But when someone gets drunk, gets behind the wheel of a car and then kills someone, do we ever hear that "cars and alcohol don't mix!"? I know I don't. I mean, God forbid the thought of banning alcohol or automobiles, which are just as deadly as a gun in the wrong hands, but we gotta ban all the guns! That'll do it!!3 points

The reason these ammo shortages are happening, is because one person panics and they buy all the ammo. Guy #2 comes in and see they're out so they run to the next store and buy all of it, or they wait until the day the new shipment comes in and buy it all out again etc... It's a vicious cycle2 points

Bottom line is his negligence was criminal. Feeling bad about it afterwards is not a defense to the crime itself. Should it be taken into account during sentencing absolutely, but he should still be tried for involuntary manslaughter/negligent homicide.2 points

I think that there is a need to seriously punish this guy. Yes he has suffered a terrible loss, however a ND killing someone fits the definition of criminally negligent homicide fairly well.2 points

The only way to prevent this kind of thing is for everyone to observe the rules of gun safety. Unfortunately, some people are just undisciplined in everything that they do, which carries over into how they handle a firearm, and this is the kind of tragedy that results from it.2 points

You must list a caliber. And although you can swap calibers as needed you must always have a 9mm upper to put on it. Or if you list 5.56 as the caliber you must always have a 5.56 to put on it. Anyway you do it you must have a caliber upper to match what is on the form. You use the existing serial number. It is better to have the lower engraved [u]BEFORE[/u] the paperwork comes back. If you do it then the firearm is not a NFA item and any FFL can handle it. Once the paperwork comes back the lower [u]IS[/u] an NFA item and the engraving must be done by a dealer that is licensed to handle NFA items. Dolomite1 point

This really puts this car thing into perspective doesn't it? For me I just really have to draw the line at automatic transmissions. Nobody really needs one of those and they are so dangerous because they make it easier for stupid people to learn how to drive. Just wondered if anyone has taken that class and if it would be worth the 100 dollars. I plan to load 9mm,40 and 45acp. They show you how to reload a 38 special but i suppose the basics would apply to the calibers i want to reload? If anyone knows of a better class any where i would be interested in knowing about it. One thing the video didn't mention - I got my butt busted when I got in trouble, smacked in mouth when I back talked, and often had to pick out a switch to be used on the back of my bare legs. I survived and learned a valuable lesson too.1 point

I shot ammo through a mosin that went through Katrina. It was corroded and rusted and shot just fine..... but thats a mosin. Hell the ammo was probably dug up from some field and then sold.1 point

Two things had to happen for this boy to be shot. First, the gun had to be pointed at him. Second, the trigger had to be pulled. If someone can't grasp the simple concepts that you should never point a firearm at anyone nor should you pull the trigger unless you are going to shoot something I don't see how any passive safety features would prevent this. It's like when I see stories of toddlers drowning in the family pool. All the baby gates and safety latches in the world won't help you if you aren't doing the basic steps of keeping an eye on your children.1 point

When I was a kid, I'd help my Dad take the tubes out of our old radio and take them to the Rexall Drug Store. They had a tube tester there. If they tested bad, they sold new ones in the cabinet below the tester. That was fun! Best of luck in your repair.1 point

Decockers must be engaged in order to do their job. If the father was so irresponsible that he couldn't practice proper trigger or muzzle discipline, then I seriously doubt that a decocker or even an external safety would have made any difference as they probably would NOT have been engaged. I know that's speculation, but the pattern was there. And the article says "It's not clear how the gun went off." Seriously? Again, they're just feeding the common misconception that a gun has a mind of its own and will discharge for no good reason. Makes it easier to blame the gun, I suppose.1 point

easy to be a monday morning quarterback,yes the man did a calamity of errors (these things are usually filled with multiple errors) but at the end of the day a boy is dead and a father is for the rest of his life going to be in misery if he does not end up killing himself from the grief RIP1 point

It’s pretty black and white to me. If a cop thinks your drinking is an issue and you are carrying a gun; it’s a problem. As Pain103 points out there is no BAC limit requirement. And even if there was a BAC limit most people have no idea what a .08 is. The OP asked a question and the answer is… No it’s not okay. Transport it the same as if you didn’t have a permit; unloaded and inaccessible.1 point

According to TCA, the only time you are immediately irrefutably guilty re mixing booze and carry is in a public establishment and you have even one sip of one alcoholic drink. But yes, possession under the influence is certainly just another gray area in TCA -- if push came to shove, you might get off with a BAC under .08 argued as a reasonable standard, or you might not. Certainly there's nothing in the carry laws to support either guess. There's also no requirement for a BAC to even be taken. To further complicate things, IF you violate the drinking in a public establishment, AND are determined to be under the influence, then besides other sentencing you lose your HCP for three years (even though you'd lose it for the duration of the sentence of the Class A misdemeanor anyway -- another unspecified part of the statute is whether the 3 years suspension is in addition to the Class A 'meanor suspension). So all in all, I'd feel rather nervous myself if my breath even smelled of drinking near beer, and won't even do that and carry (or drive). Who needs the possible hassle even if not convicted, eh? - OS1 point

Sounds like he was professinal. That said, he has no reason, nor right to disarm anyone who is in legal possession of a handgun with an HCP. If he conducted a search due to probable cause, and you didn't have an HCP then yes. He is a public servant, not an overlord or sheepdog. Sorry for the rant, it just gets on my nerves that any police officer thinks hes safer by disarming the man who openly discloses that he has a weapon and an hcp. The guy whos gonna shoot him at a trarfic stop isn't gonna tell him he has the gun beforehand.1 point

If the school parking lots are excluded from the law, make the schools responsible for the safety of those parking there and on their commute to and from the parking lot. Leave the schools open to unlimited liability for death, injury or rape, as well as pain and suffering. Then, tell them to pick: guns in the parking lots, or unlimited liability.1 point

Just one example, perp throws himself on his knees with hands up to surrender. At that point you no longer have that presumption, and the testimony of witnesses, or the forensics of a point blank head shot, etc could still get you charged with murder or manslaughter. Any provable circumstances that remove the "reasonable belief" part of the "Castle Doctrine" also remove the "presumption" for it. - OS1 point
