  1. I doubt this will happen.  The military is pretty anti gun and doesn't want people carrying on their bases.  I don't think even their own security or police can carry off duty on the bases.
  2. Keep your car doors locked, windows up, and watch out at intersections and keep the car moving if possible.  It's hard for someone to get into a vehicle if the vehicle is moving with the doors locked and windows up.  I would not advise anyone to get gas in any of those parts of Memphis mentioned, and especially not for a woman to get gas in those areas.
  3. It is my understanding that Andrews Vs State basically affirmed that Tennessee could pretty much prohibit the carrying of weapons in public because it was a part of the whole 'prevent crime' aspect.  I don't know if that is the best court case to help us.
  4. The legislature should have just listed a handgun carry permit among all the other present exemptions to both parks and school property.  School shooting teams, hunters, and armed guards already have this exemption and you can't tell me that handgun carry permit people are any less law abiding or qualified than armed guards or school shooting teams.   The legislature also could have fixed the no guns sign problem by changing it to a trespass issue instead of a weapons violation, but again did not fix that problem that affects not just handgun carry permit people but anyone such as armed guards servicing a location with a 'no guns' sign that complies with state law.  Are people declaring cased firearms inside the airport terminal breaking 39-17-1359 too?  It looks like they technically are if the airport has no guns signs up.
  5. We just need to quietly change the whole no guns sign law and have it changed from a weapons charge to a trespassing issue.  Most other states treat no gun signs as a trespassing situation when people with guns do not leave when asked to leave.  This is how the safe commute law is set up.  You can be asked to remove your car with a gun in it from any property, but it can only turn into a trespassing issue if you fail to leave when asked.  It is not a weapons charge to have the gun in your car.    If you read the law as it is written, even armored car services or contract guard services are breaking the law every time they service a location with a no guns sign, such as Regions Bank or a city of Memphis government building.

If I couldn't get fined over a no gun sign at a local government office, I'd say they could put up all the no gun signs they wanted because I would conceal and ignore those signs.  Since we can get fined over those signs in TN, I have a problem with local governments being able to hassle me after I have had my background checked and paid the money for a handgun carry permit.

I could see the argument in regulating the carry of people without permits prevents crime (I don't agree with it) but I don't see how regulating where people WITH permits prevents crime.   Either way, we need to get the legislature to can the whole no gun signs law or just remove the criminal penalty for people with permits and we would have some of the best carry laws in the country.  The funny thing is that Regions Bank has legal no gun signs up at a lot of their branches.  I am going to guess that Regions Bank's contract armed guards and armored truck services are technically breaking the law as far as 39-17-1359 because there is no exemption in that law for armed guard licenses.

I'm surprised that happened in Cookeville.  I didn't think there was a lot of gang activity in that part of the state in between Nashville and Knoxville.  I've stopped in Cookeville passing through and it looked like a pretty safe area that was kept up nice.  I guess anything can happen anywhere.
  9. I don't think there are metal detectors for the BBQ event so I would just carry concealed then no one can tell you to leave.

The Memphis Zoo is within Overton Park and Memphis in May is within Tom Lee Park.  Can you believe that Nashville is going through the paperwork to try to reclassify parks because people who have been fingerprinted and background checked might be carrying?  They sure never went through that when all the gang bangers have been carrying in the parks.  Same thing with Memphis.  Both Memphis and Nashville are some of the most violent cities in the country about every year according to crime stats and instead of dealing with gang bangers they put the focus on hassling us.   HB 995 that became law says for the new exemption:   "Persons possessing a handgun, who are authorize to carry the handgun pursuant to 39-17-1351, while within or on a public park, natural area, historic park, nature trail, campground forest, greenway, waterway, or other similar pubic place..........."   The bill description says this:   " As enacted, allows permit holders to carry handguns in parks and other public recreation areas owned or operated by local governments except when the property is in use by a school for an athletic event or other school-related activity; prohibits permit holders from carrying handguns in parks and other such areas that are owned or operated by a school; removes authority of local governments to prohibit handguns in parks by posting. - Amends TCA Title 39, Chapter 17, Part 13."     I'd say if any of those amphitheaters and pavilions are inside park land or other similar public place in Nashville, you should be legal there jus like the Memphis Zoo.  I'd even think that it is probably illegal for Beale Street to keep people with handgun carry permits from carrying on Beale Street since that is a historical area and a public street. 
  11. He is one of those guys that you know has some sort of problem but you can't totally prove it, whether it is a problem of his own fault or someone else's.  Odd how he has been involved in several incidents.

Let Memphis in May feel good about their rules.  I would just conceal my handgun like I always do and carry down there at the park.  I guarantee you others will also.  The BBQ event itself is pretty safe.  It is the walking from the event to your car where you can have a problem.  People carrying at the BBQ event is no different than anywhere else.  The handgun stays holstered and 99% of people conceal so no one knows about it.
  13. I would avoid leaving a gun in a car where others, especially kids, can get it.  Most armed robberies take place when people are walking from a building to their car in a parking lot.  A gun doesn't do much good left in a car.
  14. Yeah 39-17-1359 no gun signs do not apply to parks the way I understand the law now that it has been changed.  I still wonder if you could be asked to leave.  Of course, if you conceal no one will know and be able to ask you to leave.

You can probably be asked to leave, but wouldn't have to worry about criminal charges since you have a handgun carry permit.  It is no different than carrying at a business that has a no gun policy but you are legal carrying.  That business can still ask you to leave.  A handgun carry permit protects you from criminal charges, but not no gun policies.  Even off duty police can be asked to leave a business if they are carrying.   Personally, I would conceal my handgun and carry at those places because Tom Lee Park is a Memphis park and is legal to carry in now.  I guess you could open carry to prove a point, but I wouldn't do that now until all the bed wetters settle down.  Give it some time and people won't even think about it.  These people are making a big deal out of nothing.  The Memphis mayor thinks there is some big deal to operationalize, but there is nothing to worry about. Carrying a gun at a park or event is no different than carrying at a department store or the gas station.  The gun is safe when holstered and 99% of people conceal carry in this state so no one even knows about it.

Have bills such as this bill passed in other states actually accomplished anything or were they mostly symbolic?  I guess considering how many crimes involve both federal and state/local police (often given fed credentials) working as teams, I don't see how state/local police could avoid enforcing federal gun laws in certain cases.    I guess this would be similar to Colorado not having any drug laws against marijuana, but the drug is illegal on the federal level.  I'm going to assume that there are Colorado state or local police that are enforcing the fed drug laws as part of task forces with federal agencies.

That bill doesn't really accomplish anything for the average gun owner in this state and is just symbolic in the whole states' rights debates.   We needed solid bills that removed restrictions on handgun carry permits.  We're lucky the whole park bill passed and was signed into law after all the road blocks that were thrown in front of it.  I honestly was surprised that the car carry bill became law last year with very little media attention.  Those were both good bills that help the average gun owner.

A handgun carry permit's purpose is to keep you from getting weapons charges.  I think a bill to remove criminal charges for carrying on school property for people with handgun carry permits stands a much better chance than canning the ability of a school to have a no weapons policy.  It is a huge benefit to a lot of people because it is much better to get kicked out of school without a weapons charge than get kicked out of school WITH a weapons charge.
  19. I think if this was promoted as still allowing the colleges to have their no guns policies, but no criminal charges, it would stand a much better chance than making the colleges get rid of no gun policies.  Same thing for the no guns signs that people can get fined 500 bucks for.

Yeah from what I understand, you can carry in K-12 schools and also colleges in Alabama.  The schools can ask you to leave, but if you have a license that is all that can happen.  If you conceal, no one is going to be able to ask you to leave and you are following the law.   We need to use this list of states in order to back changes to Tennessee carry on school property for people with handgun carry permits.  You are going to need someone who can relay the information to sympathetic legislators and get the backing of the NRA.  Show that these other states do not have problems with licensed folks carrying on school property.  I mean think, people complain about California gun laws, but you can carry in K-12 and colleges legally in that state.  That is one of the few bright sides to California. 
  21. (d) A handgun carry permit holder transporting, storing or both transporting and storing a firearm or firearm ammunition in accordance with this section does not violate this section if the firearm or firearm ammunition is observed by another person or security device during the ordinary course of the handgun carry permit holder securing the firearm or firearm ammunition from observation in or on a motor vehicle.     You need to look at TCA 39-17-1313.      This is the safe commute law.   You can handle the handgun to secure it in your vehicle when on school property as long as you have a handgun carry permit.  A school can still fire or expel you but you can't face criminal charges for storing a handgun in your vehicle.

This list is smaller than the college carry list, but there are several states.  Again, these schools can still ask people to leave, but you can't get hit with a weapons charge.  The states in bold border Tennessee.  I did not add states where people can receive permission, say from a school board, to carry.  The list would be longer if I added those states.  Some states, like Colorado, only make carry on a public K-12 school illegal.   Hawaii Oregon California Utah Kansas Missouri Louisiana (parish issued license only) Mississippi (enhanced license only) Alabama Delaware Rhode Island New Hampshire

You might want to take note that college campus carry is legal with a license in the following states as far as I can tell.  This list does not mean that the colleges can't ask people to leave.  You just can't get hit with a criminal weapons charge.  The states in bold border Tennessee.  It is legal to carry in a college as far as I can tell in about half the states.  There were a couple of states, such as Wisconsin, that I was not sure on.   Hawaii California Oregon Washington Idaho Utah Arizona Colorado South Dakota Minnesota Iowa Missouri Kansas Louisiana (parish issued license only) Michigan Indiana Kentucky Mississippi (enhanced license only) Alabama Virginia Delaware Pennsylvania Rhode Island New Hampshire      
  24. Memphis College of Art does not own Overton Park.  Memphis College of Art is a private school.  Overton Park is owned by the city of Memphis.  You should be legal carrying in Overton Park and the zoo.  If Overton Park was owned by the college, then I would say you couldn't carry in the park.
  25. Most of those museums and community centers are located inside parks or similar public places.  I would guess you are probably legal but who knows.  I would still conceal to avoid any problems.  There are too many gray areas in this state for me to openly carry unless on my own property or a place like a gun range or out in the woods.
