  1.   Read all sections related to alcohol. Question stands. By what authority does TICS use "the same standards for determining addiction to alcohol as are used for dangerous drugs/controlled substances"? Since the federal government or the state does NOT use those standards for alcohol.   Why is TICS able to set standards for alcohol that aren't enacted by federal or state law?   Hell, the military "standard" would seem to be a lifetime ban.   - OS
  2.   And by what legal authority does TICS make that ruling?     And where is this from, btw? (It ain't from USC 19, 122) nor can I find from the referenced statute therein, 21 USC 802.   I'll assume it's "somewhere" in federal code, so TICS is going to take federal law about non-alcohol related controlled substances and just decide to apply them willynilly to alcohol, too, eh? How positively clever of them, I must say.   - OS
  3. Been some pretty disparaging  "press" regarding them lately on arfcom about how barrels are installed, and especially how they are "fixed" after coming loose. And the hassle with getting them to respond to the problem in the first place.   - OS
  4.   Don't see where bureaucratic control of a building determines its status one way or the other, 1311 simply says ".. or other building facility, area or property owned, used or operated by any municipal, county or state government, or instrumentality thereof, for recreational purposes."   But doesn't matter. Is to be posted under either statute and indeed under 1311 there has to be a formal resolution record by city/county/state that it opted out of the carry freedom. Also, the signage is more strict for 1311 (though again who knows if "non-statutory" signage avoids prosecution/conviction). Also, the penalty for violation is greater under 1311.   But either way, if it ain't posted at all, certainly no legal leg to stand on under either 1311 or 1359 to ban carry.   - OS
  5.   There is also no legal basis in TN law for such an action. That's the point.   It's exactly the same crap as the HHS or ATF, making on-the-fly "rulings" regarding ObamaCare and firearm rights, but at least those powers are delegated by the original statutes. I know of no such interpretative power granted to the TBI to do so in this case.   Perhaps next they'll stake out AA meetings and cross reference people with HCPs. After all, attending an AA meeting means you're probably an addict right? Even if one hasn't had a drink in 20 years, he could still be deemed as being "addicted to alcohol". Maybe they should stake out your local liquor store, if you show up there more than X times a month, tag you as "addicted". Whatever.   If you're all for granting them the first power, you'd be in favor of granting them the others, seems to me.   - OS
  6. Well, if indeed it doesn't legally fall under 1311, anything can be posted under 1359.      Although what constitutes a "legal" post still has no case law, I agree with you if it's not posted at all.   - OS
  7.   What in TCA are you referencing period? The posting statute itself or parks/recreational facilities statute? Seems it could clearly be posted under either one?   - OS
  8.   If TN wants to enact a law that says you can't buy a firearm for a year after a DUI, or can't buy one while serving a sentence for it, or whatever, that's one thing, but such is not the case. But if TBI is going to make an arbitrary rule that you are deemed to be an addict after a DUI conviction, that is quite another.   Perhaps it's okay with you that they deem you a mental defective because you once saw a psychologist regarding some personal problems, or had a script for an antidepressant, and could never own guns again?   This is a proverbial slippery slope, and enters into the area of civil rights.   - OS

  11.   Well, I can understand, since it's not apparently a matter of law, but of a TICS "policy" that apparently nobody has ever heard of before, at least on TGO.   Matter of fact, if the reason proves to be accurate,  OP should challenge it in court, since he should easily be able to do it for just the low cost of the filing fee. If they can do this, they can also rule that you're a psychotic because you're got script for antidepressants, who knows what else for c'sakes.   - OS
  12.   He says he is an attorney. And no, I know of no federal or state sanction against buying or owning firearms for being on probation for a conviction, unless it were a disqualifying conviction, which DUI is not.   If properly reported, any Class A misdemeanor causes your HCP to be suspended for duration of sentence, which would include any probation as far as I know, which is the full 11/29 for a first conviction of DUI.  However, this should not affect your ability to buy or own firearms.   What I don't understand --   1.  is the restricted DL what you presented as ID to the FFL? And is it the same number as your previous full status one? 2.  did you appeal the denial?   Assuming you appealed, you should get feedback in whatever time span it is, 15 working days or so I think. Or it might be overturned without having to do anything.   - OS   edit: just reread eRay's post, glossed over that in a hurry,  sorry.  Bit hard to believe they are contending that, but if true I suppose that is the answer, though this must be new. Thing is, if they are going to maintain that view, means you technically can't legally even own the guns one already does under federal law, as 39-17-1307 says state is supposed to enforce that also,  eh?   Also, there is additional irony, as you could probably go to any other state that only uses NICS, and purchase a long gun from FFL.
