The fact that in Obama's progressive society, some can make $80K without working, hence afford the Prius, and get a free phone to boot? And that's without necessarily even going on disability, of which there's been an unprecedented increase since he took office. I guess somehow the collective workplace has become unprecedentedly more dangerous since '08 some how or other. - OS -

So I haven't kept up the nuances in the law. Existing mags are grandfathered? Assuming yes, what's the burden of proof as to when they were purchased? Heck, what was the burden of proof on stuff for manufacturers or resells during the '94 AWB? - OS -

No, there is nothing illegal about buying a firearm you don't intend to keep. Maybe you like to shoot different types, and know you'll sell most of them off over time. Perfectly legal. Maybe you're buying it for a gift for a non-prohibited person. Also legal. There are other intents that are illegal however, like buying for a prohibited person -- that's a true "straw purchase". Also buying for "the business" of firearm sales, without a license. The intent is not really prosecutable however, until we have Minority Report type mind probing, but the subsequent acts are. - OS -

So: - no, "no weapons permitted beyond this point" is not statutorily compliant, regardless of where it's posted - but 1359 does not say you can't be prosecuted if it isn't - we can't find a clear cut incidence of a state resident being prosecuted under 1359 at all, for any kind of sign - OS

Yeah, I've wondered about that little part of the 4473 instructions. A TN FFL can sell a long gun to someone of most any state -- I said "most" because it's "any" for federal law, but some states don't allow their residents to do that, and don't know how FFL's around the country keep up with that, or even if they do. BUT, I don't think you'll find a TN FFL that will sell a handgun except to one who has a TN driver's license or other valid TN id. 'Cause you can't take possession of a handgun except in your actual state of residence by federal law. And as far as your doing personal sales in TN, well ... no legal opinion, but sound pert iffy to me at best should push come to shove. - OS

These aren't state laws, they are federal. You can sell a long gun through FFL either in your state or through state of the buyer. However, a hand gun sold to a different state resident may only be transferred through FFL in the buyer's state. Of course, in MS you can sell a long gun or handgun to a MS resident without going through FFL at all, assuming you have no reason to believe they are barred from firearm possession. Not real sure what exactly you're driving at here. I don't think that TN recognizes any kind of "dual residency" for firearms stuff, except for military stationing of those with a different state of record. - OS

What's the actual sign say, I can only read "warning" since it's so small on the frame? As for as "legit", there's nothing in 39-17-1359 that exempts you from prosecution just because a store's sign is not complaint to the statute. No test case yet as far as we know, either. - OS
