ATF's definition of "engaged in the business" ATF Changes Definition of “Engaged in the Business” Written by Ricky Zyvoloski | April 15, 2024 | 0 comments The final version of ATF Rule 2022R-17 has been submitted to the Federal Register and will go into effect 30 days after the date of publication. The Final Rule broadens the definition of who is “engaged in the business” as a dealer in firearms and finalizes many amendments to regulatory definitions. A person will be considered to be “engaged in the business” as a dealer in firearms, when that person: Resells or offers for resale firearms, and also represents to potential buyers or otherwise demonstrates a willingness and ability to purchase and resell additional firearms (i.e., to be a source of additional firearms for resale)” Repetitively purchases for the purpose of resale, or repetitively resells or offers for resale, firearms— (i) Through straw or sham businesses, or individual straw purchasers or sellers; or (ii) That cannot lawfully be purchased, received, or possessed under Federal, State, local, or Tribal law… Repetitively sells or offers for resale firearms (i) Within 30 days after the person purchased the firearms; or (ii) Within one year after the person purchased the firearms if they are (A) New, or like new in their original packaging; or (B) The same make and model, or variants thereof As a former licensee (or responsible person acting on behalf of the former licensee), resells or offers for resale to a person . . . firearms that were in the business inventory of the former licensee at the time the license was terminated… and As a former licensee (or responsible person acting on behalf of the former licensee), resells or offers for resale firearms that were transferred to the licensee’s personal collection…” The Rule finalizes the amendment to the regulatory definition of “Dealer” to clarify that firearms dealing may occur wherever, or through whatever medium, qualifying domestic or international activities are conducted. The Rule also “finalizes an amendment to the regulatory definition of “engaged in the business” to define the terms “purchase” and “sale” as they apply to dealers to include any method of payment or medium of exchange for a firearm, including services or illicit forms of payment (e.g., controlled substances). “Resale” is defined to mean “selling a firearm, including a stolen firearm, after it was previously sold by the original manufacturer or any other person.”” Providing services is considered a medium of exchange, so the ATF has codified their “historical exclusion for auctioneers who provide only auction services on commission to assist in liquidating firearms at an “estate-type” auction.” The ruling states that a “licensee transferring a firearm to another licensee, must do so by following the verification and recordkeeping procedures in the regulations, rather than by using a Firearms Transaction Record, ATF Form 4473.” “The final rule recognizes that individuals who purchase firearms for the enhancement of a personal collection or a legitimate hobby are permitted by the GCA to occasionally buy and sell firearms for those purposes, or occasionally resell to a licensee or to a family member for lawful purposes, without the need to obtain a license.” Without an FFL, an individual must ensure they are not “engaged in the business” and the transaction is not “to predominantly earn a profit”, which now focuses only on whether the intent of the underlying sale or disposition of the firearms is predominantly of the obtaining pecuniary gain. Individuals may continue to engage in private intrastate sales, without a license, provided the individuals are not “engaged in the business” and the transaction is otherwise compliance with the law.2 points

I just picked up this Springfield Armory SOCOM 16 at my FFL I made a trade deal for it off another forum I belong to. I'm thinking of a new project just got to figure out what. I am going to get a wood stock for it, I just prefer them to the "plastic" ones. Here's one pic I took after I got it home it came with the orginal Box, web Sling all the paperwork, some manuals, and one 10rnd. mag and three 20rnd mags. I'll post some more once I figure out what I want to do.1 point

Here's a 2008 M1A SOCOM 308cal. I got in a trade deal, It had the Factory Black Stock installed when I got it, I since dug around and found a Fajen Wooden Stock that I had and installed it in the wooden stock. It comes with everything shown in the pictures, and I added a padded cheek test to it. $1450 CASH FTF. I live in the Whitehouse area and can meet locally around Goodlettsville, Hendersonville, Gallatin, Nashville area. I can drive a little to meet halfway to make the deal. 1- Orginal Box 2- All Paperwork and Manuals 3- OD Green Web Sling( came with the SOCOM) 4- One Ten Rnd. Mag., Three Twenty Rnd. Mags.(they are not marked best guess factory mags.) Not looking for trades at this time. Thanks for looking, let's give this one a new home.1 point

My older boy likes Lego kits. I kinda think of them as cheating as I just had blocks (lots and lots of blocks) and had to use my imagination to build stuff. He's got Darth Vaders helmet, the Apollo lander, the Charger from F&F, a Vette, and a few others. Guy I used to work with had the Millennium Falcon.1 point

I won't unless I hold off on lesser things LOL. I'd dearly love to have a high end SAA or 1911. And of course, this one after the wood is put to it.1 point

If people bought a gun every time that notion crept into their minds....well, I guess some do. But, you'll be fine. Let your desires and your budget guide you, not the political situation. We seem to be in a nice area of both sides want to argue about it rather than push the issue one way or the other.1 point

You would probably love my bonus room then. Yes, you're also dead on about the therapy. I love the "tinker" nature of it. My son always wanted legos, so he would buy them and just couldn't be bothered to finish them. So I wound up doing it. Eventually he got a couple of the cards and so after i built them, he wanted to showcase them in my space upstairs. Next thing you know, i've got probably 15 or so. Eventually the fam just started buying them for me for birthdays, Christmas etc. I got this one last Christmas. https://www.lego.com/en-us/product/peugeot-9x8-24h-le-mans-hybrid-hypercar-42156 These days my son is much older and has his own job, so he builds the big sets. I don't even want to think of the money he's put into it. This is the last set he did https://www.lego.com/en-us/product/daily-bugle-761781 point

While I owned several classics in the 60's and 70's ( think 55 Nomad and 57 Bel Air hardtop) my first taste of a true muscle car was a 69 Road Runner. Damn I loved that car!1 point

I think a lot is going to depend on what happens in November. If Joe gets another term, gun sales are going to skyrocket as will prices. If you want one, now may be the best time to do so. But if you buy also consider going ahead and buying extra mags, ammo and accessories as they will also be going up if Joe wins. 7.62X51 - turning cover into concealment for almost 70 years.1 point

president and ATF can't enact or change the law. you would think the congressional yank on ATFs chain would deter this type of crap. Just another example of the fascist over-reach of the current admin.1 point

I got a Jeep gladiator in 2023. I have haven't been in the Studebaker since it got the Jeep. It's pushing a year. I took it out today to get gas and spray it off. It took more than hour because of the non English speaking individuals that want to take pictures. I got to hug some attractive Latino women. I'm convinced it's the only thing that can kill me it scares the hell out of me. I deleted 90% of what I had to say after this. Be good to you Wife and Kids. They will remember you. No one else will care1 point
