He'll get it in same way Romney did, but easier. Paul and Cruz will shake out like Paul Sr., Bachmann, Santorum, and Perry. Matter of fact, only guy to beat Rubio might be Christie, but I still think there's outside change he'll run as independent, with the goal being Hillary's veep. Really. Only thing certain is that the US electorate will not go with a true conservative, no way, no how, unless something very BIG and very BAD happens first. - OS

I myself don't get all the Probable Cause arguments. Forget the body armor for a moment and just consider the appearance of a firearm alone. It's illegal to have a loaded gun on your person in this state. If you have an HCP, you have a defense to carry a loaded handgun. If a LEO sees the handgun, he can ask you to see the permit. If you don't have one, seems he would also have PC to check and see if the gun is loaded, to see whether he should charge you. There is no such defense for a loaded long gun on your person, so when a LEO sees one, or what likely appears to be one, how does he not have the same Probable Cause to inspect it? I don't see where a case, regardless of how it is shaped, figures into it at all. Indeed, the TN statute only gives an out for "an unloaded rifle, shotgun or handgun not concealed on or about the person and the ammunition for the weapon was not in the immediate vicinity of the person or weapon". Indeed, having it in a case that visually and logically implies that it contains a long gun might be interpreted as "concealed"? Or perhaps a case that does not imply "long gun" is "concealed" (but would be problematic for Probable Cause). Point is, though, by what interpretation of 39-17-1307 and 1308 did the LEO not have the full authority to check out the firearm, especially since the case itself screamed AR-15? I suppose a locked case presents another particular set of legal parameters, but in this case it was not locked (and I don't believe gaffer tape could possibly be construed to be so). And "locking" the firearm itself, well, dunno about that, but here they did not defeat that lock anyway. So certainly seems there was every reason to legally detain him until they could look in that chamber. The fact they arrested him for the can seems to be the only problematic part to me, especially if indeed the paperwork was right there in the case plainly visible, whether Lenny ever drew their attention to it or not. - OS

Nope. The bang of hunger, poverty, and insecurity will have to hit a tipping point within whatever the middle class has come to be defined before Big Brother can be whacked at the knees. Might not take a cataclysmic event though, as we're already teetering on about a 50/50 split between earners and takers. Hell, half the earners are takers too -- the working poor may become the turning point, dunno. - OS

I disagree. If I had to bet, I'd pick Rubio as GOP nominee. While Paul and Cruz may do well in some primaries, no way either will get the nomination, and should I be wrong about that, I fell comfy predicting that either would lose the general election resoundingly, maybe not as bad as Goldwater way back when, but wouldn't even be close. Paul and Cruz may well become lifelong career pols on the Hill, but that brand of conservatism will never again be in real presidential contention unless/until the Big Pain hits to sway folks back the basics of the Republic. The only reason we see such strong GOP representation on the state levels currently is because the party has done a much better job of gerrymandering than the Dems over the last 10-15 years. - OS

The picture with the cable lock is from Lenny's website, it is not how the rifle was secured on his walk. - OS

Note there is no longer a way to ship handguns between non licensed persons, assuming you follow the law in the case of USPS and the respective TOS of FedEx and UPS. - OS

Brief history, mostly accurate I believe: - Never been arrested before - Apparently lost his HCP back in '08 for a while due to Order of Protection taken out against him, OOP was later dismissed, HCP returned. - Had his HCP revoked (or suspended, don't remember which term TNDOS used) after the Belle Meade Navy Pistol Incident, then did not show for the appeal hearing - Lost suit against Radnor Lake LEO, and the appeal - Lost suit against State of TN regarding constitutionality of the HCP (can't remember if it also went to appeal)... - Received an 01 FFL and class 3 SOT - Now this - OS

That's often said, but really not fair in this case. The only way he could vote against it was to allow it to come to a vote, and the GOP decided it was better to actually defeat the thing than prevent it coming to the floor at all. And they knew they had enough Dem votes to do it even with four GOP defectors, or they wouldn't have. Though most here absolutely skewered all of them for doing it. - OS

No. He was simply one of the numerous GOP senators who voted to end filibuster and take up the Manchin-Toomey Background Check Bill back in April, the actual passage of which both he and Lamar voted nay. - OS

Petition against funding obamacare
Oh Shoot replied to kieefer's topic in 2A Legislation and Politics
ObamaCare is already 90% funded by the law itself, and this whole push won't succeed to deny the rest. The only thing that will change it is when it is shown as a total failure, then it will be changed in Congress. If Dems control both houses, it will become the one payer plan, 100% government healthcare, which is what most of them wanted from the gitgo. - OS -

Well, there's no penalty in the statute for not doing the job, just like in most all gummit bureaucracy. What damages would you sue for? Maybe if you got shot on the 91st day and you still didn't have your permit .... - OS

Nope. Matter of fact, they don't "have" to do new ones in 90 days. Lisa told me personally that no permit would be issued before all checks were in, regardless of what the statute says. Yep. - OS

Another show about finding nothing, with what appears to be a bunch of inbred obese idiots. Bound to be a hit. The only one of these type shows that's any good is River Monsters, as at least the guy does catch something or other most of the time. :) - OS
