How about we just get rid of the 'no gun' signs criminal penalty? Isn't that the easier solution? Let the property owner put up the 'no guns' signs, but remove the criminal penalty and turn it into a trespass issue. Sometimes politicians really make things more complicated than they need to be. Look at how the park carry bill turned into several pages of garbage when it could have been a clean one line exception. Also look at these private school and university carry bills that have been proposed for further proof of something that is more complicated than it needs to be. -
SB1736 is a bad bill that will not make any movement. A bill that adds liability to a business over a no gun sign will not go anywhere. Why even write a bill like this when you can write a bill to just remove the criminal charge of the sign law? The easier solution would be to just get rid of the sign law or heavily modify it into a trespassing issue instead of a weapons charge. If you fix the sign law, then people would be able to legally carry in a lot more places. You can say just avoid a business all you want, but people forget that these signs are legally binding at any local or state government building and places like hospitals where people often have to go Think about this. There are more than just private businesses that have legally binding signs. There are a lot of places that you have no choice in going but must go, like a hospital or local/state government office. If the sign law was changed and you were concealing, you would not have any problems and be legal. when at those places. If you are not good at concealing and being quiet, then you'd be asked to leave. When you cause a scene and don't leave, then it is trespassing. That is how most of the country operates except for TN and a few other states.

How much does that Constitutional carry bill have of not getting a fiscal note and being stuck in the finance committee?

The anti gun college faculty members will be voting for Bernie Sanders this year. The heavily Republican state legislature doesn't owe them anything and does need to pay attention to who got them in the legislature if they want to stay in there.

Obama has just a year left as president. He can't do anything as far as guns because Congress will not do anything of substance. -
Why is the college carry bill just covering college employees? Why not just have a clean exemption for all people with a handgun carry permit.? If you are going to go to the trouble of rewriting the law, just give everyone with a permit an exemption for carrying at a college or school.

I never really liked to fly before the TSA was started, but all the useless TSA garbage has made me avoid flying unless absolutely necessary. I highly prefer to drive instead of flying.

I think if the legislature spends time on this, it needs to turn the sign law into a trespassing issue or totally repeal the sign law. Would the NRA or other groups be willing to lobby for this?

We luckily have pretty good reciprocity with the TN handgun carry permit. The live fire training and 21 age requirement seems to help with reciprocity. About the only places you can't carry on the TN permit are states in the Mid Atlantic/Northeast, California, Illinois, and Hawaii. You can get non resident permits in some of the east coast states that do not have reciprocity. You can at least bring a handgun with you to California, Illinois, or Hawaii. I'm surprised that some state has not filed a lawsuit with the federal government over LEOSA.

Mississippi has an enhanced permit that allows you to carry in more places, such as schools. The training for the MS enhanced is basically the same thing we go through to get our TN handgun carry permit. MS does not require training for a regular permit. I agree that we just need get rid of the sign law this year. I think that is a decent goal that has a chance of passing as some sort of technical correction. I'd like to see handgun carry permits legal inside school buildings, but that would be an issue that would attract a lot of attention. If we got the sign law changed, we'd be legal pretty much anywhere in this state except for courtrooms and school buildings. Not bad compared to what it used to be here. I'd like to see Constitutional carry or open carry out of principle, but don't see it happening with the finance committee games.

I'd like to see a TICS exemption too for handgun carry permits, but I don't think it will go anywhere because of the perceived fiscal impact on the state. I think removing the no gun fine signs would be easier and might be able to fly under the radar just like the gun in cars law did a couple of years ago. Cut the law out or heavily modify it to basically a trespass issue and there is no way there could be any fiscal impact on that sort of change, so it won't get tied up in committee. Get the NRA and other groups to push for it. School carry would be tougher and receive a lot of media attention. You could possibly make it legal at private schools, but I doubt it would get anywhere if it included public schools. Constitutional carry and open carry would receive a lot of media attention too and you'd have a the state government claim that it will lose money from people not buying handgun carry permits.

Obama gets to look like a hero to his supporters and the GOP candidates get to raise cane over the Executive Action, so all the politicians benefit. The executive action did not change anything legally as far as normal intrastate private gun sales because Congress must make that change. It may even benefit people in certain parts of the country as far as NFA items because they will not need permission from their county sheriff anymore, just notification. If the bulk of the population really believes that Obama stopped private gun sales, then so be it. The less a lot of people know, the better sometimes. -
Either way, I'd sure like to see the sign law neutered in some fashion. The park law last year opened up a lot of places for legal carry and neutering the sign law would do the same thing.

I would remove both the criminal charge and the fine for people with handgun carry permits. Missouri, for example, only turns the signs into an issue if you fail to leave when asked to leave, and even then it is only a 100 dollar fine. Missouri's sign law makes the busy body politicians feel like they are doing something but in fact it helps people with permits. You can even carry on school property legally in Missour until someone notices you carrying and asks you to leave. That is a lot better than Tennessee. Change the wording to something like this: Carrying of a concealed firearm in a location specified in subdivisions (1) to ( 17) of subsection 1 of this section by any individual who holds a concealed carry permit issued pursuant to sections 571.101 to 571.121 shall not be a criminal act but may subject the person to denial to the premises or removal from the premise

The fine is the same for carrying past a sign on a government building just like carrying past a sign on private property. Both are a misdemeanor 500 dollar fine. You can carry in state and local government buildings if there is not a sign. We just need to get this sign criminal charge removed during this legislative session. Any bill in the works? -
If the fines were dropped, then if you had to go to some sort of local government building or a hospital to see family, you wouldn't have to worry about a weapons charge. Many places have these signs that are not just ordinary stores or restaurants and you often have no choice in going to those locations.

I'd push for getting rid of the fine for no gun signs and also school property carry. I think the no gun sign law modification would be easier to get politically than school property carry.

I think also for the handgun carry permit to be a substitute for a background check when buying a gun at a dealer, the state would have to run background checks yearly on all the handgun carry permits. I may be wrong, but I think the background checks are only done when the permits are renewed.

I would like TICS exemption too for the handgun carry permit but I do not think it will happen. Pro gun bills have a way of being stalled in the finance committee and a TICS exemption would reduce govt revenue. We need bills that would not get stuck in the finance committee so that they can reach a floor vote.

Are there any plans this legislative session to get rid of the 500 dollar fine for the 'no gun' signs? We would have it pretty good here with our handgun carry permits if the 'no gun' sign law was modified to remove the fine for people with permits.

This executive action does not change anything except for NFA items bought with trusts IF 41P regs are put in place. Just like I said before, the president cannot on his own force all private intrastate gun sales to go through a dealer. -
Have the NRA and other lobbying groups started working with our state legislators on bills to improve our carry rights?

The president can't just make up a new law to make all private sales go through a dealer. He can change executive branch agency regulations, such as not enforcing federal drug laws, not enforcing immigration laws, or stopping imports of certain goods, but he can't make all private gun sales to go through a dealer. That would require a bill to be passed by Congress and then signed by the president.
