  1. I would think rally point of neighbors driveway is too close.. it will work if there is a house fire but I would think with a BG you need to be about a block away minimum.

    When Responding to calls with FD, when there may be a threat,( attempt suicide, domestic , fight , assault etc. ) we stage several blocks away until dispatch
    tells us scene is secure (by PD)

    a house or two away, you can easily be engaged by a BG even if he is fleeing the scene....


    If you live in the country and neighbors driveway is a quarter mile away... you should be good for a rally point
  2. I did speak to an attorney to get better understanding.. in general said too soon to need an attorney but his info was helpful... he said 15 days for appeal
    decision is the law and if can't research it properly in that time they
    should automatically approve or at a minimum
    "Conditional proceed" He said let it alone right now...

    he said if they are running behind they may just quickly try and figure it out and since no convictions approve it

    I did Learn you cannot appeal the appeal... also I learned that you can fax in an appeal with supporting documents

    He told me if I get denied and wait for my expungement to complete and start over on the same already PAID FOR guns..

    if still denied appeal again and fax my expungement packet with the appeal form...

    If still having issues get with attorney...
  3. I am continuing to post here as hopefully my adventure will help someone else if they ever have to go through this.

    Today I went back to the court clerk just to check on expungement ,and good thing I did, because they could not find my file... they finally did and started the expunge process...

    I did find on TBI site that they can expedite expunge for firearms purchase, so I have to get clerk to fax in to a special number tomorrow..

    3. ADOPTION"

    If you Call TICS, and choose appeals, you get a message that says due to high volume they are not taking phone calls and to call your FFL..

    Today is Day 15 of my appeal... so I called the FFL. He has heard nothing, but said he got one back yesterday that was faxed in on 12/15/15

    Mine was Faxed 12/22/15 (he said he gets them back in date order) so he said call back in a week as , it looks like TICS is about
    a week behind.

    I don't really mind the extra wait.... but the rules say "15days" and if can't be done by then, a "Conditional Proceed" gets issued

    My guess is they can't physically get to the forms in 15days to issue that "Conditional Proceed"

  4. well 15 calendar days is up on the 6th... so we will know shortly , what happened or what to do next.

    FFL said he will hold guns for me no problem until I can get this figured out....

    Mrs. already saying "just give up and get money back"... but told her of importance of her learning to protect herself if I ever die and don't comeback again... Had her watch The movie " the Perfect Guy" where he stalks the crap out of the lady only after a few dates... she said
    "maybe we should get the gun thing handled" LOL

    I am waiting for him to call me with the appeal results... was going to have my ducks in a row if it goes conditional proceed,,,

    is it your experience that he will hold guns for folks to clear up this stuff, ?? or does he have a hard and fast rule that conditional proceed
    means NO GUNs ... it sounds like you know him personally

    Williamson county doesn't have a web thing like this... so I took my court papers to the clerk today...
    I was told that if my attorney turned in all required info for the retirement ( and I am not "wanted", so he must have) that the case becomes
    dismissed... I asked for proof of dismissal and was told they would do one better and pull the file from achieves ( its 5 years old) and if
    all was in order they would expunge it on all levels at no cost $$ (state and federal) ( they said State may currently not know the
    disposition of my case)
    which would tell me that the state may not be able to directly approve and make it CONDITIONAL PROCEED... If that happens I will ask FFL to look at all my paperwork (and my wife said she wants to go there with me to show him she is safe)... or hold the guns unit I get the
    expungement letter and then let me have the guns.

    It will take a week because of the holiday. They said they will mail me expungement or call me if anything else is missing from file or needed info.. I have copies of everything they required just incase, so this should be a done deal.

    Now Just waiting to hear from FFL on my appeal...

    A coworker, that used to work at an FFL ,said if totally denied to try and figure out why and fix and that there is a 30 Day waiting period to
    reapply to TICS which would give me time to fix anything... hopefully I am not way off base here,

  7. what happens when purse stolen with gun in it?

    any liability there? (like say it gets used in a homicide or school shooting or home invasion??)

    I understand its a situational awareness thing too, but Mrs has had some things stolen from her in crowds and malls without even knowing it
    until later.... I have also been attempted pick pocket but my fat butt prevented the wallet from coming out and when I turned and spotted the guy he ran away...

    we are new to weapons but I am acting as if purse isn't even a choice..... Shhhhh

  8. I Just found some good news!! I think... in my search I found this

    3.Retirement, which is basically putting your case off for a period of time to determine if any other violent behavior will occur. A retirement always comes with conditions such as drug or alcohol counseling, batterer's intervention program, monetary contribution to Bridges Shelter of Williamson County, and any other conditions that the
    Assistant District Attorney may feel is necessary given the circumstances of your case. **** If completed successfully, the case is dismissed after the retirement period
    and does not go on your record.****

    my paperwork says 3 months... its been 5 years, gotta see the clerk to make sure all this happened.. or if I still have to expunge it

    I also found the no matter what the ARREST will ALWAYS show up to the system but not sure if it will show up to the Public....

    I think no matter what I will always get an initial deny on a gun purchase and the appeal should be filed

    I will have to check, as it was a Williamson county case , and I would hope the same info applied..

    I will run by Williamson and ask the clerk if my retirement qualifies for expungement,, maybe I don't even need my lawyer

    as for this denial even the ATF site said it has to be a conviction to bar gun ownership so hopefully I will hear good news in a week or 2

    I am told my guns are still siting at the FFL pawn shop the Georgia dealer uses for TN folks... uGH
  10. Ustawuz when I was a State Trooper way back when we used horses -
     
    "Retired" was the first part of the phrase - "Retired with leave to reinstate."  That was meant as a Damocles Sword over an offender to make them change whatever behavior the prosecutor or judge wanted changed.  It was also used for traffic tickets where the person didn't pay and it was too much trouble to go get them for a headlight violation or something.  Sometimes the offender would petition the court after a time to change "Retired with leave to reinstate" to a flat out "Dismissed."  You weren't found innocent but for whatever reason the judge dismissed the charge.

    I would guess that's what he meant.. but paperwork only says retired... and the box next to it is checked.... I guess its just a waiting game....

    If I am not supposed to have a gun by law, then ....so be it... but I have never been convicted of anything more than paying speeding tickets

    after my recent death experience I thought what if they didn't save me how would Mrs. protect herself... but she won't buy and go to classes and range without
    me going also so we figured it was time to get armed and trained.
  11. first time ever buying guns today.

     

    The background check at FFL denied and they faxed in an appeal and said 15 business days..( so I am guessing, this time of year, I won't hear anything until Mid January????)

     

    I do have a Dom. Violence arrest, 5 years ago, but the case was RETIRED

    ( yes I know a conviction blocks me, but case retired and I have paperwork to show it)

    as it was a loud verbal argument not a physical battle and I was arrested to "separate" us so the PD  would not be liable if something horrible would have happened after they had left us alone.

    ( I personally know the officers who arrested me)

     

    and I Just received my TN Security Guard  in the last 30 Days and that had full TBI,FBI, fingerprints, and I think I had to pee in cup.

    If I can pass that, I should be able to get purchase approval.

     

    I have 3 speeding tickets in 30 years of driving.. all handled

     

    I noticed in some other thread posts saying  "Call TBI"... who do you call?

    how do I go about fixing or proving my side,  if appeal fails?

     

    some posts say you will never know why, and others say call TBI...

    FFL said if denied after 15days the state sends out letter explaining it all...    what is the process??

     

    any help would be great

    I ended up calling GT and they have plenty of stock..,

     

    I drove down  (2.5 hrs) and purchased 2- G19 gen 4 with night sites $455 each... (My Fire ID was just fine by the way)

     

    did the whole pawnshop down the road thing...

     

    and  Tennessee has denied my purchase and I had to file an appeal. ( so  2.5hr ride back with lighter wallet and no guns...UGH)

     

    I have  no convictions so either a  mis identity issue ( I have a common name and run into problems from stuff that was not me)

     

    or the one time I was arrested and case retired, just has to be confirmed....

     should not be an issue, as the state just ran full TBI check  with finger prints on me, and issued my security guard license... 30 days ago...

     

    Stinks having to wait for an answer  and then have to drive back down and get pick up  or get money back...

  13. I like the Viridian for green laser  and strobe light ability  and online customer reviews.. also they sell it with a TACLOC HOLSTER already made for the G19 with the light already on it  so would probably stick with that

     

     

    not sure about  small car safes (but probably need one as can't carry at fire dept  or my  concert venue job either )

     

      I like the gunvault SV500 for in the home   (might even mount one in the back of my F350 SC)

     

    crossbreed looked like it had a nice  bedside holster set up for in the house

    ( I have other fire safes I can always lock away in If I need to )

    The fact that the guns are on back order til??? 

     

    Glock didn't know they have the most popular gun like ever... ???  and made a ton of them  ... I think they had an idea they were popular ??? LOL

     

    or is he trying to get me to buy the $549 guns  also telling me my ID is not detailed enough....

    Glock website just says copy of Dept Issued ID... nothing about a chiefs letter

     

    I really don't want to pay $549 for the earth brown frame/ black slide ones he does have... and said he can't discount them down

     

    Is there anything I am forgetting on my list of stuff to buy?

     

    It looks like I can get better online deals on safes , ears,and dummy rounds  maybe even the FMJ ammo

     

    viridian laser/light looks to be about $379

  15. Very good   thanks for the info.... kinda what I thought

     

    went to blue label dealer today and they said $425 each  and on back order... filled out a form and he will call me when they come in hopefully in January???    said Fire dept ID was too basic,   so I will have to get a letter from the Chief....

     

    told him I wanted 2 Viridian X5L w/ tacloc lasers and hearing protection a bunch of dummy rounds . (so she can be comfortable B4 we use any live rounds) 50 defensive rounds,  1000 FMJ rounds,  2  simple car safes , sv 500 safe $125  (maybe 2 for house), 2 CCW classes and looking at range membership... CASH ( Am I missing anything?  we are Noob's?)

     

    he tried to talk me into 2- $250 hornaday safes, that open with a bracelet, for house... and to get streamlight rail light and laser.. and just seemed too busy  I guess my order is not as big of an order as I thought it was

     

    wasn't a satisfying trip LOL  but he is only Blue label dealer listed in area  

  16. We hit up a few local shops  and it seems that, "as long as she likes it on a range day", we will be getting his and hers  Glock 19 Gen 4..

     

    I qualify for the Blue label pricing  and I think that means I get 3 mags instead of 2... but what else comes in the box??

     

    We are trying to figure out what else we need to buy.
