  1. You have no duty to retreat. That is something different than thinking Castle Doctrine creates a free fire zone. If you walked in and found a burglar in your home, your Nest camera is running, or he is live streaming as some criminals do, and it records him throwing his hands in the air, surrendering, and telling you he is unarmed, don’t shoot. You kill him. You will enter the courtroom with the presumptions given you under Castle Doctrine. The prosecutor will then blow those presumptions out of the water. That’s just my opinion though. I guess its possible the state would allow you to execute a surrendering burglar. But since they won’t let you kill a fleeing burglar; I doubt it. But those are decisions everyone must make on their own. My own personal belief is that when a person is committing a forcible felony they should have no rights. And should be subject to being shot or killed by the victims or bystanders. Unfortunately most folks don’t agree. Especially when the offender is a friend, family member, or a child. Our founding Fathers were a bunch of tough old guys that are probably rolling over in their graves when they see their words being twisted to hold the rights of a criminal above those of the victims.

  2. Took the ole lady out to the range to shoot her Christmas present! I’d say she done pretty good for a first time pistol shooter! Couldn’t help but take my new FN 509 along for the ride. Shot surprisingly good with 115g reloads.

  5. In all the vastness of the Universe, to think that we are the only intelligent (?) life is the ultimate in human arrogance. Have other sentient species developed space travel to the point where they can visit here? I don't know. I kinda hope they are that much more advanced than we are. But then again, if they are intelligent, why would they want to speak to this bunch of idiots? I believe Earth is kinda like the Detroit of the galaxy. Everybody knows where it is, its just that nobody wants to come here unless they absolutely have to.

  8. One of the best peices of advice I was ever given was "you can only take offense it can't be given to you" if someone says something that offends you then its your choice to take it to heart. God knows I've had to hold my tongue a few times knowing that I dont have anything to prove to anyone and that the offender is just a POS. That being said..... I don't expect everybody to share my sentiment.... if someone rattles off just right to the right person theyre gonna get their teeth adjusted eventually. But I digress.

  16. Until I was the ripe old age of 18 I lived less than 1/4 mile from Lake Superior and used to see some very odd stuff over that lake at times-things going faster than a air force jet-which we had plenty of also. KI Sawyer used to run drills over Lake Superior all the time.

  21. E4 I will try and address several good issues you have raised. First, it is entirely possible we had 'different' TN state HCP courses. Best I recall, got my permit in '96. The course has been modified by many instructors to include a lot of personal opinion, ad lib, shortened hours, etc. Plus the state has had official changes implemented over the years, the next one effective Jan 1, 2021. For many years the course was done by an official state mandated outline which left the door open for the above noted varibles. Over the past 4 years or so the outline was changed to a PowerPoint presentation which has to be gone over in its entirety. Minimal time for much ad lib. This is a positive change which gives greater consistency in the program state wide and thus less room (note I didn't say no room) for confusion. And don't forget changes in the law that can occur twice a year. I have been a state instructor for the past 7 years and am still active. In fact I have a course scheduled at Pellisippi State the 16th you are welcomed to attend and simply audit if you like. I routinely attend and read multiple legal seminars and discuss many of these issues with other instructors as well. So I do actively stay up to date, but am always open to discussion. To my best recall, I do not remember any car-jacking videos by the state. Maybe after I got my permit, but before I started instructing. The home breakin you refer to is still present. The robber was armed with a golf club he picked up in the home, but really does not make any difference. As you referenced, the law does state that it is assumed that someone breaking into your home is considered to be a threat of serious bodily injury or death, and one is certainly allowed to use deadly force. You seemed to confuse and reference SYG with Castle doctrine, which are two entirely different and separate issues. Also neither, as DaveTN noted, gives one a free shooting permit. Castle doctrine for the home and auto are similar, but there are some differences, those points have been discussed previously in this post, but again the most important is that your passenger compartment has to be breeched, not withstanding a firebombing or trying to turn your car over. Still much active debate in the gun community...as noted vehicle damage from banging on it...not a shootable situation, plus you can drive off. Finally I pretty much agree entirely with your last paragraph.

  23. How come you don't fence your property? While I'm no security expert, I have several layers of security at my house: Property is fully fenced and gated, I have a remote controlled gate opener and key pad, if I buy anything online you can include the gate code in the shipping comments for the delivery driver, driver enters the gate 45seconds later the gate closes, driver leaves there is a sensor along the driveway gate opens and closes 45seconds later, property secured. Roving dog patrol, sometimes this is a problem when drivers deliver, my dogs usually followed them out the gate, after a few times of looking for them I caged them on delivery days. Security lights, I have a street light on my utility pole and motion lights on my back garage. I have a couple cameras, I'll get more soon (better ones), I have WYZE cameras there inexpensive and will notify you immediately on your phone and back up to the cloud free for 2wks. Hopefully it all stops at the gate!

  24. And @chances R Realizing that neither of us were police officers in this state, you and I must have had completely different Tennessee-certified HCP courses. In my course they made it clear that if someone breaks into your occupied home then deadly force is authorized regardless of whether or not they present a clear danger to you or yours. They even showed a video of a few scenarios that were presumably also state-certified. One of those scenarios was the homeowner entering his house to find a burglar who was presumably unarmed as he did not have a weapon in his hand. The scenario did not have the homeowner retreating out the door that he'd just entered, nor did it have him hold his fire because there was no weapon in the burglar's hand. The video showed the homeowner standing his ground, drawing his weapon, and shooting the burglar. They also showed a video of a car-jacking. The instructors and the videos emphasized that if someone is illegally entering your occupied home or occupied vehicle then it is presumed with statistics that they are there to do you serious harm, and deadly force is authorized. Has the state-certified training changed since I took it? If not then the state cannot sanction an action with training and then convict you for doing it. Notice that I said convict rather than prosecute because the odd thing about this country is that both our federal and local governments seem unconcerned with prosecutorial misconduct or incompetence. In this case, the first thing I'd have my lawyer do is show the prosecutor the training video. But even a clearly good shoot is still going to cost you a good amount of money unless you are comfortable navigating the aftermath without a lawyer. I'm not that naïve. If I use deadly force my first call will be to the local law-enforcement, and my second will be to my lawyer. Having come incredibly close to killing someone, (justifiably), I know how upset that made me, so I can imagine how upset I'd be if I actually killed someone. There's no way that I'm going to talk to the LEO's in that condition without my lawyer present.

  30. Thanks for sharing @peejman ! I agree with you about our childrens safety, for the record... Once threw a shovel at, and started chasing the neighbor kid's car down the road, 'cuz the little SOB though it was a good idea to come around my corner at 40 mph every afternoon.... stopped doing it after that incident, but I'd digress. But at the risk of poking the bear, the instant you feel your rights supercede mine, is where I begin to have an issue, even though we agree on the conclusion. Strange, isn't it? To me, its similar to the attitude and way of thinking I wanted to get away from when I decided to relocate my family. I once had the school district superintendent (top dawg, whole county, 150k+ students) stand up in front of the entire school and TELL ME, my town was too white. So they were going to bus some city kids into my children's schools. He knew better than me how to raise my kids. Actually said so. I'd just have to trust him. I was the ignoramus for not being in agreement with his idea. I've been told by very well meaning people that are utterly convinced in their hearts that they know better, how I should drive my car, what TV I should watch, how to store my medicine AND firearms in my own home, and what kinds I should even be allowed to own (YOU don't NEED a 30 rd magazine...) All perfectly legal, all perfectly rationalized, supported by the PTA, local church, pushed for and propagandized by the local news. You're a whack-job if you don't agree. Won't somebody think of the children?!?! If it just saves one life.... Oops, there, I went and did it. Look, this is just an exercise in thinking things through. I don't mean to give the impression I'm this big of an A-hole... I'm deliberately playing devils advocate (for a reason). Personally I'm all for the greater good, community, etc. Didn't move to an off-grid cabin halfway up a mountain side for a reason... We give up certain freedoms in order to have this thing called civilization. I like the fact I can safely drive 15 min to a DG/o get a quart of milk. I can assume my neighbor doesn't have booby traps set throughout his property. That comes at a price, no? Even though I live on 15 acres out in the sticks, I can't start shooting off tannerite bombs in the middle of the night. Why? Because my rights don't supercede those of my neighbors, even if they are 1/2 mile away. The INSTANT you assume your way of thinking is superior to someone elses, you create a problem. Your experience with your former neighbor illustrates precisely my point: There would be no reconcilliation between you two, you both believe you are correct. Glad you feel self righteous. You should move North! You'd fit right in...

  33. Treat them exactly like you would any other neighbor. We're all pink on the inside! Who/how your neighbors are depends on who/how your neighbors are, even if they hail from North of the Mason Dixon. I've met plenty of jerks from both sides of that line. Lots decent folks, too. I moved my family down here to get them away from what I felt were bad influences (see, I DO care about my kids! LOL!) The simple tale of geriatric neighbors illustrates my point. I'd rather my kids know your neighbors than old Mr. Smith that I had. Crazy Joe was a friggin hoot though, every town needs a local crazy guy on a tricycle in women's dresses. Life just doesn't have the same spice!

  34. I have a long property line that goes over a hill. I could not see from one end to the other. I had a surveyor mark the line in a couple of places and drove in two steel posts to mark where I should mow to. After about a year my two posts disappeared. I got it surveyed again and this time I put two 8 ft pieces of telephone pole 4 feet in the ground with concrete. They have been there several years now. If my neighbor had come to me and asked me nicely to remove the steel posts, I would have. If I was sure he was the one that pulled them up without asking, I would put up a barbed wire fence along the property line. Asking before doing anything to another persons property goes a long way.

  35. I watched a news special the other night about the Broken Juvenile Legal system and it is not broken. It is almost non-existent. Some Officers have arrested a Juvenile for possession of a stolen fire arm at 7PM and arrested him 4 hours later and he had another gun when they arrested him the second time. He was released at 7:30 to his mother and she said he never went in the house but took off soon as she stopped her car at home. The police said that the system is just a swinging door. The singer that was killed during a car hijacking was shot by a 13 year old that had 5 prior arrests with 3 of them for stolen gun violations during the commission of a felony armed robbery. He was arrested with 3 friends for the murder and he is the only one still locked up and his mother said she hopes they try him as an adult and he gets a long prison sentence. During the report it was said that the zip code for north Nashville and Madison area has more juvenile arrests than any other place in America. Now with that said, if an officer shoots and kills one during the commission of a crime they want to hang the officer for doing his job!!! They asked one officer if he had any idea how to fix the problem and he said yes, just 1. Pass a law the permitted people the right to use deadly legal force to protect their property without fear of prosecution and it would take a short time and you would begin to see the numbers go down pretty quick. He said until you put some fear in these young people that they can be killed by the property owner they will continue to do as they please because they don't fear being arrested.

  38. Someone trying to get into your car certainly means to do you harm. I think that a reasonable person would call it a good shoot, but my opinion is worth exactly what you paid for it. If nothing else your incident has reminded me that I need to look into overriding the auto unlock feature on my Tundra. I hate that it does that. If I pull over for lunch, or I'm checking my phone before I go into a store, I want my doors locked, especially since my attention is not focused on my surroundings.
