  1. I was a police dispatcher at the start of my law enforcement career (thankfully that job didn't last long before I moved on to patrol). Unless things have changed, dispatchers have no lawful authority to order a caller to do anything. In fact, they have so little autonomy, they are generally prohibited from giving any sort of legal advice or provide instructions that are outside of the scope of their training. For example, to give first aid instructions over the phone, the dispatcher must be specifically trained in "emergency medical dispatch" or a similar type of training. The reason for this is obvious. A dispatcher is not trained in the law and they aren't at the scene to see what's really going on. If they give bad info, they can be held responsible.

If I am flat on my back with an adversary sitting on me, pounding my face with his fists and bashing my head on the concrete, and if the adversary is struggling with me for my undrawn and now uncovered weapon, I am in fear of my life. I will shoot him before I lose consciousness and before he shoots me with my own gun. If this is the scenario, then there is no jury that will convict. If we have to go through all the play-acting of a trial to mollify everyone to get to this conclusion, I don't like it, but so be it. Upon acquittal, I would file criminal and civil charges against those who attacked me and my reputation in the media. I am not a public person, and therefore the libel & slander, and fear for my life, and loss of freedom, and loss of income that arises from maliciously edited 911 calls and the wanted dead or alive bounty statements would be actionable to the tune of millions of dollars. There are plenty of lawyers that would be perfectly willing and eager to take 30 percent of that business. Someone else can speculate upon a different scenario with different details; this one, I think, is relatively accurate in description and outcome. Time and a court trial will tell.

  3. If he's acquitted we'll see riots just as we did in the Rodney King fiasco. My estimation, (based on limited information), is that Zimmerman has just been roped into a huge legal debt just to temporarily appease the masses. I don't think that he could possibly get a fair trial, but if he's indeed acquited we all better be locked and loaded.

  4. I think (hope) some fairness just entered the picture. Nobody wants Zimmerman to get away with murder. It's ALL gonna come out now. I'm sure we'll quarterback the whole thing

  5. Mollifying the mob of peasants with torches and pitchforks that formed for this case will only postpone the inevitable conflicts. Al Sharpton and Jesse Jackson will just go trolling for another case to inflame the masses. I'm thinking there is a real chance for an ugly ugly Spring Summer and Fall. If at least one metropolitan city center does not burn in riots ala the recent London riots, I will be very surprised. Keep your powder dry and your Eyes -- Eyes Open.

  6. However, she was not collecting in 1935. Nobody that had any immediate or even shortly to be realized vested interest in supporting passage of the legislation is still alive. Even a 100 year old today did not start collecting until 1973-77. It's really not valid to criticize folks who have had no choice about paying into the system for taking out of it. - OS

  7. I think it's funny everyone is hung up on part of a drill that is fifteen seconds of a two day, 18 hour course. That, if you didn't want to participate, you aren't required to. Mike

  10. If you are on the ass end of and ass kicking, how do you decide if the guy doing the ass kicking is going to stop before he kills you or causes you permanent and/or life threatening injury? Do you wait until just before you go from a mild concussion to near unconscious and then respond? I'd really like to know the answer to that one because I haven't been able to figure it out yet. I can say that is some stranger who is a half a foot taller and 30 years younger than me decided to jump on me some night I'm probably gong to be in fear for my life...maybe I shouldn't be and maybe someone else wouldn't be but I probably will be and if I'm able to get to my weapon I'm probably going to use it. And, if by shooting my attacker I stop the attack before he actually does cause serious harm which means I don't need a lot of medical treatment at the scene, does that mean I couldn't have been in legitimate fear for my life? Do I have to prove my life was truly in danger or only that I had cause to think it was? I'm not suggesting who is right and who is wrong...just trying to understand.

  12. If I'm in MY HOME, and someone enters, I believe they are the ones who need to dial 911...not me! I think 911 operators want you to take a non lethal way out. However, they are not there to see what's going on. If anyone enters MY HOME and refuses my command to "get on the floor".....they are going to floor the anyways. I feel for their next of kin.....

  15. Just because the first DA chose not to charge Zimmerman means nothing. It happens all the time. Cops say "charge this guy", DA says "not enough evidence", police gather more evidence. In this case it went a little different, but if it resulted in the collection of more evidence that points toward a crime then isn't that good? Don't we want people who commit crimes to be prosecuted? I don't care how wrong the media or Al Sharpton is, it doesn't excuse someone illegally killing another person and getting away with it. 2nd degree murder..... me thinks there is more evidence than we have available to us.

  18. A President can say that all day long but it's meaningless because the President has no power to make it happen. A president, if he is popular enough and/or if his party holds power (or a lot of the available power) in the legislature then he can set the agenda and push for change but a lot of the power of the president is in his ability to block or not block change by virtue of his veto power. We aren't going to change anything overnight - you aren't going to end SS by the stroke of t pen and even if you could, I can't imagine a more cruel act than to steel money from people all their working lives on the promise that they'll at least get some of it back only to tell them "sorry...try the dumpsters behind Kroger for your food.". Changes will have to be done in a way that is gradual with everybody losing some but not some losing everything. So what if we don't change it back to 100% of how it was...that doesn't mean we shouldn't do it nor doe is mean that armed rebellion is an answer - first because it probably wouldn't be successful and even if it were successful there is no guarantee that the government put in place will be one that is actually better than the one just overthrown. It may be different but not necessarily better. The only real answer is getting people to vote and to vote for the betterment of the country rather than for what the government will give them. If we can't get people to do that...if the welfare/entitlement generation continue to only vote for their own selfish interests or if people who know what is needed refuse to participate (and would rather just complain about the lack of quality candidates) then our course will not change.

  19. What are you arguing? In TN we have to fill out 4473 and NICS (through TICS) is run. In states where carry permit suffices, they still fill out 4473, just no NICS is run, but they check to see if carry permit is valid. That was what the proposed statute change in TN was going to do. The federal gov decides which states may do this, but the state still has to choose to do so. Are we actually in disagreement of anything? - OS

  20. Okay, semantics. The fed decides if state is allowed to substitute carry permit for the 4473 background check. Better? Yes, you still fill out the 4473, correct. Just that background check is not run through NICS. However, the states that are allowed to implement this still have to check that the carry permit is still valid at the time of purchase, as I have read. - OS

  21. The federal government decides if a state can substitute carry permit for 4473. Has to do with fed's standard of state's level of back ground checks, and also perceived communication between LEAs, court system, and permit issuing department. I believe about half the states are now allowed to, but only a few actually do. TN is allowed to. The recent bill in TN legislature to allow it had provisions to raise HCP cost enough to be revenue neutral on projections of HCP holders' purchase of guns from FFLs. The formulae they used to determine that was available somewhere on line. - OS

  22. Well, okay not being legal to purchase a handgun is grounds for HCP revocation or suspension, so I'll rescind my previous statement and give you that one. If indeed TNDOS is alerted at same time as bench warrant is issued, guess that could trigger it. Then again, if you don't pay a traffic fine or show up to contest it, I'd opine you aren't responsible enough to be carrying a heater either, so ultimately I guess I still don't see your point as to why this is unjust or something. - OS

  25. i really think u would really like the sig 238 i went through almost every polimer pocket gun on the market,yeah alot of money and ammo. got the sig and am very happy use a desantis nemisis pocket holster. it actually shoots like a much larger gun,pricey but worth every penny.

  27. I have taken apart and put back together a crap load of FN M4, Colts M4..A2 and A3's and have never seen that kind of wear from a charging handle on it and the upper. Especially on the anodizing on the inside of the upper. Something appear out of spec on a new rifle. I would take better pictures and email Daniel Defense on a new rifle. Maybe others can shed more light. Bottom line I would want the company to repair it. Just goes to show that the upper end AR's have issues also.

  28. P238 is the only gun i have ever carried in my pocket successfully. I tried the j-frame and pf9 with no luck. The Sig fits well and doesn't weigh too much. I'm not a huge fan of .380 but its better than nothing when you can't conceal a compact weapon.....
