He did lose his permit and you have no idea of his history here. That's why I clearly state I don't agree with what he did/does/represents. However, he is the most extreme example and he did not get charged. -

As I much as I hate to say this, but I'm just gonna finally lay it out. If you're new to the forum simply google Belle Meade Leonard Embody and Radnor Lake. The guy is a nut and I don't support him in anyway, but if there is ever proof that you can walk around with a loaded gun and not be charged...there ya go. And what he did is not even close to anything Dan, Mike, myself, and others are discussing. Good post by the way Dan. -
Something is up with this. I'm all pro-cop and pro-soldier when it comes to being on duty usually, but we are all human and we all do stupid stuff when we're out drinking. First-degree battery for punching a guy? OK I can see that. First degree murder because he fell and died? I'm not real sure about that. Manslaughter would be more what I would think. Unless the Suspect was just pummeling him and screaming "I'll kill you!", I'm gonna say they'll have a hard time making that charge stick. On the other note I think alot of it depends on the bars you go to and you're amount of self control.

Maybe most felons, IE repeat offenders, but not all. I think you'd be surprised at some of the things that are felonies. I don't think that just because you get in a really bad fight at 18 or 19 and get charged with felony assault that you should be forever scorned from society and gun ownership if you stay out of trouble.

Agreed. Too much zero-tolerance BS. To me a sexual offender is a sexual predator, not some kid who streaks at a football game.

I think it's a good idea. TGO vendors can still always post threads with sales and updates and locals are usually pretty aware of shops/ranges near them. I think it's a good way to keep everyone happy and keep TGO up and running without David trying to scrape together the bill every month just from benefactors and a few vendors. -
No sir, I'm a jeans and t-shirt kinda guy lol Some of it is club business so even though the 'net provides some anonymity I'm gonna be vague. It was just a trip marred by problems. People didn't show, couple bikes had problems, bad attitudes, in-fighting, etc. I eventually just struck out on my own and did my own thing. Started coming down with a cold Sunday mornin so I got to ride back feeling like crap and I had to miss another night of work last night due to being sick. Basically it just wasn't the wild ruckus I thought a rally would be.

I also only brought up guns once for what it's worth. I guess I just don't see why you're so quick to defend him is all. I just can't see being in that position around someone else. Again, not condemning the guy to Hell or anything, I just think it was an accident of negligence, not freak. That may just be a difference of semantics though. To me freak would be my steering wheel popping off with great force and crushing my skull in or something.

Allright calm down. No need in breaking your neck falling off the horse. I'm not condemning the guy, I'm sure he feels bad and I'm not saying he should be charged or anything, but he was negligent. I bring up firearms because it's called a "comparison". My Uncle has bow hunted pretty much exclusively for decades with his friends and they've never had an accident like this. I wonder why. The guy was negligent and he killed his friend. Same way if a soldier or SWAT member killed one of their guys breaching a door in a line. If you're doing what you're supposed to do, everyone goes home.

I smoked and drank heavily this past weekend at the bike rally and now I have a cold...can I have 10 bucks? Of course I jest, but you may use that as an example for your statements if ya like. Statements that I wholeheartedly agree with. Very well put.

So by that rationale a person who makes a mistake at 18, serves their time, and never commits another crime is a worthless person and shouldn't be able to be a productive member or society or protect themselves or their family? That's just astounding to me that you can think that way.

I think so as well. I hate to bring it up again, but Kwik was never charged and he carried a gun down a main street. Lost his HCP because he's a loon, but still. -

First off, let's get the "kid in college", young buck, know-it-all stuff out of the way. I've heard too much of it the past few weeks. I'm not debating age here. We are debating intent of Tennessee state law. I work with this stuff every day. I've sent people to jail for it, wrote reports on it, and trained on it. I know my weapons laws. Now, I agree if you put someone in fear you could very well be charged. That goes to intent. Could you be charged for walking down the street with a gun in your hand even with an HCP? I'm certain you could. Does TN state law say you should be? No. The point many are and have been trying to make here is that nothing in TN state law states that just because you have your firearm out of a holster you are committing a crime as a permit holder. If I am in a situation where I feel threatened and simply remove my firearm from it's holster and have it out of sight, just in case my fear level raises to the use of deadly force, I have committed no crime in TN. If I threaten someone with it or act stupid with it and cause fear then I have. That's the usage and intent of the law that I have seen used in my experiences in Shelby County. -
Gotta say I agree with both lol Why I was never a fan of the "shotgun racking will scare them away". Yea it's a cool sound and we all love it, but I'm not about giving my position or intent away. If I have to shoot the last thing someone in my home illegally is going to hear is a firing pin hitting a primer.

More than familiar with the statute, it's not unclear in anyway. My point is there must be a victim, someone who felt threatened and you need to have a suspect that showed intent. Every time I OC, I am "displaying a deadly weapon". Every time I pull out my pocket knife for some reason, I am displaying a deadly weapon. I live and work in Memphis, TN rival for "weapons displaying" capital of the United States and I have never seen or heard of anyone being charged with "brandishing", Assault, or Agg. Assault for anything like what we are discussing here. If that is happening in your county then I feel extremely sorry for the people that have been wronged by your courts. -

I'm just really glad you have this in your sig line... I've worked with lawyers, cops, firearms trainers, security officers, you name it all my professional life thus far and you are the first person who stated they were in a legal role that has told me I'd be charged for simply removing my firearm from it's holster.I also understand that may be what you guys do where you are and that's your experience. I'm just saying I don't think it jives with state law.
