Many people seem to desperately look for a guarantee that if they are in the right they won’t be charged criminally or sued civilly. There are no guarantees. But I believe that one thing you can do to reduce the risk is your state of mind about how you would react in a deadly force situation. If you limit the use of deadly force to situations where you are truly in immediate danger of death or great bodily harm; your risk of being charged or sued is pretty low. Not what you think you could make someone believe; but what you truly believe. Not some interpretation of some law that you think creates a free fire zone on your property, or some misguided belief that you can kill anyone that you perceive as a threat. If you are going to carry a gun; know the law. Read it, and make sure you understand it. It’s not rocket science; but it also has many variables and is generally applied to a specific situation or set of circumstances. I don’t know how many times I’ve seen on here “I don’t care what the law says; I’m taking care of my family!†Taking care of your family implies that you won’t be going to prison; if you do you didn’t take care of your family. Situations and circumstances, they can change in a split second; be able to keep up.2 points

This. The actual State of TN requirement is that 70 percent of all the holes have to be in the black and touching the silhouette, no matter how little, counts as in the black. The target is a B-52 is pretty large. Someone has already mentioned this, but some instructors grade using the scoring rings, but that isn't specifically required by the State. Unrelated to the OP: The sad part is, occassionally, someone (while I was still doing classes) would fail the shooting portion. The ironic, yet funny to me part is, it was almost always the guy with the biggest attitude because he already knew everything. In the last class I taught, I heard a guy tell his wife, and I quote, "Don't pay any attention to their BS about how to shoot. I've been shooting all my life and that ain't how I do it, and I know what I'm doing." ...and yep, you guessed it, he wouldn't listen to anything we told him, and he scored a 62 or 64. His wilfe listened to what we told her, and she scored a 100. Of course, being the good instructor, I had to point it out to him.2 points

The Walther is a gun that will not last. The slide is made of pot metal, not even aluminum, and it has other issues as well. I watch the front sights pop off. The hammer springs break with regularity. It falls in the same category as the Sig Mosquito. I was told by the engineers at Sig that the Mosquito is designed to last 10K-15K rounds. That means if you shoot a brick of ammo a month, which is easy to do with a 22, the gun will be junk inside of 2 years. I have shot the Walther and it does feel good but I would rather have a durable, reliable gun than one that feels good. The Ruger MK series will last lifetimes because it is steel. The standard MK series, not the 22/45, has a all steel frame, steel receiver and a steel bolt. They will outlast any of us on this board and probably several generations of children. Heck it Ruger's first model was produced in 1949 and most are still as capable as the day they left the factory because they were 100% steel. Even the 22/45 will last a lifetime because all of the "working" parts are 100% steel. There are very few all steel 22's out there and of those the Ruger is the most popular because its price is reasonable. Dolomite2 points

People have been harping on the man's birth and hidden turban for so long that even if something legitimate came out, people would just dismiss it as just another moonstruck cow theory. We're in Verizon-Hell right now on their shared-everything metered data plan. We recently switched from the coveted Unlimited data plan when I added a line to our plan for my mom. Their records showed we used about 2GB per month on average and could realize significant savings with the new plan. Since then the different lines on the plan at random will suddenly report 50% data used and then almost an hour later report 90% used, then they fall back down. My wife had it out with them on the phone earlier and suddenly our reported data fell to something like 0.50 GB for the current month. Less than 6 hrs later it was back to reporting 50% used. Seriously... W T F. We've about had it with Verizon at this point. Their answer was for us to go ahead and upgrade to the next tier data plan or pay the overage and then submit to have it reimbursed to us. Um, not a chance in hell.1 point

In essence, you are correct. Although I am not aware of any case law on this statute, I believe one of two things could occur to end the lawsuit at the earliest stages: 1. If the shooter was adjudicated in the criminal court as having been justified in using force, the defense files a Motion to Dismiss and asks for attorney fees, costs, etc. in that Motion; or 2. Defendant asks for a preliminary hearing to have the judge determine justification issue. If judge finds that defendant was justified, same motion as mentioned above. Unlike the "loser pays" rule that went into effect in Tennessee this year, the protection in this statute is really strong. It is the only time I know of in Tennessee where the plaintiff ends up paying for the defendant's loss of income from defending himself. It is HUGE. Again, anyone can bring the suit, but they may wish they hadn't. But keep in mind, getting a judgment against the plaintiff is one thing. Collecting is another.1 point

Romney can use this pretty well if O declines. How damaging to a presidential candidate can it be to say " This guy would not provide simple papers to help a charity out and as a result millions of aid for said charity was lost" From a moral standpoint, that's a very nasty indictment.1 point

I agree that we have evolved into a divided country. I think the difference is, in the past both parties wanted basically the same for the country, they just disagreed on the best path to get there. We now have a fundamental difference on where we're trying to go. I fully believe in the statement, together we stand, divided we fall, and we sure as crap aren't together right now. Unfortunately I think we're living in world of Atlas Shrugged except I'm still waiting for John Gault to show up.1 point

I noticed that witch's Romney/ Israel comments, too. She is such an outright liar. Don't bend the truth when you can just flat out lie. I am extremely conservative, so don't throw rocks at me, but.... if Obama could have been a "moderate" Democrat instead of a total socialist, he could have been a really good president. Politics aside, he is likable. He could have been everything his 'followers' made him out to be. That's sad. Having said that, Obama tops my hate list. His true agenda is evil. But it was a well orchestrated effort to get him to where he is in such a short amount of time. All of his enablers/ puppeteers need to be ranked right there with him at the top.1 point

I agree. I don't know any lawyers that would take on that kind of case. FYI, asking for a cash retainer up front on what might normally be a contingency fee case is usually what lawyers do to make someone go away if you think their story doesn't make sense or their case will be have a problem. It is much easier than telling someone you don't believe them.1 point

Only a fool thinks he can survive, shooting every zombie he comes into contact with. Not one to be a fool, I took this old crusty roofing hatchet and spent some time with it. I ground off the BS and contoured it a bit. Then I smoothed it out a little and put a razor edge on it. The handle was short and rotten so I set about making me one with a touch more length. The center is teak with purple heart scales down the sides and the pommel scales made from bloodwood. Couple dozen coats of BLO until it wouldn't soak up any more and tada! I'm no wood worker, but it feels decent and is more than capable of severing some undead brain stems.1 point

The operative part of that statute is in the last provision that says "if the court finds that the defendant was justified . . . ". For this protection to apply, some court (either a criminal court or the civil court in the negligence lawsuit) has to find that the defendant was justified. In my opinion, the only real protection provided by this is two-fold: 1. The self-defense criminal statute provides a specific framework for the determination and that can be decided by the judge (rather than a civil jury); and 2. There is a potential for the Plaintiff to have to pay for the Defendant's costs. There is no blanket prevention from having a lawsuit filed against you. However, the threat of having a judge (probably at an early stage) determine that the lawsuit should be dismissed AND the Plaintiffhas to pay the Defendant's costs is better than any other civil lawsuit I know of.1 point

Actually most new lawyers come in the fall. Majority of law students graduate in May, take the bar in July, and get licensed in Oct/Nov, assuming they passed. If it were me, I'd certainly want up front from the defendant (the armed citizen). If it were a criminally justified shooting I'd tell him or her that the law allows us to recoup attorney fees, etc., but (as others have pointed out) don't count on that actually happening. As for the shootee, I wouldn't even take that kind of case because that's just not what I do, but if I was a plaintiff's lawyer and it was clearly a justified shooting I probably still wouldn't take it. If the client broke out the checkbook and said, just tell me what number to write, I would put it in the fee agreement that they understand the difficulties of the case and that they may end up paying more, that there are no guarantees, etc. But if it was an unjustified shooting and it looked like there was a deep pocket somewhere, I'd probably take in on 1/3. It would have to be a pretty sleazy lawyer to represent a plaintiff on contingency where the shooting was justified. Even a bottom feeder will realize that's not worth their time.1 point

Let's not kid ourselves, though...if a bad guy is willing to do a little homework, there are plenty of signs to indicate that a person may be carrying or will at least make a bad guy think you are.If you go walking around in a "concealment vest/garment" or have a fighting knife with the head of it sticking out our your strong arm front pocket, etc...you could be made. People who don't carry may never notice but people who do or those who need to know based on their chosen profession may be able to tell or at least make some reasonable assumptions. That's why, except for the rare occasions when I'm carrying openly, I go to great pains to make me NOT look like someone who is carrying.1 point

Yes, this was done several years ago and it was far from a fair or accurate test. Two specific problems related to it that I like to point out is: 1) Nobody (as far as I am aware) has attempted to replicate the exercise in a fair way, and 2) As long as nobody puts together something to replicate this exercise, the original will continue to be peddled by the anti-gun crowd as "evidence" that CCW laws are dangerous. The sheeple are too ignorant to know the difference. I'd also like to point out the exercise was put together with the help of a police department, which is from the days when MOST cops were anti-gun. That was when I first started in law enforcement and I was one of the few cops who believed that people had a right to carry a firearm. EDIT: Ya know, I'm in a position where I can actually try to replicate this, except under more legitimate conditions. Maybe I should put my money where my mouth is.1 point

How do I do it...... I don't. I used too, but like you I just find it uncomfortable. It really requires you to buy pants a size bigger, so then if you don't carry IWB then those pants don't fit right. I have just gone to OWB almost exclusively. When I didn't carry IWB I found the Comp-Tac MTAC holster to be pretty comfortable.1 point
