  3.   No, federal law does not say that at all, Dave.   Federally, in both cases to be unlawful, the seller must  "know or have reasonable cause to believe" that such is the case. Otherwise, it is not unlawful, simple as that, as the statutes are precisely worded. I don't know of any seller in his own state who was stung for that unless he saw the buyer's out of state ID or was told by the buyer he was from out of state, and sold anyway -- never have seen any mention of a precedent where simply not asking to see ID was grounds enough alone for a conviction.   AFAIK, TN law doesn't address the issue of private interstate transfer at all, not sure regarding proof of culpability for intrastate transfer to a minor.   - OS

And proving it is pretty cut and dried when folks mail a firearm, as each party knows they are dealing with out of state resident.   As far as face to face, whichever buyer or seller is in a different state than his own is the most clearly culpable. The only gray is for a seller in his own state, as he must "know or have reasonable cause to believe" that the buyer doesn't reside in same state, but actual documentation is not specifically required (though I think a seller is quite unwise not to check).   - OS
  7.   I just don't see the legal argument behind this. Statute is pretty clear that TN permits are for TN residents and residents of other states regularly employed in TN for over 6 months.   New residents' other state permits are only good for 6 months after residency is established, so it seems pretty far fetched to claim that you as a long term resident could carry on a newly acquired out of state permit. Even stretching such a concept to it's max under any nuances of the TCA wording, certainly you'd only be allowed to do so for six months after obtaining the FL permit anyway.   If you haven't been able to work anything out by then, after the first of the year, I will pledge to dedicate a day to drive over from Knoxville and get you to the class and back, and if we can't get to the DMV/fingerprint center on same day, will stay over or come back to do it the next day if you need that also.   - OS
  8.   Bzzzzt.   Private sale of any firearm between residents of different states is a felony under federal law, regardless of where it takes place.    The only difference in long gun and handgun is that 4473 must be done in the state of the recipient in the case of the handgun, while long guns may be transferred by an FFL in any state.   - OS

  10.   JM barrels still put on most rifles made in MA after Remington bought them, and apparently are still JM on some guns even after Marlin left the MA plant with North Haven still on the barrels that were left over. Also, there seem to be barrels that were actually made in Ilion that had North Haven on them before they left that plant.   Just depends on how purist you want to be about the "Remlin" or "Marlington" thing. Only way to know for sure to get a "pure" Marlin seems to be by getting one from pre 12/2007 when Remington bought them.  'Course, saying Mayfield, KY or Ilion, NY on them erases all doubt for the new ones. :)   And btw, most of the "remlin" proofs are "REP" or "RP", though I have a transition Model 60 that shows North Haven, but with RE marking.   Also also, have read several places that sometime in 2012, the new barreled rifles have switched to the Remington date codes rather than the Marlin system.   - OS

  15.   Nothing in federal law prohibits states/municipalities from enacting most any kind of stricter ones. Perhaps you haven't noticed that most all have? ;)   Of course, I suppose the ATF could try to class a "non metal barreled" firearm as a Destructive Device, in which case you'd have to have a tax stamp to legally possess one.   - OS
  16.   Depends on what the transfer is. At 9.25% tax, a $25 transfer is cheaper beginning at $275 gun price.   - OS

  18.   Don't have the Pro but AVG free updates defs every day, and if you happen to check more often than auto, often more than once per 24 hours.   It, a router, and modicum of caution have served me well for a good number of years now.   - OS
  19.   A pistol buffer is no ultimate defense from anything.   The test is simple: ".. an NFA firearm is made if aggregated parts are in close proximity such that they:  (a) serve no useful purpose other than to make an NFA firearm (e.g., a receiver, an attachable shoulder stock, and a short barrel); or ( b ) convert complete weapon into an NFA firearm (e.g., a pistol and attachable shoulder stock, or a long-barreled rifle and attachable short barrel)"   There is no definition of "attachable" and no definition for "close proximity". If I only had an AR pistol, and no AR rifle or 16" AR barrel,  I would not have an AR stock anywhere on my property, regardless of buffer type. Or a vertical forward grip is the pistol is not a legal 26" overall length.   Gaffer tape will attach a stock, and I consider any where on my property as "close enough", if the axe they decide to grind is for you.   Simpler than it sounds:   Full auto or can aside, look at a part or component: - Is there an illegal config I could use this with? - If no, cool. - if yes, then - is there also a legal config I could use this with? - if yes, cool - if no, don't have it   - OS
