Chances, I worry about more political capital being placed on the open carry w/o permit bills VS a good bill like this that fix all the off limits places. I think i'd rather pay 50 bucks for my handgun carry permit and carry anywhere legally than open carry w/o a permit at Wal Mart. The open carry bills do not fix the school issues, parks, or the no gun signs that we can get fined for. In an ideal world, you would be able to open carry anywhere without worry, but in reality it just isn't going to happen.

This is an excellent bill. You'd be crazy to not want this to pass VS all the other bills that are floating out there. Prison guards, full time LEO, reserve LEO all carry under 39-17-1350 and can carry anywhere legally in TN when off duty. An off duty LEO in TN can carry legally in any parks, any posted properties, or school property without fear of criminal prosecution. Read 39-17-1350 for info on off duty carry. The only catches are that off duty LEO's cannot be drinking while carrying, not intoxicated, and must notify the principal at a K-12 school that he is carrying when he enters the school. That is a HUGE improvement over what we have now with the park problems, school property felony, and getting fined over signs. (a) Notwithstanding any law to the contrary, any law enforcement officer may carry firearms at all times and in all places within Tennessee, on-duty or off-duty, regardless of the officer's regular duty hours or assignments, except as provided by subsection (c), federal law, lawful orders of court or the written directives of the executive supervisor of the employing agency. ( B) The authority conferred by this section is expressly intended to and shall supersede restrictions placed upon law enforcement officers' authority to carry firearms by other sections within this part. (this strikes out the other non carry areas of the TCA) (c) The authority conferred by this section shall not extend to a law enforcement officer: (1) Who is not engaged in the actual discharge of official duties as a law enforcement officer and carries a firearm onto school grounds or inside a school building during regular school hours unless the officer immediately informs the principal that the officer will be present on school grounds or inside the school building and in possession of a firearm. If the principal is unavailable, the notice may be given to an appropriate administrative staff person in the principal's office; (2) Who is consuming beer or an alcoholic beverage or who is under the influence of beer, an alcoholic beverage, or a controlled substance or controlled substance analogue; or (3) Who is not engaged in the actual discharge of official duties as a law enforcement officer while attending a judicial proceeding.

I think this bill is a good bill and has a decent chance of getting past the committees for the following reasons WITH proper support from NRA: 1. It is a simple and clean bill that fixes all the off limits (parks, school property, no guns signs) locations for people with handgun carry permits. If someone is quiet and keeps his handgun concealed, he is legal and no one will know. If a property owner notices the gun, the property owner can just ask the permit holder to leave. It is a good balance between property rights VS gun rights. No one can claim that guns are being forced on them because as of now, any property owner can ask an off duty LEO to leave the gun in the car. 2. Unless there is a lot of dishonesty, there is no way a fiscal note can be attached to the bill, throwing it in that finance committee to be killed. The open carry, the TICS exemption, and anything reducing or eliminating handgun carry permits will get the finance attachments and kill the bills. It stinks but that is what the politicians pull. You have to figure out how to work around that with something that doesn't affect money the state gets off permits. 3. It will not attract the media attention like the constitutional carry or open carry bills. There is a chance it could fly under the radar like the car carry bill did last year when the open carry bill attracted all the bad press. If the bill gets a floor vote, most of the politicians will not vote against it because they want the NRA vote.

I would see if he would get behind HB0320 and focus efforts on that. HB0320 is one of the best bills introduced this year that will decriminalize some spots for people with handgun carry permits. Your handgun carry permit would actually be a huge benefit if HB0320 was passed into law. There is also now a Senate companion bill of HB0320. -
This is the best bill out of all the bills introduced that would help people with handgun carry permits. It is short, clean, and makes too much sense. We'll see if it makes too much sense for the politicians. We would basically have an enhanced permit like people in Mississippi have and can carry anywhere legally except courtrooms during court. I'm sure you'd get asked to leave if you notify a school you are carrying, but that is a whole lot better than being arrested and charged with a criminal charge. I think it would be great if the TGO folks got behind this bill. TGO folks that live in this rep's district need to contact the representative and thank him for this bill.

Yeah that is why I think property owners should be able to ask people to leave, but on the flip side someone carrying at a place with a no gun sign should not have to worry about a weapons charge. I think that protects property rights and also protects the gun rights of the person carrying. If the person carrying is smart, the person would conceal the handgun well in such a location and the property owner would not know about it, if signs did not have any criminal penalties. -

I think the time spent on a parking lot bill that kept employees from being fired for guns in cars could have been used to repeal the whole 'no gun' signs law or remove the criminal weapons charge of that law. It's a stupid law that could have been modified with the right approach and very little media attention. You'll do that way before you take away a company's ability to fire people. I also think that the time spent on the whole open carry bill last year could have been used to fix the dumb off limits places for people with permits. Fix the off limits places for the handgun carry permits, then go for constitutional or open carry. What good is having a handgun carry permit when you can't carry legally here or there because of a stupid sign? I've traveled to a lot of places and I have seen more legally binding signs in Tennessee than any other place I have been. Most other places either don't have any sort of weapons charge for a sign or you just never see them in the few places that do the same thing as TN. I'd gladly take legal concealed carry anywhere I go VS being able to open carry but truly not being able carry everywhere. -

Yeah it would be nice if our handgun carry permit became a TICS substitute but I'd rather have some of the other bills passed that improve carry VS this bill. -
Yeah I'm hoping this makes it out of the committees and is allowed a floor vote as a clean bill. Hopefully it doesn't get thrown in that finance committee again.

" We need to work for this in Tennessee through the NRA and our legislature. Make the handgun carry permit an exemption for parks, schools, and places with no guns signs. Once you make those fixes like Wyoming is trying, TN would have some of the best carry laws in the country.

We need to get behind this bill and also the house companion bill when it is introduced. This bill will legalize handgun carry permit holders carrying handguns in all parks. It seems to be a good bill and provides a clean exception for handgun carry permits. Hopefully a house bill will be introduced soon. This bill should be a big priority for us to get passed.

I think that business owners should be able to disallow firearms, but on the flip side there should not be a weapons charge for someone with a handgun carry permit carrying a handgun at such business. I think it should be a trespass issue if the person with the handgun is asked to leave and doesn't leave. That works in most states, why can't it work here? We just need to find the right legislator to sponsor a bill and fix this problem. It is a pain to go anywhere in downtown Memphis because both private businesses and the local government offices all have 'no guns' signs. Of course you can say not give businesses your money, but when you are asked to meet somewhere for business or have to go to a local government building for work, good luck avoiding it all.

It looks like to me if you are in legal possession of the firearm, then you can have it loaded in your car when you are 18. You have to be 18 to possess a handgun in Tennessee, unless you have permission from your parents to use it in certain activities, like target shooting.

Will there be any decent bills introduced this legislative session to fix some of the problems that folks with handgun carry permits have as far as the local parks or no guns signs? It would be nice to be legal when carrying in parks in Memphis and the city government buildings in Memphis.

Why would it be illegal for him to carry at the meeting? I can't think of why it would be illegal in Tennessee.
