A concealed unloaded handgun is not a defense to unlawful carry under 39-13-1308. Then again, maybe it wasn't concealed. Obviously, not concealed well enough anyway. Metal detector? Who knows. But if this is true from the story: "The gun wasn't loaded, but officers did find four rounds in her purse", and both the purse containing the ammo and the gun were on her person, the second part of the 39-13-1308 defense is also negated. The defense is "...an unloaded rifle, shotgun or handgun not concealed on or about the person and the ammunition for the weapon was not in the immediate vicinity of the person or weapon" I agree though, that dumb asses with no criminal intent should not necessarily be convicted if they did no harm, the "ignorance of the law is no excuse" principle notwithstanding -- that would be in keeping with the spirit of justice as opposed to letter of the law. - OS -

"Title 39 Criminal Offenses Chapter 17 Offenses Against Public Health, Safety and Welfare Part 13 Weapons Tenn. Code Ann. § 39-17-1309 (2012) 39-17-1309. Carrying weapons on school property. (d) (1) Each chief administrator of a public or private school shall display in prominent locations about the school a sign, at least six inches (6'') high and fourteen inches (14'') wide, stating: FELONY. STATE LAW PRESCRIBES A MAXIMUM PENALTY OF SIX (6) YEARS IMPRISONMENT AND A FINE NOT TO EXCEED THREE THOUSAND DOLLARS ($3,000) FOR CARRYING WEAPONS ON SCHOOL PROPERTY. Is that the one in Guam or Knoxville? I walk by the one here at least once a month, almost always stop a minute and gaze again. edit: I'm thinking Guam, as ours is built up on higher pedestal, now that I look at it a bit closer. I dare say the majority voting for him feel that way. It speaks volumes about Mitt that BHO is the most vulnerable incumbent since Carter, yet that it's even in the ballpark close. And I still think Hussein will squeak it out. The media is electing the prez this time instead of SCOTUS. I predict 274/264 electoral college. - OS

While no firearm that actually throws a bullet without harming the shooter is "useless", I sold the only one I had that most nearly qualified, a .38 special derringer: Hard to cock (almost impossible with one hand), slow to deploy since safety on is a good idea, very heavy for its size, 50 lb trigger pull, can potentially fire while loading if not placed on half cock first, extremely limited accurate range, etc. Other than that, was a fine firearm, and always went boom. - OS

I much prefer the 20 rounders for both AR and Mini14. Better balance, clearance, lighter weight, etc. But of course I keep 30s for both also .. you know, for those daily firefights I'll be involved with after TEOTWAWKI. - OS

Yep, called "conditional proceed". "What is a Conditional Proceed? If during the background check TICS locates a record with outstanding disqualifying charges or charges that are undeterminable as disqualifying, TICS will deny the transaction. Upon an appeal of the denial, TICS will attempt to find disposition information on the charges in order to make a determination of eligibility to purchase a firearm. If TICS cannot obtain the information within the mandatory 15 day limit, the transaction will be marked as a Conditional Proceed. This means that the firearm dealer may lawfully, at his/her discretion, complete the transfer, although it in no way means that the dealer must complete the transfer. Should the dealer choose not to complete the transfer, your only appeal is to the FBI's NICS Appeals Services Unit. You may contact them at (877) 324-6427." - OS

Yeah, was gonna mention load the first one from slide lock, at least for a while, as manual says. Make sure rounds are seated well in mag with first one pointed up. Smack back of mag against hand. You probably have. What's the round? Do all type rounds do it, both FMJ and hollowpoints? Have you shot a hundred or so through it yet? Kahr wants you to do 200 before they'll concede you might have a prob. Run it good and wet for a while, too. The only failure to chamber I've ever had is when changing mags in a hurry where the top round has jiggled forward when mag was in pocket, knew it was that because I could repeat it by putting top round in non fully seated position in mag. Oh, and no chance you've reversed outer recoil spring, right? - OS

There's the problem. That Handgun Got Confiscated document stuck out like sore thumb. Seriously, folks post this all the time here, so it obviously happens a lot, and sounds like a real glitch in the system if a bunch from the same gun store were denied in same day. I always ask though, did you use your SSN on the 4473? - OS

Yep, that is probably the true the crux of the question. Since all the kits being sold are to convert pistols into rifles. And according to the quotes I've cited, back to a pistol. I'll have to find an old newspaper. edit: I'll wait till I hear from your inquiry -- and assuming they say it's a go, ask also: - can it go back and forth if it were a rifle first, and - about buffer tube too, whether it has to be incapable of holding stock while in pistol config or whether standard rifle buffer can be left on it, just without stock - OS

It is late for you, I quoted exactly the same above; it is from the opinion I linked. There are several Glock/Carbine kits being sold now with 16" barrels. No mention of them having to stay carbines forever either. This would tend to support that this is a new interpretation also. http://mechtechsys.com/glock.php Another quote from the first of the BATF doc certainly covers all "kit" conversions. "A firearm, as defined by 26 U.S.C. 5845(a)(3) and (a)(4), is not made when parts within a kit that were originally designed to be configured as both a pistol and a rifle are assembled or re-assembled in a configuration not regulated under the NFA (e.g., as a pistol, or a rifle with a barrel or barrels of 16 inches or more in length)." This would seem to cover all commercially sold kits to make a pistol into a rifle and back. And as far doing it yourself, with your own "kit": "A firearm, as defined by 26 U.S.C. 5845(a)(3) and (a)(4), is not made when a pistol is attached to a part or parts designed to convert the pistol into a rifle with a barrel or barrels of 16 inches or more in length, and the parts are later unassembled in a configuration not regulated under the NFA (e.g., as a pistol)." This directly says a pistol can go to legal rifle length and back to a pistol, seems to moi. - OS

Ah okay, I get it. And that does see to jibe with the opinion in the BATF doc I posted. I understand everyone says that because it has indeed been interpreted that way by BATF (the only opinion that counts) for a very long time, but my point is that it seems to have changed as per the opinion I posted, which is dated July of last year. As far as individual firearms, I can find no hint of an opinion mentioning any specific one except the Thompson Contender, and some mention or other of antique ones like the old Buntline specials and old Lugers and whatnot. Actually, I won't get to talk to local agent until Monday. - OS

Yep. And most kids had their dogs running around with them in the neighborhood. I certainly did. In the small country burb I spent most of my growing up in, all the "normal" dogs ran loose, everybody got to know who's were whose. If there was a problem dog, that's when something happened, like it being fenced in or taken away. - OS
