I don't understand what you're trying to say. You can have the gun inside your vehicle. You can have it on your person inside the vehicle, whatever. Of course you can have it thus on "public roads". The only places you can't legally have it inside your vehicle without a permit is parked on school property or a posted lot. Instead of trying to get back to your truck for your knife, you could at least have had the gun waiting there instead. Of course, you can even use it outside the truck without a permit in legitimate self defense situation, too. You may also carry any type or size knife on your person. - OS -

You could call his record "mixed" on that . He kicked off some of the major gun restriction laws in Kali. Signed the Mulford Act which ended public carry of loaded guns. “There’s no reason why on the street today a citizen should be carrying loaded weapons.” Signed a 15 day waiting period into law there too. Supported Brady Bill. Made various public statements about how certain arms should be forbidden. Signed FOPA, which was good, except for the glaring exception of the machine gun ban (which was passed illegally by Charlie Rangel on a voice vote that clearly went the other way); he could have vetoed it on that part and sent it back, but he was clearly in favor of banning auto weapons period. Etc. - OS -

Unfortunately, if you obey both federal law and Terms of Service with carriers, there's no way to do that with UPS or FedEx unless you send to or from a licensee. Which only leaves USPS for long guns, and YMMV with them too. If you obey both law and carrier TOS, that means there is now no way at all to send handguns between unlicensed individuals. Carry your guns down here according to storage requirements of FOPA. In all the horror stories I've read regarding NJ, MD, NY, et al, not one of those folks was complying with the "safe passage" part of FOPA. - OS -
Okay, you seem to know, so I'll take that as a given, thnx. However, must be only part of the story, as federal excise firearm tax on handguns is 10% and Glock for example Blue Label pricing seems more like at least 20% less than average retail. - OS

Read deeper. Only the right to keep firearms in the home is a blanket sanction. And even this does not of course preclude all laws regarding which weapons and manner of licensing to do so. "Carrying" of weapons in public, the true meaning of "bearing" them, was still left to the states. There was no general admission that "bearing" weapons outside the home is within the scope of the decision, and several times in both the majority opinion and individual assenting opinions, the matter is left open as to the degree of regulation, echoing what Scalia had said even in Heller, that the exact scope of conduct permitted would have to be determined by future courts. Which is why most states still require a permit to conceal carry in public, and why there are still "may issue" states, which in most cases is still "will not issue". The federal court decision in Kali: https://www.nraila.org/articles/20141112/california-one-step-closer-to-shall-issue or one like it, will have to get to SCOTUS to at least see if "may issue" becomes the law of the land. And future ones will have to do same to include non-permitted carry. Until then, the right to "bear" is only incorporated as a general tenet, but not in actuality, as is possession in the home. - OS -

As I have already pointed mentioned, it only incorporated the right to "keep". "Bear" was not ruled on. With some cases seemingly working their way here and there regarding the "may" vs "shall" issue remaining in a few states, perhaps it will have to rule on that part too ere long. But almost certainly it won't go past that permitting process one way or the other itself. SCOTUS just isn't going to rule that you can pack heat anywhere in any state period, no way. Indeed, had even that "universal permit reciprocity" bill passed a couple of years ago, I feel sure they would have struck it down. - OS -
TWRA does not police the roads of road kill, nor donate roadkill to shelters. You, however, are free to grab most any roadkill you like. Exceptions: you must notify a proper authority within 48 hours in the case of deer, and you must still get a kill tag first to throw a bear in your trunk. :) - OS

I don't see any way the Supremes would see it as having standing to be heard there. Even if the right to "bear" is incorporated to the states, all the details about continuing degrees of "reasonable" legislation of that will be as ongoing as is the incorporated right to "keep", which of course is still incredibly limited by a number of states. - OS -
Firearm excise tax is paid by the manufacturer on every gun when sold to a distributor or FFL, so don't see how this gets "waived" on down the line. Are you sure you aren't talking about special LEO pricing from various makers? - OS

Only reason I mentioned it, got to talking to a Knox County cop at the range a few years ago, on topic of knives he showed me his original Cold Steel SRK, said he kept it in the cruiser just for putting deer and whatnot down. 'Cause of course any weapon discharge required review and paperwork and gawd knows what all. - OS

Again, 1359 specifically excludes parks type property: "This section shall not apply to the grounds of any public park, natural area, historic park, nature trail, campground, forest, greenway, waterway or other similar public place that is owned or operated by the state, a county, a municipality or instrumentality thereof. The carrying of firearms in those areas shall be governed by § 39-17-1311." Claiming that, what looks, sounds, smells, and feels like any of these, and indeed have long been referred to as such, and used as such, and/or even have these words in their frigging names, are actually something else just isn't gonna fly in the courts. Also add the additional language in 1311 that includes other rec properties such as certain buildings as further reinforcement that 1359 may well not be able to be applied to them either. - OS -

I can't see that argument at all. How is a permit in any way a deterrent to murder or other gun related crime? Indeed, having to have a permit actually creates crime, as anyone without one becomes a criminal, with no ill intent whatsoever. - OS -

Note that cities/counties are still allowed to ban carry by employees and contractors as per 1314, and indeed bar carry by anyone as per 1359. So the state legislature is still allowing local gummit to regulate that -- and one could well debate whether this remaining allowance "by proxy" of a state statute over the wearing of firearms is within the spirit of the brief statement in the state Constitution. Indeed, the legislature even includes its own digs under the blanket of 1359 "option" rather than a yea or nay specific statute. - OS -

No, you are correct about that -- local gummit could still ban park carry by adhering to 1311 only. Knoxville did nothing, so contrary to Mayor's and PD Chief's lamentations this year, it has actually been lawful to carry in parks here for a year already. I think from reading here, there were other places that were in same boat, including some who actually changed their local code after the fact, which of course meant it was no longer legally grandfathered in the first place. - OS -

No, WM, 1314 was amended last year, nuking all grandfathered local ordinances save for three areas of regulation, and carry in parks is not one of them. - OS -
What are you asking? There are import taxes on most everything imported into the US, so I suppose there are on firearms also. Yes, there are new AKs you can have that are not made in the US, but no new ones from China or Russia currently. And yes, they cost around $500 and up, but that's just what the traffic will bear, not the gummit's call. Domestic ones are generally higher, and there are also excise taxes for any US produced firearm. We pay a lot of excise taxes, like on gasoline, regardless of where the crude is from that made it. And you can bare your arms any time you want, in every state, and even in public. :) - OS
