  2. Why? Why should a person committing a criminal act be able to claim self-defense? Bill and Joe are at a drug deal. Joe knows it's dangerous, but goes anyway. Bill tries to shoot Joe. Joe kills Bill. Joe put himself in that situation. He had a choice. Now a permit holder carrying in a posted location, illegal, but not the same in my eyes, a judge or jury maybe, but not mine. Now your average criminal, no they do not have a right to self-defense if they are committing a criminal act. That is why we are law-abiding. We make alot of pro-gun arguments based on this remember? The law clearly states you DO NOT have a right to self-defense if you are engaged in illegal activity. That is the law of the state of TN. There is no misconstruction.

  4. The rubbermaid containers are a great idea. I'm working on getting a large container set up for the essentials so if I have some time I can load up and get out. The bug-out bags are ready to go though. Now with the loaded long-gun law my Henry .22 survival rifle is loaded up and a new addition to the bag.
  5. It can be overwhelming. My advice is the same as the Instructor's I work with always give, follow the law. If you are unsure about something always ask or talk to a lawyer.

  7. That I'll agree with. If someone is running away and no longer a threat you can't shoot, but if he turned around and shot you and killed you, even if you did fire at him, he can't claim self-defense because he is engaged in illegal activity.

Self-defense. — ( (1) Notwithstanding § 39-17-1322, a person who is not engaged in unlawful activity and is in a place where the person has a right to be has no duty to retreat before threatening or using force against another person when and to the degree the person reasonably believes the force is immediately necessary to protect against the other's use or attempted use of unlawful force. (2) Notwithstanding § 39-17-1322, a person who is not engaged in unlawful activity and is in a place where the person has a right to be has no duty to retreat before threatening or using force intended or likely to cause death or serious bodily injury, if: (A) The person has a reasonable belief that there is an imminent danger of death or serious bodily injury; ( The danger creating the belief of imminent death or serious bodily injury is real, or honestly believed to be real at the time; and © The belief of danger is founded upon reasonable grounds.
  9. Sorry, but that is BS. While I agree with Hex you shouldn't shoot him in the back because he is no longer a threat, he still can't claim self-defense. If he is running out the door with a bag of money he is still committing the crime. Your instructor's logic is akin to an officer showing up at a robbery scene, the perp dropping the money and his gun, and the officer going 'Well crap Frank we can't arrest him now, he's not doing anything." It doesn't work like that. You would actually be within the law if you pursued him and placed him under citizen's arrest. Not advocating that, but just saying there is not a time in that scenario where the crime just stops. The threat to use deadly force yes, but not a time where the BG can suddenly claim self-defense.
  10. Who the hell was your instructor?! That is complete BS. First, you cannot claim self-defense while committing a crime. PERIOD. The new self-defense laws in TN specifically state you cannot claim self-defense while committing a criminal act. This is why there is much debate about the 39-17-1322 thing, because technically by carrying in an off-limits location you are committing a criminal act. That defense just supposedly gives you an out if it was a gun charge and you used it justifiably, but it has not been case tested yet. Second, there is nothing in the law that says a gun must be pointed at someone before you can shoot or how close a person with a knife has to be. A person can close a 21 foot gap in about a second. You just need to be able to articulate Intent, Ability, and Jeopardy.

  12. True. LOL ham sammich. My point was a DA could always charge you and a judge could throw it out based on that defense. I'm just bringing up the old debate points that there are still people who say that law doesn't apply now because the new laws canceled it out. Not wanting to rehash the debate, just cautioning anyone (especially a new member) from thinking they have some magical legal loophole to carry where ever they want as long as they don't get caught while not defending themselves.

  15. This too...TN now has laws in place that protect you from a civil suit if you are not legally liable in the shooting. Doesn't mean you can't be sued, but it's more or less agreed that it will keep the lawyers you mentioned from taking frivolous cases.
  16. Just FYI everything else you said was great, but the hollow point thing...don't believe everything you read on the internet I'm not a hero. I don't carry a gun to be a hero. I won't say what I would do one way or the other. I make judgements based on the exact situation at that time. No scenario is the same, that is why training is so damn important. You can't just be able to fire your gun accurately. You have to have the mindset to assess the situation, recognize the target and collaterals, and then engage or disengage. If you engage you need to be prepared to do what is necessary to keep you and everyone that is not a target alive.
  17. I hear that from alot of cops as their reason for not wanting to allow students to carry. My question to them is always "Do you shoot every person you see with a gun?" You survive first, then you sort out the details.

  19. I had the same issue with my RIA 1911 and it is clearing up now around 500 rounds. Use the WC mags like Truthsayer suggested and maybe only load 6 or 7 rounds. See if that helps for awhile.
  20. TWRA won't have a thing to say about it. If it passes state law we'll be able to carry there. If TWRA doesn't like it, tough. Their little regulations do not trump state law unless specifically granted the right to do so by the legislature.
