Choosing to take up this issue on an “Invasion of Privacy†or “Surrender of Rights†platform is no different than the anti’s saying that we (those that carry) may harm someone or cause crime rates to rise. One may happen in limited cases, the other is fiction. Gun owners that were legally carrying with permits have shot innocent citizens and murdered Police Officers. Should we outlaw all carry permits because of that? I think not. Some people see any search as a violation. That was not the intent of the 4th amendment and protecting criminals certainly was not the intent of our founding Fathers. Search subsequent to an arrest, plain view, and exigent circumstances, are all present in this case. I don’t see how an Officer could have much better probable cause. However, when you have been sentenced to 10 years in prison and the state is providing legal assistance; you can file this kind of non-sense.

  3. You don’t see any difference in searching a suspect that has just been arrested dealing drugs in an undercover buy and searching a law abiding citizens that is not suspected of any crime but merely wants to get on an airplane?

  6. He can go to a clinic after spending a few months in jail and I don't mean an air-conditioned jail with cots and cable TV...this is when we need just a big fenced in area like Sheriff Joe uses...let idiots like this actually be punished for being this stupid and dangerous.

  10. You can’t tie the hands of law enforcement on what someone may do any more than you can arrest someone for something they may do. All evidence whether obtained in what we (the public) feel was a “justified†search or not will be challenged in court by the defense and will be ruled on by a Judge. That’s one of the reasons we have Judges; cops make the decision to search in minutes and then the system takes weeks or months to debate whether they made the right decision or not. The fact that a search is thrown out doesn’t mean the cop is bad or had ill intent. As technology progresses it will be tested in the courts. You see accessing a drug dealers cell phone to get the number so you can get a warrant for the records as a violation; I see it as good Police work that put at least one street thug in jail for 10 years. Could someone use their wild imagination to think up a scenario where innocent citizens’ rights could be violated? Sure, but that will be dealt with when it happens.

  11. The 4th amendment protects you from “unreasonable searches and seizuresâ€. I searched hundreds of cars without a warrant. Houses are harder, but given “Plain Viewâ€, being called there, etc.; warrants aren’t always needed for them either. They weren’t Rummaging through his phone to see what they could find; they accessed it to get the phone number, they then subpoenaed the call records. They successfully made an argument that evidence could be destroyed. Being a criminal is not always fair; the good guys won one. No rights were trampled.   12. I agree. Also, I didn't mean my post to be a criticism of the OP. I think I was simply putting myself in the situation and thinking that such possibilities are why I tend to prefer at least 'casually concealed' carry (doesn't mean everyone should.) I like to think that I generally maintain pretty good situational awareness but know myself well enough to realize that I sometimes get distra...oooh, look at the birdie!

Just like the "guns-in-bars" bill, which you were DEAD WRONG on, but refuse to own up to and admit that you were wrong, you are wrong about this. Every time you write one of your hit pieces on gun owners, you sink in credibility, but that's your choice. It's fine to have an opinion about something, but unless it's grounded in fact, then as my dad used to say, it's about as useful as teats on a male pig. Please stop lying about gun owners.   23. Yeah, me too, I keep ones and fives in same pocket as gun, so I generally give them one or the other. Seriously, though, I walk a lot to downtown, so I run across any number of street people, and generally give 'em a couple bucks, sometimes before they ask. Few times I've given a double sawbuck to folks in small hobo jungles when I walk the urban RR tracks. I see it as partially in lieu of a "tithe". - OS
