None of those folks mentioned would need a warrant to enter your business and carry out their jobs (maybe the ICE agent but I doubt it, certainly not the others). Obviously, they would need one to enter your home. That's why a biz open to the public simply just does not have the same sanctity as your personal real property. Just like city or country fire marshal doesn't need warrant to check your biz. But he doesn't come out and insist on checking your home at all. Why? Because there's a big diff in safety codes, seating capacities, etc for biz open to public than your home, ie a matter of perceived public liability. Simply put, there are dozens of restrictions on a biz open to the public that aren't placed on your home and lands. Also, about the third protected class "private entity" you kick out of your biz,, maybe even the first, is gonna get you discrimination scrutiny, whether you mention the reason or not. It just will; there's money to be made. Even if you win, you lose some money, if you lose you lose a lot of money. Punitive damages are rather cut and dried in discrimination cases, it's a mucho PC country now. My main point: that you simply can't claim you can manifest all the same behaviors at a biz as at your home. Some things, maybe, many things, absolutely not. And the business regs/laws stay in flux; and you know what, they never get more lenient. Good Lord P, was not my intention at all; the lady doth protest too much methinks , just trying to make some points without being boring. Seriously, you really surprised me with that, but since you took it that way, certainly here's my apology..

Definition of unloaded, says no loaded mags anywhere, no mags period in vicinity of guns. To my knowledge, this is never enforced, but it is in the statute as part of the defense of unlawful carry due to unloaded firearm. - OS

I hear that from time to time. Why do you think so? The law does not say it ONLY applies to those with HCP, only mentions them to make it clear that it does indeed apply to them also. A person without HCP is guilty of illegal carry possession and carrying past a sign. Would be one Class A (with fine and/or time), and one Class B misdemeanor (with fine only), assuming LEA wants to press it to max. - OS

Hmm, let's see. How bout a biz starts asking all blacks and folks in wheelchairs to leave. How much money do you think a little class action suit would net? How 'bout telling that county food inspector he has to leave your restaurant. How's that gonna work out for ya? How 'bout telling BATF to get off your property when they come by to do a spot audit on your FFL? Right. Maybe the ABC guys if you run a liquor store, or County Beer Board guy comes by to check on things? Scram? I doan theeng so Lucy! How about you tell the ICE guy to get off your place when he drops by to ask about an employee or two? Umm hmmmm. There are LOTS of encroachments on your public business private property that you don't have on your personal real property at home. - OS

Let's please please please don't get into this specious argument again. It's just not true. There is most certainly a big difference in how city, county, state, and federal laws affect businesses open to the public compared to true private real property. You just can't equate the two types of "private property", not by a long shot. - OS

Well, I gave ya mine. As long as the statute is in effect -- but my further opinion is that 39-17-1359 should be struck down in its entirety. One should not acquire a misdemeanor record and $500 fine for any behavior which is legal on one side of a public business' door but immediately illegal on the other, just as it is not a criminal act for violating a "no shirt, no shoes" or "no pets" sign. The trespassing option after verbal notice is ample, and apparently works fine, and constitutionally so, in the other 45 or so states which have no criminal penalty for merely carrying past a no-guns sign. - OS

Sorry, have to mention the law, as I consider "proper" synonymous with "statutorily compliant". Management feels strongly enough about the issue to have me charged with Class B misdemeanor, seems to me the least management could do is also obey the law. The short example sentence in the statute and/or a gunbuster sign is too complicated? - OS

Nifty. Don't know how much that one is, but I've carried the $20 Boker Credit Card Knife in wallet for maybe a couple of years now. Nifty little item, sharp as bejesus. Take the clip off and it fits in credit card slot. Slicer not a stabber though. -
Yeah, class A, that's why I asked about bond for DUI, which is also class A. Ironically, or not, it's also a Class A to have one sip while packing if you're in place open to public. But not against the law at all to drink and pack elsewhere, unless you then become "under the influence". - OS

Status as a courtroom alone doesn't matter. And it only applies to that room, not the larger building that houses it. "...any room in which judicial proceedings are in progress" is the wording. - OS

Maybe. SCOTUS opened the door for states to basically reject any expansion of Medicaid roles without losing existing funding. Lack of that expansion, as I understand it, would prevent the "exchanges" being set up, allowing that state in effect to just opt of the whole mess. That's what Florida gov has already vowed to do. And with 26 states in the original lawsuits, surely they will not be alone. This even before the promised "whole state exemptions" promised to be offered by Mitt immediately if he wins. And again, the last thing a pol ever wants is to hang his name on a new tax, so that may over time be the most effective way to limit government overreach, since the commerce clause whipping boy is gonna be tougher to claim. - OS -
Fareed Zakaria on CNN has done a special that looks at healthcare around the world. Unless the data is flat out falsified, Taiwan looks like they may have done it as well as anyone; and they implemented the major changes in less than a year, Switzerland's system looked pretty good too. - OS

Hard to believe that with a new miracle non-drowsy antihistamine appearing every few years, that y'all can't find something besides Sudafed that is effective. I have quite severe ragweed allergy from Labor Day till first frost, and for quite a few years now generic Loratadine has done very nicely (Claritin). And there were a couple of previous ones that worked pretty well too. There are others too, most all have been around long enough for the generic equivalent to be out, too. - OS

Besh wedge design itself is total junk, marketing hype. You can barely cut butter with them or stab though cardboard with effort. All just to claim a strong tip. Believe me, you'll be quite disappointed. I've held the various Spikes but they don't fit my hand worth a hoot, too narrow, really haven't had much interest, and I'm rather a CS fan. I'm sure they're lethal enough if placed correctly, but seems pretty limited overall use. - OS

Maybe check out the Mini-Tac Kiridashi too. Though the Skinner is perhaps better all around utility blade and pretty formidable as defense, the Kiridashi is my backup second choice for defensive necker these days. Be aware, in both the double edge and single edge Meyerco Necklances, the blade is not embedded in handle very far. Probably not a concern for anything but really hard use. Or, gulp, bone. - OS
