That was pretty much where I stood. What bothers me is someone looking at that provision as some ace in the hole to break the law and came out ok, because like Canyn said, the chance for someone to just be caught carrying and prosecuted is much greater. Each their own, at least those that disagree are just going on the side of caution as opposed to advocating breaking the law in general.

See the thing that hangs me is the "notwithstanding". It's like it's saying despite what this law SAID, this new laws trumps the old. That, as well, is just my take.

HAHAHAHAHAHAHA!!!! I'll cut you and Creeky in for a slice since you two have give me the will to carry it on. I think to sum this all up, regardless of what we each think, or think we know, there isn't alot of case law on either the baton or 39-17-1322 item in the past year. As Chip pointed out, the lawmakers aren't exactly making things super easy to understand. I mean give me a law that says, "If you carrying you gun somewhere you ain't s'posed to, but som crazy sum bitch comes in cappin' asses and you cap his, we ain't chargin ya".

Fallguy's post is spot on. Nate, I think it would depend on the situation. Like the situation DBw99j described I think you'd be ok. Otherwise I'd hold them physically down, cuff them, or tie them up. Whatever it took depending on the situation. I did see 2 wal-mart guys zip-tie a guy's hands that punched one of them while trying to steal a computer a few years ago lol that was funny. He punched a member of the senior football team.

You can use just about any force except for deadly force to effect a citizen's arrest. I work private security and do not have "arrest powers" so to speak, but I can tell you in the past 2 years I have fought with and physically detained several people and transferred them to Bartlett, Memphis, Millington, Tipton, and Shelby county authorities. You can do the same as a private citizen. The way the law is written is that the citizen MUST witness the mideameanor or felony and if they detain the person they must transfer them to the custody of an LEO ASAP.

I agree with all except that. A private non-leo citizen only has the power to detain a person while making a "citizen's arrest". They do not have arrest powers. Private citizens don't have to read miranda rights, book a suspect, etc. It's not a huge difference, but there are technicalities.

That statement is ignorant. Cops and military all go through specialized training and have powers the average civilian does not. If you want to sit there and tell me they are just like everyone else that's fine, but a sworn LEO is different from the average Joe on the street.

Range USA has AR nights from 6-9pm on Saturdays. They require you use a frangible round so it doesn't penetrate the backstop. The ammo is pretty reasonable I think somewhere around 40 bucks for 100 rounds.

OK now this is ridiculous. I keep my mouth shut and I thought we kinda got this worked out through private posts. Now you wanna start this kinda crap? That's ridiculous man. You just caused me to lose all respect I had for you. I don't know if that means anything or not to you, but you know people can have differences of opinion and at least on my end I was simply cautioning people to check the laws for themselves and to know if it was legal or not. I said before if it is legal then that's great, but my sources that I know and trust said it isn't. That's what was told to me and that's what I relayed. So your answer is to call out a person who once considered you a friend and make me look like a fool. I'm completely astounded at you man.

Thanks for proving my point for me. The Appellate court reversed the decision and he had to go to trial correct? As far as "my company lawyers" maybe you could strap on your big boy pants and add something halfway useful to a discussion before you jump in here and start spouting crap. At least the people here that have disagreed with me can offer a halfway intelligent response. Every post I have seen from you is inflammatory. You just like to start crap or are you just that damn stupid? Go play with someone who gives a damn kid.

I don't have cases to post. I have the opinions of my company lawyers and my instructors. I would think someone who deals with this aspect of law more than the average street cop and teaches this stuff all the time would know the laws fairly well. At any rate, this is like running into a brick wall. I won't post my opinions anymore since either I'm wrong or my sources aren't good enough. I'm seriously hoping you guys are right, but at any rate defenses aren't bulletproof. If you want to carry where you know you shouldn't go ahead. Me? I'd rather just not eat out if I'm that scared. I don't want to be a victim, but I think there is a line between paranoia and readiness. Take care folks. I'm out.

As someone who wants to be a trainer I won't sit here and advocate breaking the law. I will fight like hell to get them changed however. That being said I'm done with TGO for awhile. I think alot of you guys on here, but there is some really bad misinformation going around from "experts" and "lawyers" who "know a guy who knows a guy". If you are getting information on 13-whatever from State Reps cool. I'm not. I'm getting it from my sources that I trust and work in my jurisdiction and have cases backing their views and opinions. Everyone is so quick to slam someone who calls them out on their opinions anymore. I'm not leaving and not coming back, but I'm gonna stay out of the boards for a week or so and let these threads drift off and die. It's not worth the hassle of arguing with people I generally like over "perceptions of law".

6 in one hand and half a dozen in the other. I'm not saying I wouldn't want to shoot the guy, but seriously it's easy to talk big on the 'net and all, but have you ever seen anyone run through the criminal justice system? Let's say you shoot the guy, and contrary to TGO popular opinion, you go to jail because you were carrying your gun in a prohibited location and the judge feels like making an example out of you. The jury feels that you broke the law and the DA makes a good case that you could have fled. So to save yourself life in prison you plead to Manslaughter. You do 3-5 in jail, lose your guns, your permit, your job, etc. Not so rosy is it? Maybe you live, maybe you die, maybe you go to jail, maybe you don't. Flip a coin and spin the wheel.

I'm not trying to get into a pissing contest. I'm just stating this is a debated issue and I think everyone should understand the law, because on your end you say it's ok, on my end I've got lawyers, cops, state certified instructors, and even the shops that sell the things saying Nope no go on civilians carrying. I'll be interested to see what the State rep says, but until I get something more solid than an interpretation of law, I'm standing by my sources.

Not really the same thing. If batons are legal for civilian carry then why do most shops not sell to civilians? I'm kinda at the point to say do what you want, but the internet is not the place to get your legal advice.
