to do the paperwork and keep track of which felons are eligible and which felons are not? No, not a cent.

Well now you know some things. Assuming her embezzlement charges were the only charges against her; either they weren't dismissed as part of a diversion deal, or the disposition of the charges being dismissed wasn't properly reported at the end of her case. Part of any diversion for embezzlement would almost certainly require restitution; until that was paid the charges wouldn't be dismissed. She can pay for a background check to confirm what she already now knows, (the record is there) or she can contact the Circuit Clerk or Court Clerk in Nebraska and she whats going on. Expungement is not necessary if the charges were dismissed. (although it might help in the future)

All they can do is try to protect businesses that don’t post. We will see how it plays out. The state doesn’t recognize the 2nd amendment as an individual right; carrying a loaded gun in this state is a crime. So they can’t say a business can be held liable for not allowing carry. They can try, but it would never stand. The state can’t sell someone a privilege and call it a right; rights are reserved for all the people.

I know this has been discussed in-depth before, but my search returns no results. If a person has a single DUI conviction, do they have to wait a certain time before being allowed an HCP? Someone I know seems to think the law has changed on this.

I was a Police Officer when the “domestic violence” laws came into play. Prior to that it either assault (words) or battery (physical) and the Officer had discretion as we had in all misdemeanors. The women’s groups that got these laws passed claimed the cops weren’t doing their job and because of that women were continually being abused. Nothing could be farther from the truth. Any Police Officer will tell you that most people (men or women) are not prepared to leave a relationship because of a fight and never return. Many refuse to make a complaint and refuse to testify in court. The states in all their wisdom decided they wouldn’t require the victim to make a complaint; they would be the complainant. It was one of the stupidest things I had ever seen done in law enforcement. I can’t put a number on how many people I arrested on DV but it was a lot. Our hands were tied. There is nothing just or fair about it. And once you have been accused of it you will be treated like a leper; guilty or not. Some cops get tired on enforcing an unjust law that doesn’t work. Then they get the blame for it. Now don’t get me wrong; I have no qualms whatsoever about arresting a person that assaults anyone (family member or not should not matter). But it should be like other laws and require someone to make a complaint. Those who want help would get it from any Police Officer I ever met. My point? Know that if the Police are called to your home on a domestic violence call there is a high probability someone will be going to jail. Also, the cops are not social workers; they are not the people you call to fix your family problems. The probable cause required for an arrest for DV is very low; it’s right there with disorderly conduct. However, the lifelong ramifications are much greater.

Pretrial diversion generally means charges were dismissed. However, that doesn’t mean her records will show a final disposition. Not having a disposition is a common cause for being refused on a gun purchase. Unless she knows a cop that can run a background check, the best source of information she has will be the court clerk where her case was handled. They should only be a phone call away.

That is correct, but it requires a DD214 that documents at least 4 hours of handgun training. I had handgun training, but my DD214 doesn’t list it. I would choose the obvious round for an AR… 308 Winchester. (Or 7.62 NATO if you are the tactical type).

I don’t see it listed on their website yet. But I wish them luck; we need all the American gun manufacturers we can get. Cheap guns sell; price will overcome anything in the handgun market.

They won't destroy a million dollars worth of guns or anything else. That is the Jeffrey Lash case; I doubt they will get those until that investigation is over.

Handgun would be a tough call between a S&W 686 and M&P40. Rifle would be easy DPMS 308 Panther; it can cover all applications.

I would put a quality long range optic on it; that could be 1000 yard rifle. Something like the Leupold 6.5-20X40 in a one piece solid mount. https://www.leupold.com/hunting-shooting/scopes/vx-3i-riflescopes/vx-3i-6-5-20x40mm-side-focus/ It’s a rifle carbine; you don’t need sights for CQB.

If he were arrested for transferring it back to the dealer, or turning it into the cops; then he would have a legitimate gripe they were doing it because he was a reporter.

They absolutely are planning on banning these assault rifles and high capacity magazines. It won’t be next week because they are on break until the week after next. There just happen to be some obstacles in their way. (People who understand the problem)

While I truly believe Obama is trying to do all the damage he can to this country; I don’t think everyone is. Otherwise we would be experiencing less gun freedoms; not more as we are. I suspect our gun rights/privileges are going to be held at a state level. The Feds have no business deciding when and where you can carry. I suspect they will keep busy with the background check laws and continue to try to ban semi-auto rifles. I think they will get most anything they want on background checks. I personally think it is ridiculous that the no fly list and the terrorist watch list is an issue. I suspect any legislation that passes will have an appeal process. So if they label me a terrorist they will need something more than the fact I own a gun. However, I also believe if you make threats of violence (against anyone) you should be in jail and unable to buy a gun. They will continue to attempt to ban the AR federally. I don’t think that will happen. With the SCOTUS refusing to answer that question right now; states will do as they please on that issue. I don’t see my ability to own or carry a gun be impacted in this state. However, I do what I can to make sure that doesn’t happen. I certainly won’t be standing on the sidelines watching this election or voting for people that have openly stated they want to take my guns.
