  4. You're over thinking it. Those aren't state signs in National Parks. You'll also see no carry signs in state parks (which ARE state signs), but with HCP you can ignore them, since they are made void by state statute. The only no carry signs with any weight to otherwise legal carrier in National Parks are those on federal buildings, and apparently in some buildings that are run by a federal contractor within federal park land (like Mt. Leconte Lodge) and seem to be treated as "federal buildings". - OS

  8. Interesting, in that I see this statute has been revised, although I can't read the "compiler's notes" as suggested in the public version. I thought there was indeed a more general description for the alcohol part, but seems it is indeed now rigid that the prosecution must prove .08. Period. Correct, no definition of "carrying under the influence". Good points, and I'd wager you're correct about falling back onto .08 for setting case law precedent. - OS
  9. Note that many have stated in the past that a duplicate ordered after the fact is given about same priority as a HCP renewal, which can take much longer than an initial HCP app. - OS

  11. Of course it's true, you need only read the statutes and compare. A non-HCP holder cannot be charged with carrying past a sign either. So whatever other charges he may face, that saves him $500 right off the bat. AND, he can still get an HCP, where the statutes also say that an HCP holder who carries past a sign has his suspended or revoked. Another case of idiotic disparity in punishment. The good guys have more to lose than the bad guys. - OS

    You've been EDC that gun, but had never shot it, or just not shot +p through it? +p in is generally considered to be optimum for self-defense in .38sp, as it is in 9mm also. - OS
  13. Umm, that IS the law currently. I certainly am not arguing that anyone logically SHOULD drink and carry, but the statute simply does not say that -- the two drinking situations in question are quite distinct, one gives zero leeway for consumption and the other is left to LEO/court discretion. This is just one of the many dumb ass inconsistencies in TCA weapons code. A dead drunk non-HCP holder can be convicted for illegal possession of a weapon AND possession while intoxicated, and still get an HCP; while an HCP holder can have one sip of a drink in a bar and be fined/jailed AND lose his permit. - OS
  14. Just because many folks can carry in National Parks now doesn't mean they are allowed to shoot in them, not even for target practice. - OS
  15. Well, I have too, come to think of it. Maybe I was remembering the times I added alcohol and cannabis to the mixture. My point really was, though, that there's no real established level for most other drugs as to when you are "high". So barring a prescription, you could be charged with intoxication if they did a blood test and found about any level of opiate, xanax, cannabis, other stuff. - OS
  16. The answer to your question is that it is totally up to the LEO whether you get charged for carrying while intoxicated. There is no test required for arrest, or conviction. You might get field sobriety test, you might not. If you ask, you might get a BAC test, but according to LEOs here, probably not. The obvious advice is of course to not have your heater on you driving with alcohol in your system/on your breath (unload it, separate ammo same way non permitted person must). Then you're only risking DUI, which is generally a little more straightforward, proof-wise. - OS
  17. Dunno, I've got old bottles of Oxycodone and Hydrocodone, both say one or TWO every four hours. After 4 of them at about hour 5, I probably shouldn't be doing much of anything that's very serious at all. - OS
  18. What's a "nerve pill"? Xanax, anti-depressant, Thorazine, morphine? First, a controlled substance is one listed in the five classification schedules of the Federal Controlled Substance Act. Second, isn't having a prescription for even one that is listed there at least an arguable exception to "intoxication"? - OS

  20. With an HCP you can carry your gun everywhere, with possible exception of Corps of Engineers and TVA lands, which remain gray. - OS

The driving part is what nixes it, though. Not wise to get stopped for something and smell like alcohol period, and/or be packing too. - OS
  24. I believe that everything got finally legislated so that you may carry a handgun with HCP during any type hunting situation now on most all TN lands, whether during hunting season or not. This didn't change any of the laws about actually HUNTING with a handgun, though, so barrel size/caliber/whatever are still in place for that. Someone correct me if that's not correct, but I believe it is. The gray areas are still perhaps Army Corps of Engineers and TVA lands, but not sure if there are hunts on them? Unfortunately, those statues are scattered around in the section 70 area of TCA, I believe, so I can't point to them exactly. - OS
