  8. Well it was bound to happen sooner or later. I got hurt at work. STAT call to deal with a Psych patient. Make the scene and the dude is chilled out. He's hopping back up in the bed RNs are getting him cleaned up. He had pulled out his IV so there was blood everywhere. I disregard my other officers and I'm explaining to the guy why he needs to relax and why he has to stay. All of the sudden he bolts up and jumps for the door. He slams into the glass, I grab him, and it's on. I get him in a choke-hold and over the bed we go. Radio comes off, my back gets slammed into the bed-rail, and when we hit my shoulder goes POP. We put him in restraints and he gets some night night juice. Meanwhile I have to fill out paperwork, get x-rays, and be off until Saturday. Luckily my shoulder has been dislocated before so it pretty much pops in and out like Mel Gibson's in Lethal Weapon lol No "new" damage, but I'm on pain meds and home bound until I get checked out again tomorrow. Fun day. On top of it all I have a sinus infection from Hades.

  11. Yea you can still claim 3rd party self-defense. In that situation I'd be utterly flabbergasted if the Chief of Police didn't pin a medal on you. There are plenty of situations where shooting someone in the back would be justified. They could have a gun on your wife, kids, or another citizen.

  13. That is pretty much the biggest issue. There are alot of guys out there that are average size and don't look menacing at all. To bad they have 20 years of 8 different types of martial art and special forces training uder their belt. Really to bad they just decided to go the heck off and are now trying to kill you. Likely scenario? Probably not, but it does go to what you know when the threat is taking place. If a guy punches you, you better not shoot him. If you fall to the ground and he is trying to stomp your head into the ground...different story. It's a weird what if. You really are looking at 1000 different variables.

  19. Correct. It wasn't admissable because Fish didn't know these things at the time he shot his assailant. The assailant never deployed the screwdriver.
  20. Understood, but Pursuant to Rule #3 of the Second part. Under 39-17-4008 you must post a TCA sign on each thread notifying the poster that they are in violation of said part. Notwithstanding the fact that they have heretofore violated subsection D of the 5th part. Thank you.
  21. It's really going to depend on if it it goes to trial or not. Remember the Harold Fish incident? The guy was crazy, had a violent history, and had a screwdriver on him. Guess how much of that went to trial? Zip, zero, nada. I'm 6'3 175 pounds athletic and work Security. I also can claim different belts in 2 different styles of martial arts and basic military training. I am probably not gonna be able to justify shooting 1 unarmed attacker. Now multiple attackers or attackers with weapons, probably so. The thing to remember is you must be able to defend why you felt the way you did at the time you pulled the trigger. You must be in fear or your life or serious injury. Fallguy pretty much summed it up when he said there is no black and white.
