I believe the distinction is, if you have a valid HCP, "brandishing" for you becomes pointing it at them. If you do NOT have a permit, making it visible is brandishing.   So it was explained to me.

I think the issue, as I understand it, is that the 5.56 loses its' tumble at impact at the lower velocity, and therefore loses its' wound capability. I think that's where the comparison to a .22 round comes in.   I don't know; I'm just offering that to the discussion.
