  1.   The fed has no control over the states' drivers licenses. At least yet. The penalty total isn't even in the ballpark of being correct. It's bunk.   However, the tax lien would likely eventually happen, as the only control on the penalty is through the IRS, and it already does that on possessions.   - OS
  2.   Think. The driver's license part alone proves that to be bunk. Also, first year penalty is $95 or 1% of income, which on $50K is 500 clams.   - OS

  8.   Yeah, I use my domain email for "serious" stuff, a couple of Comcast ones and a Gmail for everything else, and even an old Netscape one that's still valid with the dialup account I still keep, all with POPs set in Pegasus. I actually don't leave anything on the various servers. All available via webmail too, of course, if I'm somewhere and need to.   I've got around .5 gig of saved emails that go back to the early 90's pre web days, for no particularly good reason, nostalgia mostly I reckon. With Peggy you can just copy the whole shebang over into any new installation on a different box.   - OS

  10.   edit: took time to read more of the doc, and TN statute.   So, looks like domestic assault in TN is anything that fits an assault statute, with the "domestic" variable also met.   Skimmed the article and get the gist of the two sides -- federal definition of domestic violence 'meanor for purposes of gun ownership defines it as "use or attempted use of physical force", both of which are overt acts, but you don't have to commit an overt act to be convicted of it as per TCA.   Sticky wicket all right. My layman's opinion on decision : too close to call. :)   Main prob is not for those who obviously have committed physical violence but those who get convicted for merely inspiring the fear of it, a highly subjective call, just like a lot of orders of protection too, seems. But both wind up with same conviction, with same firearms ownership ban imposed.   - OS

  12. Don't have to touch anyone at all for simple assault (fear factor is enough) or aggravated assault (just implied threat of showing a gun is enough), right?   What is the domestic assault number? Does it actually require physical contact at all, unlike the others?   - OS
  13.   It won't be about that, looks like, but more regarding whether TN's version of domestic violence law is valid, or I guess "constitutional".   Don't see why it wouldn't be though. You don't have to actually even touch someone to be convicted of various other types of assault in TN, and I suppose it's that way in various other states too.   - OS
  14. It's illegal to be engaged in the business of selling firearms without a FFL. There is no specific number of firearm sales that determines that.   From 18 USC § 921:   "The term “engaged in the business” means— ... as applied to a dealer in firearms, as defined in section 921 (a)(11)(A), a person who devotes time, attention, and labor to dealing in firearms as a regular course of trade or business with the principal objective of livelihood and profit through the repetitive purchase and resale of firearms, but such term shall not include a person who makes occasional sales, exchanges, or purchases of firearms for the enhancement of a personal collection or for a hobby, or who sells all or part of his personal collection of firearms ...... The term “with the principal objective of livelihood and profit” means that the intent underlying the sale or disposition of firearms is predominantly one of obtaining livelihood and pecuniary gain, as opposed to other intents, such as improving or liquidating a personal firearms collection." ----------------   Don't come under ATF's radar and all should be cool. But if you do, guess who makes the determination?   For Gawd's sake don't sell personally to out of state resident by mail or in person, or even to a TN resident if you're not in TN at the time -- check TN DL even though not "technically" required. That buyer might not be just a buyer, ya know?   - OS

  16.   Carson was on O'Reilley last night. Bill recounted how a number of years ago he was audited three years in a row, all clean of course.   He had his mouthpiece file a letter with them threatening lawsuit if the fourth one happened, and it still hasn't.   - OS

  20. Heard some official's statement today that the shutdown is costing $30million dollars a day extra.   Only the corrupt US government can spend more money by shutting down than by "normal" operation.   - OS
  21.   Unlike for normal citizens   - their police arrive instantly - they the have the best insurance for the least money - they get paid a great salary for 1/3 time work (239 vacation days in 2013) - automatic salary increases yearly - they get a great retirement package after only one day in office - many other perks, to many to list   They are America's French bourgeoisie, the elite privileged class.   - OS
  22.   Latest:   Woman driving nuts around capitol in black Infiniti.   They forced her stop once at gunpoint, but she took off again, finally shot her (multiple shots fired).   One officer hurt somehow or another likely by her car itself, or fell or something. One police car damaged running into car or barrier or something.   Got her out of car alive, she later died.   No indication she shot a gun or even had a gun.   Both Houses gave standing ovation for the Capitol Police.   Maybe mostly correct, maybe not.   - OS
  23.   There's nothing illegal about selling or buying a short barrel.   Possessing it though, the ruling on "constructive possession" since SCOTUS ruling in 1992 is that:   "... an NFA firearm is made if aggregated parts are in close proximity such that they ... serve no useful purpose other than to make an NFA firearm ..."   Translation: if you have a legal use for a group of parts, assembled or unassembled, it's okay even there were an illegal use also.   Example: you have a complete AR rifle and a short barrel only -- technically illegal, as the barrel could only be used illegally by recombine the parts. Example: you have a complete AR rifle and a virgin lower and a short barrel -- fine, because you could recombine the parts to make a legal pistol.   If you have no AR stuff, owning just a short barrel is fine, as there's nothing illegal you can make. Actually, you can then own any groupings of parts even if you don't have all of them to complete the pistol, since there is still no way to make an illegal firearm.   Note: Stocks and vertical forward grips are the bugaboos in all this AR pistol stuff -- if all you own is an AR pistol or parts to make one,  I would not own a stock at all, as the only possible "useful purpose" for it would be to make an NFA firearm, whether you use a buffer tube that will accept it or not. Same with a vertical forward grip, unless the pistol is 26" or more in legal over all length. "Close proximity" is not defined, and thus I consider my entire property to be "close enough", push come to shove.   Obviously, very unlikely to get in trouble for any of that type stuff unless you came under ATF radar for something else, but no since taking the least chance since the penalties are so high.   - OS
