looks like you did well! How do you like the tactical mag release? I looked at those from time to time but have never heard first hand opinions. Is that the Krebs hand guards? how heavy are they?

I have no more use for this. You have effectively argued against you own point at this juncture. You have it set in your mind you can't trust the government and then want that same government to save you through some sort of judicial review. It is emotional paranoia and there's just not much than can be done with that. Bottom line, the detainees are being treated with far more civility and legalities than they warrant (even under our own laws) and the SCOTUS directly subverted Presidential and congressional auothrity in relation to war time policy and procedure. The constitutional authority you think you are championing in one hand, you are slapping with the other. Have a good day.

So what is your premise then? My premise is that this is war time prosecution and as such, the SCOTUS has subverted the entire history of judicial and constitutional review of this matter.

and just how would you go about doing that? Would the "detaining" officers testify, evidence collected and cataloged from the battle field, "crime" scene sanitized? War time is an entirely different proposition than peace time policing. Your mixing a fear of losing civil liberties based on an international war is misplaced. Heck if we wanted to (maybe we should) we could label these as "pirates" and execute them on the spot without military tribunal or any other legal process. i don't recall the total degradation of civil liberties when these policies were imposed.

How do you know they are innocent? I prefer to use the judgment of the guys picking them up. This is Vietnam mentality all over again. People thousands of miles away over ruling and making "judgment" calls not trusting our guys first hand experience and veracity.

POW's fall under the Geneva convention. Enemy combatants do not nor are they afforded any legal distinctions since they are non-conventional troops. The reasoning is that if you choose to fight guerrilla style, which is "unfair", then you can't cry when you are treated differently. We apply this same thing to our own "black op" operation's. If they are captured or compromised then they are essentially on their own. essentially there is no double standard. Think of it this way, if you want to cheat that's fine and dandy, but if you get caught you can't cry foul after the fact.

and there lies many problems. SCOTUS has just become the entity that decides what formal deceleration there is. Are we at war, are these POW, are they enemy combatants? They just took that away from the President and congress (in their respective capacities) and made themselves the governing body. That is unconstitutional at the extreme. Besides how can they only apply that to these detainees and not have overlying power in future rulings? Also they are not generally conservative. We are getting closer but it is still 5 to 4, as evidenced in this ruling.

Then as a strict constitutionlist you should know that the constitution is only applicable to those who submit to it. It is a mutual contract between citizen and government. Those we fight against honor neither and so are afforded no legal stature. That has always been the understanding, in fact Habeas corpus and the like has provision to be suspended in light of open rebellion. In the face of war, 1. it doesn't apply for the above reason, 2. it could be an understood (or fromal) deceleration of rebellion. BTW - you do understand that you have equated your self with the terrorist right? They do not have the same legal rights as a citizen regardless of the state in which they were captured. That holds true for even international law. As human beings? sure, but that is not what we are talking about. If we are arguing about the state of man, the constitution is an echo of the values that exist aside from a written agreement.

No offense, but that is one of the most thought out ignorant responses I've seen. The total mis-application of citizen rights and war time prosecution is glaring. It is an emotional response rooted in a lack of understanding of law and war.

47! Why the Russians bought into the AR theory is beside me, unless it was a cost measure. (They were going under!) The 5.45 tumbles like the 5.56 but looses all the benefits of the 7.62x39 in the AK platform. Besides you're never going to get the benefits of the AR (range and accuracy) in the AK platform. It was designed for the x39 and that is what should be used in it.

this is one of those topics that never gets to a conclusion. Everyone will state their facts and there seems to be evidence for both sides of the coin. Personally the effectiveness of 9mm is the blalance of higher velocity and weight. That is why 115 is the standard. I use 124g +p for the same reason. 147g tends to be too heavy to get necessary velocity. However, advances in bullet design nullify some of those concerns but I still don't like them. Here is an excerpt of an article from Chuck Hawks. "All during the post-WW II years from 1945 to the 1990's there were a tremendous number of articles and books written by supposed experts alleging the superiority of the .45 ACP over the 9x19. These assertions were usually based on theoretical models of stopping power (like the Cooper "short form") that suggested a large .40 or larger caliber bullet had some intangible advantage in stopping power irrespective of the actual energy delivered. These theoretical models seriously over estimated the stopping power of the .45 ACP and seriously underestimated the stopping power of the 9x19. Assertions that .45 ball (FMJ) ammunition was 90% effective in achieving one shot stops were common. The truth revealed by the 15 year Marshall-Sanow study of thousands of actual shootings is that standard 230 grain .45 ball ammunition is about 62.89% effective, and 9x19 115 grain ball ammunition is 62.26% effective in achieving a one shot stop. More important to civilian and police shooters is the effectiveness of the best bullets in the calibers, which for most purposes are expanding JHP bullets. The top load for the 9x19 is the Cor-Bon +P 115grain JHP, which is 91% effective in achieving a one shot stop. (For comparison, the top load for the .45 ACP is the Federal 230 grain Hydra-Shok, which is 92% effective.) The 115 grain +P loads from Federal, Remington, and Winchester are all close, averaging about 89% one shot stops. The effectiveness of the 9x19 goes down as the bullet weight increases and velocity decreases. The best 124 grain JHP loads average about 81-84% one shot stops, and the best 147 grain JHP load delivers about 76% one shot stops." -
I'm more amazed that a parole officer would even ask with the expectation it was a possibility! What a great system with great people beaurocracy is.

No, it makes perfect sense. I think soldiers should be collecting evidence for prosecution and detaining prisoners with miranda and making sure there aren't any abuses of said captives all the while being shot at in a active war zone. It will also be great when those soldiers have to return to the states to testify against their prisoners.
