  6. Thanks for the clarification OS - I was confusing the 4473s with the bound book. The bound book has to be kept indefinitely and also turned over to the BATF when the FFL goes out of business.

  8. True but many FFLs still use the paper 4473. Even then, I don't know if the ATF has direct access to the FFLs computer files. They might still have to contact the FFL for information - but it would be much quicker to retrieve it from a computerized system than a filing cabinet full of paper!
  9. FFLs are required to keep 4473s indefinitely (edit: 20 years - thanks for the update OhShoot). The 4473 has the firearm serial number on it. When they close the shop, the forms go to the BATFE. The biggest difference in the 4473/background check and registration is that with registration the government could easily determine all the guns you own - probably with a simple database query. With the current model, if a gun is involved in a crime (and recovered), the government must go to the manufacturer to see which distributor received it, then go to the distributor to see which dealer received it, and then go to the dealer to see who purchased it. Not only that, but the dealer can keep their 4473s filed in a number of ways (including chronologically). It a laborious process to trace a gun.

  13. According to the story, he hit at least one of them. The other two criminals are at large - so we don't know if they were hit or not.
  14. According to the story, the shooter won't be charged. He fired on the thieves (not kids) when one of them pointed a gun at him. The criminals had stolen a truck earlier in the day and were attempting to add a motorcycle to their ill gotten gains. The 19 year old that was killed was on probation for attempted murder...

  18. Hey Dave, do you know of any case law, etc. to back this up? While a judge can force you to testify in a trial (under the threat of jail time for contempt) they can't, to my knowledge, force you to testify against yourself. There are lots of trials where defendants don't take the stand. Even when testifying in another's trial, you can plead the 5th and refuse to answer questions.
  19. The distances aren't published (anywhere that I know of) but they are in the course plan the state sends the instructors. The range requirements are pretty specific.
  20. The HCP class has to be state approved. Their rules state the course must be 8 hours (4 classroom + 4 range): http://www.tn.gov/sos/rules/1340/1340-02/1340-02-03.pdf. When I took my class (at G&L several years ago), the classroom portion was 4+ hours. The range portion required shooting in heats. You couldn't get your certificate and leave until all heats were finished though. Overall, it was 8+ hours.
