ATF has never made a distinction regarding "permanent" or "lock in place" etc regarding a stock. They simply determine whether something is a stock or not based on .. well, based on their own say so. But now, they are extending SBR to include items that are NOT stocks, by their own call. Which so far include braces and cheek rests. By simply adhering to the USC definition of rifle, ie, "...designed or redesigned, made or remade, and intended to be fired from the shoulder." Assuming they remain consistent with this, then I don't see how they could assert that the device under discussion doesn't do the same, ie, redesign the firearm to be fired from the shoulder, the same determination they made with the braces and cheek welds, which they say redesigns the firearm when used against the shoulder. - OS

I don't know of any definition of "stock". Certainly not one in the USC or CFR. So whether it's "permanently attached" or not would seem moot. The definition of rifle does not use the term "stock", so I don't see how this is any kind of out. Especially since ATF as per Mad Max Kingery now states that even using something they've clearly said is not a stock against the shoulder still constitutes the making of an SBR. I'd guess the description of the interaction between the company spokesman and the ATF is likely not really very accurate, we'll see. - OS

So, even reading up quickly, I'm confused about the pin. Looks like new barrels don't come with the pin channel already cut, so you have to drill it? Does this mean you can't necessarily use a used barrel that already has the pin channel cut, sort of like A2 gas block pin channels on an AR? - OS

How do you get a barrel into dem thangs? - OS

Neither. Main procedure is to destroy the lens with tiny ultrasound gizmo and suck the pieces out. There seems to be some sort of laser "guided" assist that some use, but the laser doesn't do the surgery. - OS

Not really, I just read all the descriptions and picked the one I thought was best for me. Don't want any IWB that has attachment point or points on the already thickest part of the thing, so loops on each end a must. The "mike's special" sits lower than some of his others, which I liked. Have been quite pleased with it, wore it daily for about a year, but admit I've gotten in the habit of carrying a Kahr in the pocket most of the time for years now (but I miss the 13+1 capacity, really do): - OS

Mine's brown too. But I wear a black belt, so got the black loops. Just like the black metal clips it comes with. ;) - OS

I had to give up on the Dual Carry. The leather loop arrangement using those risers was just too clunky for me. Need a pair of black ones?

What he calls the Slim "Mike's Special'. He's actually using my photo to illustrate it (with permission). I really love the Dual Carry, but not the metal clips. Unfortunately, with that design, the leather loop option makes it too bulky with the upright risers necessary to put them in position. - OS

Kydex for pocket, but leather for IWB for me: TT Gunleather and my XD SC: - OS

Thread started about out of state residents carrying their heaters in vehicle, then in hotel added. Seems you contesting either is legal is the main divergence. ;) - OS

That's regarding non IL residents getting an IL carry license, not what we are discussing at all. - OS

Old FAQ from somewhere. Does not apply to out of state residents with a permit from their home state, nor obviously to IL handgun carry permit holders. Law regarding both transportation, possession, and carry of handguns and ammo under the new Firearm Concealed Carry Act is state preempted. The exception for non-residents with permits from their home states to possess such in vehicle is part of the Firearm Concealed Carry Act. Entire Act, see Preemption section http://ilga.gov/legislation/publicacts/98/098-0063.htm Summary by ILL Bar Association from: https://www.isba.org/ibj/2013/12/thenewillinoisconcealedcarrylaw "Preempting local regulation Preempting local firearms restrictions and the extent of control retained by home rule units was a focal point of legislative negotiations. As a result, the state preempts most firearms regulation but does allow home rule units to enact more restrictive ordinances in limited areas. The new law completely preempts local concealed carry laws and the regulation, licensing, possession, and registration of handguns and their ammunition as applied to concealed carry licensees and FOID card holders.18 Any local entity's attempt to regulate these areas will be voided. The Act also chips away at local control over firearms issues that are not directly related to concealed carry. The state now has exclusive authority to regulate transportation of any firearm or ammunition by FOID card holders. The state now has exclusive authority to regulate transporation of any firearm or ammunition by FOID card holders, even if they do not have a CCL.19 Thus, local entities can no longer regulate transportation of any firearm. Also, the state has exclusive authority to regulate possession and ownership of assault weapons.20 Local ordinances regulating assault weapons enacted before July 19, 2013 remain valid and may be amended in the future. But entities that did not pass ordinances before that date are preempted from regulating assault weapons. So to what extent do local entities retain control? The new preemption does not mention taxation and, therefore, home rule units retain authority to tax firearms. They can also regulate: (1) individuals who do not possess a valid FOID card or CCL; (2) firearms other than handguns; and (3) matters related to the sale, purchase, and storage of all firearms.21 For example, a city may maintain a database of those who have been convicted of firearms offenses. Also, a home rule unit can enact zoning ordinances affecting where a firearms dealer's business may be located. Clearly, though, the state now has exclusive control over a majority of issues related to firearms and local units retain little room to exceed the state's restrictions." - OS

Well, thanks, that is interesting: "Can I keep a firearm in my hotel room when I travel? Yes, assuming no local ordinance applies. The critical question is how the firearm was carried into the room and transported in a vehicle. Those actions must be done lawfully." Interesting that this doc was made in 2010, before any of the law changes we're discussing, so hopefully this includes out of state folks too, and not just residents with a FOID card. Didn't see anything in included state code to support it, but didn't read it uber carefully either; certainly the word "hotel" ain't in it anywhere though. - OS

I know of nowhere in IL law where this is stated? - OS

Sure looks like AOW as per ATF even if that muzzle device were permanent. However, did you know that the feds have never gotten a AOW conviction based on a VFG? The one case in which they brought charges was found against them with pretrial court opinion, and they dropped the charge rather than continue prosecution. So there's actually no case law precedent that their determination is valid. - OS

For the gun trivia part, the guy used a Hi-Point .40. - OS -
Passed over a year ago. Be sure to read section 65 though .. it specifies the places that locked vehicle is not sufficient, and a separate locked container is necessary, All horse pucky. The only thing approaching a "federal permit" is being an authorized federal agent or carrying under guise of LEOSA. - OS

One can only believe what one believes. A god that couldn't see through a hedged bet is no god at all. There are lots of gods that neither of us believe in. I just disbelieve in one more than you do. :) - OS

L.A. police find stash of 1,200 guns in dead man's home

Remember one big difference between Kali and TN (and the vast majority of other states): There, lots of common firearm configurations are illegal. Here, only certain unstamped NFA items are. - OS -
Everything is relative. With consistent cheek weld, you can hit COM at 100 yards and in with no rear site at all, so you'd certainly not be "out of the battle". - OS
