Well, the property that 1311 affects is: "... any public park, playground, civic center or other building facility, area or property owned, used or operated by any municipal, county or state government, or instrumentality thereof, for recreational purposes." I suppose it will be determined by contract/lease law to some extent? Meaning, just what rights and "rules" do the feds give up along with the lease of the land? Does it become totally under Clarksville's control as de facto city property during the lease? We ain't seen nuthin' yet about some of the hissy fits this change will foment. Again I mention coliseums, arenas, zoos, discovery/adventure center type facilities, all manner of stuff that is either in a park or is clearly "recreational" in purpose, etc. - OS

State parks have been lawful for carry for years. This change is about all city/county parks. - OS

Just an aside, I just noticed the little English lesson correction in the bill also, surprised I never caught it the many times I read existing statute. Previously from 39-17-1311 "A person possessing unloaded hunting weapons while transversing the grounds..." Amended to: SECTION 5. Tennessee Code Annotated, Section 39-17-1311, is amended by deleting from subdivision ( b )(1)(J)(ii) the word “transversing” and substituting instead the word “traversing”. ---------- i.e., a person could only "transverse" something if his body lies across it. / end pedantry :) - OS

I spend a lot of time on some of the greenways in Knoxville, which of course also go through parks. Even though it's been de facto legal here since the change to preemption statute last year and fact that the city took no action to conform with opting out under the existing 39-17-1311, it's really nice to have that part totally cut and dried, and of course very pleased for all the other folks state wide. Now, let the gray areas of coliseums, arenas, zoos, discovery centers, etc etc start getting hashed out as applied to the revised statute as compared to 1359. - OS

Most bought a Mosin at least partially because of cheap big bore ammo. If minimum .50 per round or higher becomes the norm, all bets on that are off methinks. - OS -
Yeah, TN is not nearly the uber red sanctuary many assume. And though we're certainly a "free state" firearms wise, it's probably not quite worthy of the "Patron State of Shootin' Stuff" moniker either IMHO. Our real immediate problem is that though we have a Republican Super Majority in the legislature, so many are RINOs at best, and unfortunately that includes the Gov and his most powerful minions. I won't even get into our two Senators in DC. - OS

2012 election, Shelby, Hardeman, Haywood (Memphis area) Davidson (Nashville) counties went with BHO. Knox County (Knoxville): 34.4% BHO Hamilton (Chattanooga): 41.5% BHO State wide was: 39%, scarily high, and of course all were even higher in '08. TN went with Slick Willy back when, btw. Twice. No predictions about this Clinton this time, might be pert close, dunno. - OS

There have been bills, one of which almost passed a few years ago, to force nationwide recognition for any state's carry permit, but never heard anything about a "federal carry permit". Both of these I see as a very dangerous thing to happen, btw. For the simple reason that anything the fed get the precedent to be allowed to grant, it is equally allowed to ban. Now, if Congress or (actually better probably, SCOTUS) wants to simply incorporate firearm carry as an individual right, at least forcing all states to be "shall issue" permit issuing based on nothing more restrictive than the federal standards for gun ownership, that's another matter. Even better of course would be no permits at all, but that's a pipe dream currently, and perhaps ever so. The matter of "keeping" firearms has been incorporated, although the battle of what, how, and which hoops one must still jump through to do so will be ongoing. But the "bearing" of them has not. edit: ps, a "pre-welcome" to TN. :) - OS

Yeah, who knows. Various of "they" may be aware, but if so, certainly it's been a "let sleeping dogs lie" policy thus far. Course, hopefully won't matter one way or the other soon. - OS

Good points. There's just soooo many Mosins out there in closets though, and still coming from sources too. I rather think that if ammo gets pricy they'll come back around for sale, and cheaper, about like the recent AR glut. Time will tell. - OS -
Correct, except for any local ordinances enacted before 4/8/1986. Knoxville already had that. City Council discussed having at least some of the parks to be carry legal and whatnot. Haslam wanted things simply left as they were, which was the decision that prevailed. No posting was required under the old ordinance, so nothing changed, no money spent, etc. Knox County went the other way, and having no local ordinance, did not opt out of new state law, allowing carry in county parks. Only bright side was that during those years, the Knoxville penalty was much less for anyone prosecuted than the Class A Misdemeanor you'd face on the state charge. Changes to 39-17-1314 last year took away local options for all but three local firearms laws, including those under the previously grandfathered date, removed that clause entirely. The only local ordinances allowed after that passed regard: - carrying of firearms by employees/contractors - location of firing ranges - discharge of firearms period - OS

Well, technically, they simply did nothing about it here, just continued to rely on existing grandfathered city ordinance. Which went away with the preemption change last year. - OS

I don't think you realize that being middle of the road is probably best these days -- hence Bob and Lamar. I'd think that if the "guns in parks" issue were decided by state wide referendum, it would probably fail. If I had to bet, I'd go with him not signing it, just like the changes to preemption bill last session. That's the best straddle-the-fence strategy to hedge his bet. - OS
